James Thomas


Whereas I James Thomas of the State of North Carolina and County of Guilford, the sixtenth of the ninth month in the year of our lord one thousand seven hundred & eighty eight being in a low state of health, but of a sound & perfect memory and understanding thought fit to leave these four lines as my last will and testament, and desire all my receive it as such. ----
And first I will and positively order that all my debts and funeral charges be paid and discharged by my Executor hereafter named.
And 2nd I will and positively order that the house wherin I now live and the plantation and the piece of land which I live on, with the horse catle and hogs, the plantation utentials, and house furniture be for my loving wife Milly during her lifetime or widowhood and after death or marriage I give and devise the said land to my son Benjamin Thomas to him his heirs and assigns forever.
And 3rdly-- I give and devise to my son John a cetain piece of land on Bare Creek in Richmond County and the State afsd. with one horse, bridle & and one cow and calf to him his heirs and assigns forever.
And 4thly-- If either of my sons should died without heirs the above sd. desend and belong to his brother and if they should both decease without heirs for both their portions to descend & belong to three of John Thomass children, namely Elijah Stephen and Francis, for to be theirs equal as though they were my children.
And lasty I do make and constitute my well beloved friends John Thomas & Isaac his son with my beloved wife Milly to be the whole and sole executor of this my last wil and testament, revoking & disallowing every will or wills that may come in my name.

In witness whereunto I have set my hand & seal the day and year above written.
