Policeman indicted, held in death

Man was shot in face during incident at home

        HAMILTON — Police here arrested a New Vienna police officer after he was indicted by a grand jury in Clinton County on charges of murder and tampering with evidence.

        David Michael Mueller, 29, was taken to the Clinton County Jail. He's charged in the Feb. 4 shooting death of Robert Cundiff, 32. Mr. Cundiff was shot in the face after his wife, Bobbi, called police to their Rice Street residence in New Vienna, a rural community about 50 miles northeast of Cincinnati.

        Mr. Mueller is a resident of Hamilton in Butler County, where city police arrested him Tuesday after receiving word that a Clinton County grand jury had indicted him.

        Hamilton Police Chief Neil Ferdelman said he and officers in five marked cruisers participated in an “intense felony stop” of Mr. Mueller on Ohio 129 at Ohio 747. Mr. Mueller was a passenger in a vehicle that had left his home in the 300 block of South C Street, police said. He was arrested without incident, police said.

        Col. Ralph Fizer Jr., Clinton County sheriff's chief deputy, said Wednesday that charges against others could follow because some village officials refused to cooperate in the investigation of Mr. Cundiff's death. The sheriff's office said some village officials stonewalled on records requests, prompting investigators to obtain a warrant to search the municipal building Feb. 8.
 

        Mr. Mueller had been placed on administrative leave.
