Purpose: To convene, carry out,
and resolve- according to the regulations of IDF and JAG UCJ regulations
(Common knowledge violations)- all conflicts; violations of regulations; or
otherwise approved disputes in a timely, orderly and respectful manner.
Authority: IDF Senior Admiralty.
Effective until suspended or revoked by the same.
Standard Operating Procedure:
- Case/Issue brought before
the JAG
-JAG determines the
viability of the case.
-Viable case continues
-Unviable case is
remanded to the general authority of the CO/DD for records.
- IF VIABLE-
-JAG will convene a 3 or 5
member panel- depending upon the requested action and seriousness of the
crime.
-Panel will set a time
to hear evidence, arguments. At this time the JAG will instruct parties to
gather evidence and submit copies of said evidence, witness lists, and etc to
the JAG prior to the convened time.
-JAG Panel convenes.
-Hear
arguments/Evidence
Question the
members involved, analyze the evidence at hand and determine the viability of
all evidence/statements
-Insure every member
involved has a fair opportunity to speak and rebut any presented information.
-After this process is
done, the JAG will convene a meeting with the panel and himself/herself and at
that time deliberate on the case at hand.
-The three/five
member panel will deliberate, the JAG will only answer questions and insure no
favoritism/biased actions occur.
JAG will at this point be
notified by the panel of their findings and then render the JAG decision.
Also at this time the JAG will notify the accused that he/she may have the
right to appeal if he/she can provide reasonable justification for the Appeal.
