WASHINGTON - While the Sept. 11 commission appears likely to recommend an overhaul of U.S. intelligence agencies, the idea that a separate domestic spy agency be created outside the FBI (news - web sites) is meeting strong opposition from current and former officials.
FBI Director Robert Mueller, former Director Louis Freeh, Attorney General John Ashcroft (news - web sites), his predecessor Janet Reno (news - web sites) and CIA (news - web sites) Director George Tenet all recommended against a new homeland spy agency in testimony before the panel this week.
"Even during the most frigid days of the Cold War, we never saw the need to create a secret police force that would work outside the constraints of the Constitution," ACLU Executive Director Anthony Romero said.
In testimony before the 9/11 panel, Freeh said: "Americans, I don't think, like secret police." Yet given the FBI's multiple failures prior to the Sept. 11, 2001, attacks, questions remain whether an agency devoted for decades to law enforcement can make intelligence a mission of equal or greater importance.
Former Rep. Lee Hamilton, vice chairman of the commission, said it appears Mueller "is moving in the right direction and has made much progress" in building a new intelligence capability at the FBI. "The key question for us is whether he can succeed with the very difficult mission that he has set out, and we have not come to a judgment with respect to that," said Hamilton, D-Ind. Some members of Congress don't believe an FBI transformation is possible. Sen. John Edwards (news - web sites), D-N.C., has been pushing for months for a new Homeland Intelligence Agency that would have no law enforcement duties or powers. "This is a structural problem," Edwards said. "We have a law enforcement agency trying to do something they are not suited to do, which is domestic intelligence."
The proposal would set up an organization similar to Britain's Security Service, known as MI5, which collects, analyzes and disseminates intelligence aimed at disrupting terrorism, espionage and sabotage directed against Britain. It has no law enforcement powers.

LONDON - British Airways canceled a London-to-Washington flight on Friday, the third time in three days that the flight was disrupted on security advice from the British government. Also, an Air France plane from New York to Paris made an emergency stop in Canada because of security concerns.

The flight troubles came amid a tightening of the security net over U.S. airspace around the New Year's holiday, a week and a half after the Bush administration raised the national terrorism alert to orange, its second-highest level.
British Airways said Friday's cancellation of Flight 223 was prompted by security advice from the government, but would not give details. The flight was called off less than two hours before takeoff and some of the 300 passengers had already begun to check in.
Flight 223, one of three daily flights to the U.S. capital, was also canceled Thursday on government advice. Another British Airways flight from Washington to London was delayed Thursday night as U.S. authorities re-screened passengers. The flight took off more than three hours late.
On Wednesday, Flight 223 was kept on the taxiway at Washington Dulles International Airport for several hours shortly after landing, while U.S. authorities questioned passengers and crew on board.
"We had concerns with individuals on the flight," a U.S. national security official said, speaking only on condition of anonymity. The official said the questioning was prompted by intelligence information and not just suspicious passenger names.
The Air France flight, with 260 passengers on board, was on its way to Paris from New York when the pilot was told to land in Newfoundland on New Year's Day, airport authorities said Friday.
After a comparison between luggage and passenger lists, authorities believed there was unaccompanied baggage on the plane. A search found nothing suspicious. The flight resumed about four hours later.
