3/9-Kevin and defendants in his lawsuit did not reach settlement at their March 8th Mediation. Attorneys for all will be headed back to court for a second hearing on May 18, 2001. And on another note...Cousin Kevin will be playing at the Pound SF in San Francisco on April 14, 2001! Autopunch and Barbee Killed Ken will be opening for them. Kevin Cadogan Gets His Day in Court
Hearing to start for ousted guitarist's suit against Third Eye Blind

Ousted Third Eye Blind guitarist/co-songwriter Kevin Cadogan's multi-million dollar lawsuit (against his former band members, management, attorneys and record label) is scheduled to begin its hearing in federal court in Oakland on Friday. Originally filed in June and amended in August, his complaint, citing fraud, breach of contract and violations of federal statutes governing trademark law, will be heard before U.S. District Judge Claudia Wilken.Third Eye Blind's lawyer Tim Mandelbaum, one of the defendents, has already filed motions to dismiss or transfer the case, while the band has filed motions for dismissal for several counts of the suit as well, claiming the case was brought forward after the statute of limitations for fraud had run out.Cadogan's complaint, which claims that Third Eye Blind frontman Stephan Jenkins and his co-defendants unlawfully exploited his intellectual property in violation of federal and common law, revolves around a dispute over partial ownership of the band. "We had incorporated the band, and I was promised fifty percent. I was promised a production role," Cadogan told RollingStone.com in June. "I was told I was signing a record contract, but the contract was tricky and cleverly worded, and it wasn't what I thought I was signing. When I found out that the document gave one hundred percent of the ownership rights to Stephan, that's when the conflict started."Documents backing up Cadogan's claim are posted on his Web site (www.kevincadogan.com) in addition to the cover letter for his complaint. "A victory in this case would ensure artists' rights," he said. "I'm fighting for my rights. I don't see royalties, because they're sent to Third Eye Blind, Inc., which is Stephan. Record companies shouldn't be allowed to do this. It's old-fashioned theft."Cadogan shared songwriting credit with Jenkins on sixteen of the band's twenty-seven songs on Third Eye Blind's two albums, 1997's self-titled debut and 1999's Blue. He also shared a win with Jenkins for Outstanding Songwriter at the California Music Awards in April.

10/7- The recording for the new album is complete! The guys are now in the studio mixing and putting the finishing touches on "Bully For You's" 12 songs. Completion is set for the end of October. Tossed Out Records will be taking pre-orders for "Bully For You" soon


9/2- Cadogan has finally released sound clips from they're debut album! Check them out here!
These songs are unmixed and unmastered, but good enough in quality to get the right idea.
With 2 songs to go on guitar and 7 songs left to track vocals on, cadogan expects to be out of the studio and behind the mixing board the 1st of October. Shortly thereafter a made to order run of "Bully For You" will be available through the internet ONLY. They'll be taking your pre-orders soon.
Woo hoo!!! Personally I think the songs sound great, I can't wait for the album.


8/31-Shortly KevinCadogan.com and bully4you.com will unveil clips of several songs off cadogan's debut album, "Bully For You."
Tossed Out Records will be taking pre-orders for "Bully For You" soon. A limited release will be available for purchase only through bully4you.com and KevinCadogan.com shortly after the album is mastered in mid October. You can check either site for updates on when and how.

Dear Fans,
Hold onto those bully shirts and stickers! They are now collectors items.
Lawyers have informed the band that without a court battle bully can no longer be known as bully.
Apparently another band has been touring under that name and has legal rights to it. Kevin has chose not to, well, you know, bully another band. Henceforth his band will be known as cadogan.
However, the album title and sentiment will remain Bully For You. Sorry for the confusion, the music will be the same, by any name.
Congratulations again to all the art contest winners! Your art will, of course, remain an important part of the debut album.

8/1-As Kevin, messiah and Cool Doe have been busy working on Bully for You, some major changes have been set in motion.
You can now expect the worldwide release of Bully for You through a major label this fall!
Kevin and Tossed Out Records are very happy to have an album created completely independent of corporate influences, yet be distributed by a major label.


7/30- No recent news on the bully album but from what I heard, the release date has been pushed back to September. Congratulations to the winners of the fan art contest..I thought all of them were good in they're own little way. :-) I know there's been talk on the bully list about the recording of Stephan talking about firing Tony from the band. Don't know what I'm talking about? Click here Personally..I do think it's Stephan..I really don't think Kevin or anyone running his site would go to the trouble of creating a fake sound bite and passing it off as Stephan's voice. Why would Kevin lie to his fans??? I think people are creating a lot more drama than there really is. For now, this is all that's going on but be sure to check out the new bully contest at bully4you.com!

