About the NBTCA(A)

The NBTC(A) - the elected official representative for the Bull Terrier breed in Australia, affiliated with the ANKC (Australian National Kennel Council), was formed in 1987.

The purpose of National Councils was seen as a move towards improved liaison between clubs and as an avenue to provide dialogue with the ANKC.

Any organisation formed for the sole purpose of promoting an interest in, or the improvement and development of a specific breed of dog and which restricted it’s membership to all the Breed Clubs for that specific breed, could apply for registration with the ANKC, with only one National Council recognised for each breed of dog.

As well, membership of a National Council had to be comprised of at least three specialist Breed Clubs, each affiliated with a separate Member Body of the ANKC.

Bull Terrier Clubs, which are now Members of the Council, total eight of the nine affiliated Breed Clubs in Australia, with one Associate Member from New Zealand.

From a somewhat stormy past – which included a suspension period for the Council, the Council, under the guidance and hardwork of the current President and Secretary, has emerged into a progressive and professional outfit.

However, it must be remembered, the NBTC(A) like all other National Councils, is only as good (or as bad) as the Member Clubs permit it to be.

As we head into a new millennium, our breed, the National Council and the Breed Clubs will no doubt be facing a whole range of new challenges – we are now more united and better equipped to meet those challenges.

Constitution

1. NAME:

The name of the organisation shall be the National Bull Terrier Council (Australia) and shall here-in be referred to as the NBTC(A).

The breed referred to in this constitution and by-laws is the breed which is internationally known as the "Bull Terrier". Only clubs catering exclusively for the above breed shall be eligible for membership.

2. OBJECTS:

The objects of the NBTC(A) shall be:

a. To seek registration with the Australian National Kennel Council (ANKC) and if recognised, agree to be bound by the Rules and Regulations, and directions of the ANKC for the time being in force.

b. To approve the title "National Championship Show" to the various member clubs, subject always to the approval of both the State or Territory Controlling Body and the ANKC.

c. To encourage and promote in every way the general improvement of the standard, breeding and exhibition of the Bull Terrier.

d. To educate and encourage exhibitors, breeders and judges to abide by the Standard for the Bull Terrier, as approved by the ANKC.

e. To enable member clubs to take co-operative action on matters which such clubs agree are of common interest and for their mutual benefit in the promotion of the Bull Terrier.

f. To become associated with overseas Bull Terrier organisations with objects kindred to the objects of the NBTC(A)

g. To encourage member clubs to hold shows, parades, and other exhibitions as approved by and under the Rules and Regulations of their State or Territory Controlling Body and of the ANKC.

h. To legislate to make by-laws and do other acts, matters or things as may be necessary or expedient to promote all or any of the objects of the NBTC(A).

3. POWERS:

1. The NBTC(A) shall have the power to:

a. Levy membership fees from member clubs to carry out any or all of the objects of the NBTC(A).

b. To accept appointments of Office Bearers and or Delegates by their Affiliated Clubs providing said Office Bearers and/or Delegates are restricted to persons who are and shall remain, during their term of office, financial members of the ANKC Member Body in the State or Territory of their residence.

c. Invest the funds of the NBTC(A) not immediately required, in such manner as the delegates shall determine.

d. Hold Breed seminars through the sponsorship of the member clubs.

e. Correspond with and become associated with overseas Bull Terrier organisations for the purpose of the exchange of viewpoints on matters affecting the welfare of the Bull Terrier.

f. Approve the title "National Championship Show" and/or "Bi-ennial Trophy Show" to the various member clubs, subject always to the approval of both the State or Territory Controlling Body and the ANKC. (See By-law No.1)

g. Purchase, hire, lease, mortgage or otherwise provide and maintain all types of real and personal property for the carrying out of the objects of the NBTC(A).

h. Do all such things which may appear to it to be necessary for the purpose of carrying into effect its objects.

II The NBTC(A) shall not hold shows or other type of exhibitions. Such events shall only be conducted by the member clubs.

III Nothing in this constitution shall effect the right or authority of an individual member club to control and conduct their club business in the way usually followed by a Specialist Club.

Nor shall the NBTC(A) effect in any way the normal relationship between a member club and their State or Territory Controlling Body.

4. MEMBERSHIP:

a. Any Bull Terrier Club affiliated with a State or Territory Controlling Body, which is in turn a member of the ANKC, shall be eligible for membership of the NBTC(A). Any future affiliated club catering exclusively for Bull Terrier s (Miniature) is eligible for NBTC(A) representation.

b. The following Bull Terrier Clubs and other Bull Terrier Clubs as may from time to time be admitted, shall be member clubs, entitled to nominate a delegate to the NBTC(A).

