And finally not polling per se but perhaps note-worthy:  Have black protests helped or hurt the Democratic Party? “Examining county-level voting patterns, I find that black-led protests in which some violence occurs are associated with a statistically significant decline in Democratic vote-share in the 1964, 1968 and 1972 presidential elections. Black-led nonviolent protests, by contrast, exhibit a statistically significant positive relationship with county-level Democratic vote-share in the same period. This could be a recurring theme.  I got exasperated during a recent discussion the details of which I'll omit.  My interlocoteur was simply factually wrong.  It was a question of Constitutional text.  It was not an "opinion" issue.  It involved a factual assertion.  I finally exploded and observed that her Cheerleading Advisors Certificate made her a MUCH greater expert on the subject than did my JD.

In an op-ed in last week's New York Times, Vice President Joe Biden says that he “believe[s] strongly that the Constitution, clearly and plainly, calls for 100 senators to advise and consent on nominees”—and that (as I understand his argument) the Senate therefore has a constitutional duty to give a Supreme Court nominee a committee hearing and an up-or-down vote on the Senate floor.

It simply doesn't.  Period.  I've asked many a leftist to show me.  The most common response has been "I don't have tie to find it." 

It’s quite an achievement to do worse than Joe Biden’s blatherings on the Senate’s role in confirming a Supreme Court justice, but Texas A&M law professor Meg Penrose, whose astounding confusions have caught my attention before, has pulled off the trick.

In an op-ed for the Austin American-Statesman, Penrose claims that an originalist approach to the Constitution compels the conclusion that the Senate is not entitled to “withhold all consideration” of a presidential nominee but must instead give “some form of consent, including, importantly, disapproval.”

And then there's Tribe vs Tribe.  Note:  I learned my Con Law in Law School from his text. 

Compare and contrast:

1. Earlier this week, Larry Tribe signed his name to an idiotic letter to the Senate from some 350 law professors contending that the Senate has a “constitutional duty” to give a Supreme Court nominee “a prompt and fair hearing and a timely vote.”

2. Back in 1985, in his book God Save This Honorable Court, Tribe set forth the obvious, but contrary, reality that “The Senate has ways of blocking Supreme Court nominations other than by straightforward rejection in a confirmation vote.” To illustrate the point, he cited an instance in which the Senate “killed” a nomination “by simply refusing to act upon it.” (Page 82.) (Tribe’s example happened to involve a mediocre candidate who ended up asking for his nomination to be withdrawn, but there is of course not one Appointments Clause for some Supreme Court nominees and another one for others.)

As I noted before, there are plenty of other reasons that Tribe can’t possibly believe the constitutional claim he signed his name to this week (and why no other minimally competent law professor could either).

Let me begin this monring by noting that it has come to my attention that I have <gasp> at least ONE progressive reader.  They are reluctant to post responses or comments because they don't want the discussion to boil over into our real world.  I respect and appreciate that but I also encourage responses to foster polite, reasoned discussions (realizing that my posts are occasionally harsh or at least feeble attempts at humor.)  Nuff said.