7/16-Sorry I didn't put this up sooner, I was on vacation..I saw it on Kevin's website

When asked "Is it true that you guys ditched him in Utah?" Third Eye Blind's current drummer responded "No, that's ridiculous. He had an itinerary and he and his girlfriend had first class flights back to Oakland. He had a limousine to the airport." in an interview with News 4U - The Ultimate Entertainment Magazine, July 2000, Volume 10, Issue 7C.

Kevin's response -
The reason the other members of Third Eye Blind have kept quiet about their illegal and immoral actions results from the fact that they have nothing but lies to offer the public and fans. As you can see from the copy of the flight itinerary, my girlfriend and I were not booked in first class. I don't care about flying first class but I do care that Third Eye Blind tries to portray themselves as good doers. I was left stranded at the venue. I was told by the car company that I was "cut off" when I called for a car back to the hotel. Instead I called a taxi and waited outside talking with fans, many of whom offered us a ride which I declined telling them that the taxi was on it's way. I also awoke the next morning to find the full hotel bill for my room stuck under the door. There was NO limo ride to the airport, rather my girlfriend and I took a shuttle. I have yet to be paid for the shows at Sundance.

6/18-Attorneys for Kevin Cadogan, former lead guitarist and songwriter for alternative rock band Third Eye Blind, announced today the filing of a ten count multi million dollar federal lawsuit against at least ten Defendants including Stephan Jenkins, Third Eye Blind, the band's manager Eric Godtland, lawyer Tim Mandelbaum and Elektra Entertainment Group.
Among other things,the complaint cites fraud and breach of contract and alleges violations of the Lanham Act. Cadogan asserts that Jenkins and his co-defendants lied and intentionally deceived him in a carefully orchestrated plot to unlawfully exploit his intellectual property in violation of federal and common law.


6/15-bully is currently in the studio working on their upcoming debut album, bully4you. In early August the producers of bully4you, Kevin Cadogan and Mike Cresswell, will begin mixing the album. There has been much major label interest in bully, therefore it is being decided whether to release bully4you with a major label or on Kevin Cadogan's independent label, Tossed Out Records. The drum tracking for bully4you is finished and bass cracking is in progress. The album will have 14 songs on it. Scheduled release of bully4you is August 2000.


6/4- No recent news..bully is still working on they're new album. kevincadogan.com has put up a Third Eye Blind archive section. Go check it out to see what they're demo tape cover looked like and you can also read one of the first articles about them. Oh..and there's an mp3 from a radio station interview, they perform "Slow Motion" and "Semi Charmed Life" during it.


5/18-bully is currently in the studio working on their upcoming debut album, bully4you. They are working to narrow down and fine tune 12 of their 16 songs (and growing), all written by Kevin Cadogan. bully4you is being produced by Kevin Cadogan and Mike Cresswell.

It must be inspired by bully; a member, a bully song, or however else it is you are roused by bully. Your art will be posted to the website as it's received and voted on by other site goers. The top 10 winners will be featured in the artwork for the bully4you album insert as well as be posted on the upcoming official bully website.

4/22- Turns out Kevin will NOT be auctioning off those 13 guitars of his, well, except for the Blue Saber which has gotten no bids yet. He just doesn't feel it's right because there are some very deserving fans out there that just do not have the money for one of those amazing guitars. Talk about a sweet, down to earth guy :-) So..maybe his official site will have a contest or something to give away his guitars to the deserving fans. Got any suggestions?? 4/13- Kevin responds to a guest book entry that commented on his maturity (or lack of it) when speaking about 3eb:

Hello.
This is Kevin Cadogan. Thanks for your message. I know this situation has been very difficult and confusing for fans of 3eb. I hope it will be resolved within the next few months. I have bit my tongue over this for two months now, and I felt it was time to provide a response to 3eb for their false and patronizing statement that they, "wish me well". You don't just walk out on a band member after he played his heart out at a show. You don't tell him he has been "terminated"(what a choice of words), and strand him at the venue. You don't try to withhold his royalties and tell lies on MTV to the fans about his musical involvement (Tony did not play on Semi charmed Life on the record, check the album credits yourself). 3eb can't offer fans a reason because 3eb doesn't have one. There is nothing mature about that, in fact it 's downright deceitful.
I took Tony's place in the band in 1993 because Stephan was looking for a song writing partner and at the time was unable to have that involvement with Tony. I have no animosity towards Tony, he is a musician who is trying to survive and has found a good job. I believe that being mature means standing up for yourself and others that you see being mistreated. Being honest about your feelings and truthful about the facts. No to be afraid to let others now what you believe no matter what the consequences might be. This is real maturity.
I also wanted to let you know that I do care about the fans opinions, and that I am going to continue to move on with bully with sincerity. The fans deserve that.

