STORAGE SCENARIO & SURVIVAL

Please be advised that the following is a synopsis of events that have occurred in the last six plus months in relationship to my emergency circumstances created when I was illegally evicted from my office on February 3, 1999 by Judge Moy, Presiding Judge of the Law Division of the Dupage County Court.

The Judge heard my motion in a very grave matter ex parte due to the fact the Plaintiff's attorney had motioned it up via an obscure local rule which he did not cite in his notice. The Judge then issued an order denying my motion for sanctions taking issue with the death threat, "you belong in a box buried", stated by the Plaintiff Charon Vantellingen. He then denied in same motion my motion to reconsider and ordered that I be evicted in effect instanter and I was given no notice of same order on February 2, 1999. I was thus denied the right to file a motion to stay the order until proper evaluation of my motion could be heard. Dupage County Sheriff's Deputies ordered me out of my office on or about February 3, 1999 at 10:45 A.M. I was given the choice of going to jail or leaving. I submitted to the eviction with protest that the order did not have to be immediately carried out noting that it stated I "maybe" evicted immediately and that I had been denied proper notice.

After the eviction on February 3, 1999 all my equipment was sent to the dumpster area. I had no immediate alternative for storage of my valuables which included court records and research, computer software and hardware and electronics books, tools, equipment and supplies used in my electronics service business of twenty years.

During the eviction I called the Seventh Circuit Court of Appeals to let them know that the injunctive relief that I had applied to them a week or so prior was in fact needed immediately an I was told that they were taking same under advisement. Same injunctive relief was never realized on February 3, 1999 and that actual motion was not acted on until approximately nineteen days later and denied.

I then called those that I thought were my friends and after weathering the cold, rain and snow of February 3rd and that extreme cold of February 4th 1999 outdoors by the dumpster in a make shift shelter the two men suddenly appeared to give me an assist in moving my property to a storage. They appeared of their own free will with no demand for payment.

These two men helped me relocate my property to the least expensive storage that I could find. They had suggested taking my property to the another storage. The storage fee was approximately $30 more per month than the storage finally agreed upon of which I suggested and same was approximately 50 square feet less than the storage we came up with a more cost effective alternative.

The only problem was that I could not put the storage in my name due to the fact that I had already a storage that was in arrears at the facility suggested by myself. The man had no problem with putting his name on the contract so to shield me from any denials of additional storage with the selected storage company. When the man had set up the account it was understood not to mention the other storage in my name. It was also understood that he would have access to the property entrusted to me if something should happen to me.

The man took me to a store where I had a key cut in duplicate so the man could have access to the property of issue under the circumstances of something happening to me. The key was then tried in the man's presence so to make sure that it worked in the lock to be used on the locker. The key worked and everyone was happy. No other access was to be had by anyone except me in any other circumstances as noted above.

The property of issue was moved from the Vantellingen property in approximately a day and a half: starting on or about Thursday, February 4, 1999 and finishing on or about Friday, February 5, 1999. Approximately six pickup truck loads were hauled to the lockup. The man then helped me get integrated to a P.A.D.S. shelter site. We agreed that if he needed to get a message to me he would meet me at the First Congregational Church in Downers Grove which is located in the heart of Downers Grove, Illinois. The reason I felt that this was the best place to meet was due to the fact that it was probably the closest and easiest site for the man to get to from his home on Lemont Road south of I-55 and because it was available on Monday of each week, the beginning of each week, so to make convenient communications.

At this point a problem started to begin, The man and his brother-in-law started showing up randomly and unannounced at other sites on numerous occasions. Toward the end of the season, approximately in April 1999, they showed up at St. Mary's Gostyn in Downers Grove and came into the meeting area and the man began a tirade about his failure to find me at the Clarendon Hills Presbyterian Church the last Saturday Prior and condescended on me as if I were a child, perhaps, his child. Simply put he became very parental. He not only made a big issue of same but inferred that I was lying when I said I was at that church that night. He insisted that he could not find me there and I said check with my peers that saw me there. He was extremely bent out of shape in such a way that it suggested that he thought I was out partying or the like.

The fact is that the man was so sure that I was being unfaithful to my commitment to him in getting income so to reduce his outlay to the storage that he was clearly paranoid and approaching incoherence even when witnesses confirmed my presence at the church of issue. The man's actions suggest that he had been stalking me. It is clear to me that I had made no agreement with anyone as to what sites I would be attending on an absolute basis. As P.A.D.S. people know, there are sites in the south, middle and north sectors of Dupage County, Illinois. I was mainly attending the south sites and especially the site at the congregational church as mentioned above so to be sure that I would be there to interface with the man should he show up as agreed prior.

