Colts Ultimate Viewing Challenge

Rules

 

NO PURCHASE NECESSARY.  PURCHASE DOES NOT INCREASE ODDS OF WINNING. This contest is open to all U.S. residents eighteen (18) years of age or older (must provide own transportation to challenge locations).  Full- or part-time employees of Gregg Appliances Inc. and its subsidiaries, vendors and agencies and all members of their immediate families in the same household are not eligible to win.

Sweepstakes Name:  Colts Ultimate Viewing Challenge (the "Sweepstakes")

Registration Locations: All Indiana hhgregg retail locations (excluding hhgregg in Clarksville, IN)

hhgregg (Company) will conduct the Sweepstakes substantially as described in these rules, and by participating, each participant agrees as follows:

1.         Entry Period:  The entry period for Sweepstakes will begin at 10:00 a.m. ET on July 27 and end at 7:00p.m. ET on August 9, 2008 (the "Entry Period").

2.         How to Enter:   Official Entry Forms will be available on-site at all Indiana hhgregg retail locations (excluding Clarksville, IN).  To enter, completely fill out an Official Entry form at the store with full legal name, address phone number and any additional requested information and deposit it in the receptacle provided at the store. Entries are limited to one entry per person per store visit.  There is a limit of one prize per person, family, group, organization or address.

Mail-In: Mail a 3" X 5" piece of paper with your first and last names, your email address and a valid home address in an envelope with proper postage to Colts Ultimate Viewing Challenge, hhgregg, 4151 E 96th Street, Indianapolis, IN 46240. All entries must arrive by August 9, 2008 to be eligible. You will receive one (1) entry into the Sweepstakes.

3.         Selection of Challenge Contestants:  Ten (10) contestants for the August 16 to August 18, 2008 Colts Viewing challenge will be selected as follows: Ten (10) contestants will be selected in a random drawing conducted by Company on or about August 11, 2008 from among all eligible on-site entries received.  The drawings will be held at the hhgregg Corporate Headquarters, 4151 E. 96th Street, Indianapolis, Indiana.  All entries become the property of hhgregg.  hhgregg will not be responsible for late or misdirected entries. Odds of winning depend on the number of eligible on-site entries received.   All challenge contestants are subject to verification.

 4.         Challenge Contestant Notification:  Challenge contestants will be notified by telephone and/or e-mail, at Company's discretion.  If a potential Challenge Contestant cannot be reached within twenty-four (24) hours of initial notification attempt, he or she may be disqualified and the chance to participate in the challenge awarded to an alternate contestant.  Chosen Challenge contestants will be required to complete and return to Company an Affidavit of Eligibility/Release of Liability, photo and media release, and, a W9 form for tax purposes (Contest winners are responsible for any taxes or additional expenses incurred in connection with the prize won. Prizes are non-transferable and there will be no cash substitute in lieu of any prize). If potential challenge contestant fails to respond to any notification attempt within the time period specified by Company, or if any attempted notification or prize delivery is returned as undeliverable, or if the potential winner fails to complete and return any required affidavit or release within the specified time period, the potential winner may be disqualified and an alternate contestant selected. 

5.         Selection of Challenge Winners:  The 10 contestants will have the opportunity to participate in the challenge to win the Grand Prize. The Grand Prize winner will be selected at an event that will take place August 16 @ 9AM to August 18 @ 10AM. The contestants in the Challenge will report to one of two hhgregg locations in the Indianapolis area.  These locations will be designated to each respective contestant upon notification of Sweepstakes drawing. Contestants will be required to check in at their respective location and required to provide official government identification as well as complete a W9 tax form and liability/publicity releases. If the prize winner is not available or does not wish to attend the event, hhgregg will draw another contestant for the Challenge until all 10 positions are filled.

At the event, the contestants will be required to sit or lay on their respective mattress and not fall asleep.  If a contestant has fallen asleep, they win the respective prize in the order that they are eliminated from the competition.  Last person awake wins the Grand Prize. In the event of a tie where 2 or more contestants are still awake come August 18 at 8:45 AM, there will be a Colts Trivia Challenge to determine the grand prize winner. The contest that answers the most number of questions correct, wins the grand prize.  If there is still a tie after the initial 10 questions, 10 more questions will be asked.  This will continue until there is a final winner.

Contestant Guidelines:

All contestants must check in by 9AM on August 16 at their respective location. Contestants must remain awake for the entire contest. If they fall asleep, they will be eliminated from the competition. Definition of falling asleep will be explained prior to the contest start time and will be left up to the judge's discretion if a person has fallen asleep.

All contestants must have a part of their body in constant contact with the mattress at all times. Contestants may only sit or lie on the mattress. Contestants may NOT walk around the mattress while still having contact. It will be the judge's discretion if a contestant has lost contact with the mattress.

Prizes will be distributed to the winners in the order that they are eliminated from the competition.

Contestants may bring reading material, wrist watch, pillows, blankets, bedding for their mattress, 8 sodas, snacks, cooler for their drinks, any necessary medications, change of clothes, personal hygienic products, and a bag for their items.  All items must be checked in at registration.