4/12-The California Music Awards will be broadcast on WB20 Saturday April 22, 8pm pst. I'm guessing this is a station in California so not everyone will be able to see it..sigh..

4/9-Kevin won Outstanding Songwriter last night at the Bammies and he put on an excellent show with Bully. Way ta go guys!


4/3-Kevin and bully will perform two unreleased songs from their upcoming debut album, bully4you, at the Bammies on April 8, 2000. Kevin recently formed bully, a rock trio featuring Kevin on lead vocals and guitar, Cool Doe on drums and Messiah on bass.
In May, Kevin and Jason Carmer, co-producer of Blue, will be heading to Dublin Ireland to begin mixing bully4you, scheduled for release on August 13, 2000. bully4you will be released on Kevin's own independent label, Tossed Out Records.


4/1 Kevin and his new band, bully, will start recording their debut album in April. It will be released mid August.
Kevin has decided to take his lead guitar from "Kinsale Harbor" and rework it into a more "rockin'" song with new lyrics. The end result will be "Waiting For Me". Wanna hear the original "Kinsale Harbor"??? Check out my Music section.
bully will be performing "Angel vs. the Train" & "Waiting for Me" at the BAMMIESon April 8, 2000.


3/24-Kevin will be performing at the California Music Awards on April 8, 2000 (AKA: Bammies) He'll be doing two songs he wrote entitled "Say Goodbye To All That" and "Angel vs. the Train".
Kevin intends to have his solo album out before the end of August. He's doing good and is writing a lot of great music for the album.


3/11-Kevin is currently writing songs (the first of which is entitled "Say Goodbye to All That") and investing in a home studio. He will begin recording his solo album soon.

Kevin's attorneys have been negotiating settlement through a series of meetings. Upcoming negotiations will be held through mediation, and hopefully ended quickly and fairly. It is after this mediation meeting that Kevin will decide whether or not to file suit.


3/7- In the new issue of Teen People, there are two pictures of Kevin -w- Third Eye Blind. It's a boring article about Stephan, of course cause he IS Third Eye Blind now. I don't think the article mentions anything about Kevin being fired, but I just skimmed it so I don't know


2/10-I heard a rumor Kevin may be joining the Foo Fighters as their new lead guitarist but as of now, this is a RUMOR..I don't know for sure yet but as soon as I do, I'll let y'all know!!!


2/9-Emails sent to Kevin through his official site and the guestbook entries are being sent to Elektra Records so they can see how many people truly love Kevin and how upset we all are


2/5-Well Third Eye Blind was on TRL this past Thursday and barely mentioned anything about Kevin. Stephan said they wish him the best, yeah well whatever..I'm sure that cheered Kevin up. All they had to say was good stuff about their friend Tony(who looked stoned AGAIN) My prediction for the rest of the year: Kevin will venture on with a solo career and do exceptionally well while Stephan, Brad, Arion and Tony will be working at McDonald's after their tour(which probably won't sell well to begin with) and I can't wait to see that.....


1/31-Kevin has two Bammie nominations for Outstanding Guitarist and Outstanding Songwriter for his contributions to the album "Blue" by Third Eye Blind. The Bammies will be held on April 8th at the Bill Graham Civic Auditorium in San Francisco...


1/31-As most of you already know, Kevin has been fired from Third Eye Blind, here is his statement....

Dear Fans,
I did not leave Third Eye Blind. I was unceremoniously and wrongfully terminated immediately after the Jan 25th live performance at the Sundance Film Festival in Utah.
I was told by Brad, the designated spokesperson, that I was terminated because I was not happy and they were not happy. I was fully expecting to travel with the rest of the band and play on the "Tonight Show".
I was stranded at the venue as the rest of the band boarded a private jet to LA. The good news is that on my walk back to the hotel, I had plenty of time to "soak" in the beauty, snow and majesty that is Utah. Appropriate legal options are now being pursued by my attorneys. I can not say more at this time.
I am overwhelmed by the support I am receiving from my fans. It is your support that inspires me and it is my joy in life performing for you. I have received and read every email sent to my official website. It is wonderful to know that I have so many dear friends who appreciate my music. I promise the memories and my music will not end here.
