Osborne Thomas Last Will and Testament


State of North Carolina Union County, I Osborne Thomas of the County of Union of the County of Union & State aforesaid being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last will and testament in manner & form as following that is to say

First

That my executor herein after named Shall provide for my body a descent burial suitable to the wishes of my relatives and friends and pay all funeral expenses together with my just debts howsoever and to whom so ever rising out of the monies that may first come into his hands as a part or parcel of my estate.
Item 1st
I give and devise unto my beloved wife Juliana Thomas one hundred and ten acres of land on the waters of Richardson Creek, adjoining the lands of Ala Brown, Ezekiel Yarborough, Addison Whitley, & others for and during the terms of her natural life and at her death to go to my lawful heirs share and share alike. I also give and bequeath to my beloved wife Juliana one black mare to be her property absolutely and also give and bequeath to my beloved wife all my household and kitchen furniture and all my stock of cattle hogs and sheep to be her property absolutely and I also will that my wife have all the provisions of every sort both for man and beast that may be on hand at my death
Item 2nd
I give and devise unto my children that tract of land lying on the waters of Richardson Creek adjoining the lands of Redden Staton & others known as the old Thomas tract containing sixty one acres to be theirs absolutely Share and share alike

And lastly I do hereby Constitute and appoint my trusty friend Addison Whitley my lawful and executor to all intents and purposes to execute this my last will and testament according to the true intent and meaning of the same and my part and clause thereof hereby revoking and making declaring uterly void all other wills and testaments by me here to fore made In testimony whereof I have here unto set my hand and seal this 25th day of April AD 1862 Signed sealed and delivered to be his last will and testament in presents of us

Then the last will and testament of Osborne Thomas was brought into open court & proved in in due form of law by J E Irby & S B Webb and ordered to be recorded Whereupon Addison Whitley was duly sworn as executor of the same

NOTE: Osborne Thomas wrote his last will and testament 25 Apr 1862. He enlisted for war 28 Apr 1862. On 13 Dec 1862, Osborne was killed in battle at Fredricksburg VA.