Prohibitive items, but not limited to: sunglasses or tented eyeware to hide the eyes from the judge, alcoholic beverages, caffeine and/or energy pills, any electronic devices including cell phones, cigarettes and all tobacco products during active competition time, and any other items the judge deems unsafe or provides an unfair advantage.

Supporters are encouraged, but must remain in designated area. Supporters may speak with and encourage contestants at all times, but may not be disrespectful to other contestants at any time.  The judge may remove any supporter at any time for any inappropriate conduct. Supporters may not bring any additional food, beverages, or items that contestants did not check in at the beginning of registration. Supporters may not assist contestants in final Colts trivia challenge. Supporters MAY bring additional ice for the contestant to be refilled during breaks only.

Security will be on hand through the entire event to provide safety and security.

Food and beverages will be provided at designated times.  Each contestant will receive this schedule prior to the event.

Ten minute breaks will be provided every three hours. Each contestant will receive a break schedule prior to the event. All contestants MUST be back on their respective mattress by the end of the break time. A one minute warning will be provided.

 

1.Prize(s).  A total of 10 prizes will be awarded with the challenge.  The below set of prizes will be available at each of the two Challenge locations. This constitutes a total of two (2) Grand Prizes, two (2) 1st Runner Up prizes, two (2) 2nd Runner Up prizes, two (2) 3rd Runner Up prizes, and two (2) 4th Runner Up prizes.  Prize set for each location is as follows:

 Grand Prize: 2 Colts Club Seat Season Tickets ($4,800) and full size Serta Mattress ($659.98)

1st Runner Up: 40" flat panel TV ($1899.97) and full size Serta Mattress ($659.98)

2nd Runner Up: 32" flat panel TV ($999.97) and full size Serta Mattress ($659.98)

3rd Runner Up: 26" flat panel TV ($649.97) and full size Serta Mattress ($659.98)

4th Runner Up: 19" flat panel TV ($429.97) and full size Serta Mattress ($659.98)

General Prize Terms:  Prizes are not transferable, redeemable for cash or exchangeable for any other prize.  No substitutions permitted, except at the discretion of Company, which reserves the right to substitute another prize of equal or greater value.  No cash equivalent for prize will be awarded.  Prizes consist only of items expressly specified in these Official Rules.  All expenses or costs associated with the acceptance or use of any prize that are not expressly listed in these Official Rules are the responsibility of the winner.  The total approximate retail value of all prizes is $24,159.56.

 7.         Publicity; Use of Personal Information.  By participating, except where prohibited by law, all entrants grant the Company, participating sponsors and assign permission to use their names, characters, photographs, video, voices, and likenesses for advertising, promotional and commercial purposes, without further notice or compensation, and waive any claims to royalty, right, or remuneration for such use.  By entering the Sweepstakes, except where prohibited by law, entrants agree that the Company and participating sponsors may disclose personal information obtained from entrants in the Sweepstakes to third parties and use such information for marketing and other purposes. 

8.         Release.  By participating in the Sweepstakes, each entrant waives any and all claims of liability against the Company, their employees and agents, participating sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Sweepstakes, or from the receipt or use of any prize.

9.         Taxes.  Any valuation of the prize(s) stated above is based on available information provided to the Company, and the value of any prize awarded to a winner may be reported for tax purposes as required by law.  Each winner is solely responsible for reporting and paying any and all applicable taxes related to the prize(s) and paying any expenses associated with any prizes which are not specifically provided for in the official rules.  Each winner must provide the Company with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded.  Any person winning over $600 in prizes from the Company will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.

10.        Conduct and Decisions.  By participating in the Sweepstakes, participants agree to be bound by the decisions of Company and its personnel.  Persons who violate any rule, gain unfair advantage in participating in the Sweepstakes, or obtain winner status using fraudulent means will be disqualified.  Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited.  The Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Sweepstakes and the Company's decisions concerning such disputes shall be final.  If the conduct or outcome of the Sweepstakes is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Company, the Company reserves the right to terminate this Sweepstakes, or make such other decisions regarding the outcome as the Company deems appropriate.  All decisions will be made by the Company and are final.  The Company may waive any of these rules in its sole discretion.  ANY ATTEMPT BY A SWEEPSTAKESANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS SWEEPSTAKES AND UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, COMPANY RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.

11.        Miscellaneous.  The Company may substitute prizes, amend the rules or discontinue the Sweepstakes at any time.  The Company disclaims any responsibility to notify participants of any aspect related to the conduct of the Sweepstakes.  For a copy of the rules or a list of winners, visit the Company headquarters in Indianapolis during normal business hours or mail a written request with a stamped, self-addressed return envelope to the Company, stated above.  All entries become the property of the Company and will not be returned.

12.        Compliance with Law.  The conduct of the Sweepstakes is governed by the applicable laws of the Unites States of America, which take precedence over any rule to the contrary herein. All federal, state and local rules and regulations apply.  Void where prohibited by law.

13.        hhgregg management decisions are final. Rules can be updates by hhgregg management at any time and without notice.