When the P.A.D.S. program ended on April 30, 1999 I had to find alternative shelter. I first tried the Hesed House in Aurora and was allowed only one night stay since I was not domiciled in Aurora, Illinois. (I noted that approximately ten churches from Naperville support Hesed House in Aurora and I am domiciled in Naperville!). The man indicated his preference that I go to Hesed House rather than a shelter in Chicago. My gut feeling in keeping with the above stalking context was that his preference was designed not because he felt that it would be better for me but that it would be better for him to keep tabs on me.

I definitely sensed the man's distrust of me and I have no knowledge as to why he was so paranoid of myself. At this point let me note that I owed the man at least $300 to $400. Three hundred dollars for storage rental and approximately $75 in working cash for phone calls, bus and food if necessary, i.e.: approximately $25 per month in spending money for the first four months or approximately $15.83 per month for 6 months.

On May 1, 1999 I went into Chicago to seek shelter. During my stay at various shelters I kept in phone contact with the man, his son and his brother-in-law. My contacts were especially for the purposes of coordinating some work to be done for the man and his son. I did same during the month of May. Same work was with the intention to mitigate the money extended to me for storage and spending money. The man's son extended $30 to me in appreciation for the help at his home. My understanding was that I was to be paid at my standard rates which was $40 to set up the call and $25 per hour there after plus parts if any. I put in approximately eight hours at the man's son's home and another eight hours at the man's home. The jobs were not finished. The man and his son discouraged my coming back till they had completed some other pending construction and the man's project was to be researched and completed when I was able. The grand total of my labors at my standard rate totaled approximately $455.

On or about the third week of May I was given another $20 to repair a broken axle on my bicycle. My total owed the man was then approximately $395. The May, June and July storage Payments added another $300 and same grand totaled to $695 owed the man minus $425 I had coming from the man for my work. At that point I owed the man a total of $270. On May 28, 1999 the man wrote me a letter and put it inside my lockup with a note on the outside of the envelope stating that "the key you gave me does not fit the lock", WHICH SEE. The letter was found on the floor near the front door but back near a box of papers approximately a foot inside the door. Again let me reemphasize that the key did fit the lock and it was demonstrated to the man and his brother-in-law when we locked the door on the storage shortly after having the key cut. It is my recollection that the key was cut at the Ace Hardware in Lisle, Illinois on Main Street: WHICH SEE. . The man specifically requested the key copy in the context of "if something should happen to me".

The fact that the key was obviously tried shows that the man was in bad faith with me in regards to his intent to having the key. It is my belief that the man opened the lock and thus tripped my security devices and stuck the letter inside the garage door rather than merely sliding the letter under the door AND/OR, was spotted by someone who knew he was not to be in the locker or attempting to get in the locker (5-26-2000). In afterthought, to cover up his bad faith entry or attempted entry at that time (5-26-2000), he wrote the note on the outside of the envelope saying the key did not fit the lock: WHICH SEE. It is my belief when he opened the lock and hasp he realized he tripped my security devices and/or was spotted trying to open the lock and/or entering the locker.(5-26-2000) It is unknown if he entered the storage physically to have a look around. By opening the door at anytime without my specific prior knowledge, permission and presence (5-26-2000), obviously, the man had a look around in bad faith.

Let me emphasize the key was given to the man for the sole purpose of accessing "my" storage property, by his words, "in case something happened to me". Nothing "happened" to me and he should not have entered my storage without my explicit and direct permission. It is my contention he violated more than a contractual agreement but he also violated the law. He violated my right to privacy, he violated my privacy by trespassing, he violated my privacy by breaking and entering.

It appears and comes across to me that the man has a very parochial and one track mentality, in my observation, and that is that when someone goes into the "big city" it is for one purpose and that is to "live it up" and participate in activities of which one would not participate in ones own community. His evident paranoia and presumption is manifest in his need to know where I am at and what I am doing. He concludes that if I don't have a job "right off the bat", I am not in good faith with him. He presumes that everyone should be able to get a job instantly and that if they have not they are goofing off, partying, wasting "his" money on "frivolous" activity.

The man has had a very terse and critical attitude toward my work and quality of my work. He has very little tolerance for circumstances beyond one's control as he is a results oriented individual. If one fails to perform in the manner he preconceives, one is incompetent, unreliable and doesn't know what he is doing! It is interesting to note that customers who have given me trouble and exacted a theft of my services have also a similar method of operation.

Other suggestions of the above are in his authoritarian opinions and assumptions. For instance: when we first met one of his first comments was "shave off your beard". I told him that I have been wearing my beard since 1978! Another example was when we were loading property into the storage: he told me where to put my property in a storage that I was organizing. He assumed that I did not know how to store property and would keep telling me not to put property in the way of the garage door clearance. I had had no problem with a blockage yet he continued to chide me about same as if I was a youngster of his. I let it roll off but noted it as you can see. He seemed bothered that I was not "sweet smelling" while we were moving. Yet he never once offered to get me to someplace where I could clean up! Going three days without a shower and having to live in sub-zero temperatures outside for two days just might make a person stink!. (9-9-99)