The Bull Terrier Club of South Australia Inc.
The Bull Terrier Club Inc. (NSW)

c. The membership fee shall be such amount as the NBTC(A) shall from time to time determine. See By-law No.3.

d. It is a requirement that all member clubs of the NBTC(A) must have the name of the State or Territory in which they are affiliated in their Club’s name.

5. COMMITTEE

a. The executive Committee of the NBTC(A) shall be - President

- Secretary

b. The Council, at its discretion may appoint Sub-committees for specific purposes.

c. Each Sub-committee shall regulate its own meetings and procedures as it sees fit but is directly responsible to the Council.

6. DUTIES OF THE SECRETARY

a. The Secretary shall exercise and perform all the usual secretarial functions and generally attend to the secretarial work of the Council.

b. He/she shall be responsible for all monies received on behalf of the NBTC(A) and shall pay all such sums into the banking account of the NBTC(A) within fourteen (14) days of receipt.

c. He/she shall keep all the necessary books of account and financial statements as shall be requested by the Auditor.

d. Prepare the Annual Balance Sheet and Accounts and accompanying reports.

e. Forward a copy of the audited statement of receipts and expenditure and balance sheet to each member club by the 31st March each year.

7. ELECTIONS

a. The Council shall elect a President, Secretary, Co-ordinator of the Hereditary Diseases Committee, Co-ordinator of the Public Relations Committee and Co-ordinator of the ROM Committee who should, subject to paragraph (b) of this clause, hold office until the day following that of the AGM of Council at the end of their term.

b. In the event that any of the people holding the positions in 7a. should retire or be considered by the Council ineligible to continue in that capacity, the Council shall elect another person to that vacant office. Their term there shall be restricted to the unexpired portion of the term of the predecessor in office.

c. The President, Secretary must be a member of one of the member clubs and of their respective State or Territory controlling body and shall not be a club delegate.

d. Nominations must be in the hands of the Secretary at least ninety (90) days before the said meeting and all member clubs shall be advised of the nominees sixty (60) days before the said meeting .

8. MEETINGS

a. Each of the member clubs named in Clause 4b. shall annually appoint one delegate to the NBTC(A). If for any reason it should become necessary, member clubs may appoint a substitute delegate who shall ipso facto be deemed to be a delegate for voting and all other purposes at a meeting of the NBTC(A). Such substitute delegate must be financial member of one of the member clubs.

b. At a meeting of the NBTC(A) each member club shall have one vote, subject to its delegate being in attendance at such meeting. c. The quorum for meetings shall be one more in number than 50% of the number of member clubs.

d. Member clubs may bring any business before a meeting of the NBTC(A) by giving ninety (90) days notice of its intention to the Secretary. The Secretary shall communicate the agenda for a meeting to each of the member clubs at least sixty (60) days prior to the date of the meeting.

e. Except with the unanimous consent of all member clubs, no resolution carried at a meeting of the NBTC(A) shall be valid unless notice has been given in accordance with Clause 5 d.

f. Notwithstanding the provisions of Clause 5 e the Secretary shall at the discretion of the President, or at the written request of two member clubs, submit any particular matter or urgency to the member clubs by post, telegram or letter and the vote on any such matter shall be taken accordingly at meetings of the member clubs.

g. The NBTC(A) shall manage its own affairs and hold meetings at such time and place it deems fit. The Annual General Meeting shall be in held in the months of March or April of each year

h. The President of the NBTC(A) shall be Chairman of all meetings of the NBTC(A). Should he/she not be present within fifteen (15) minutes of the time appointed for the holding of the meeting, the delegates shall elect a Chairman from among their number. The delegate appointed may record his/her own vote on any matter, but shall not have a casting vote.

i. Should the Secretary not be present within fifteen (15) minutes of the time appointed for the holding of the meeting, the delegates shall elect a Deputy Secretary for that meeting, from among their number. The delegate appointed Deputy Secretary may record his/her own vote on any matter.

j. Every motion submitted to the meeting shall be decided by a show of hands, each member club with a delegate present shall have the right to record one (1) vote. In the event of equality of votes on any matter, the Chairman shall not have a casting vote,and the motion shall be deemed to lost.

k. The President shall not be entitled to vote at any meeting of the NBTC(A)

9. HEADQUARTERS

The headquarters of the NBTC(A) shall be the residential address of the Secretary where the books, records and property of the NBTC(A) shall be kept.

10. FINANCE

a. A bank account in the name of the ‘National Bull Terrier shall be opened with a recognised Australian bank and kept in the name of the NBTC(A).

b. All monies payable on behalf of the NBTC(A) shall be paid by cheque drawn upon the bank account of the NBTC(A). All cheques shall be signed by the Secretary and countersigned by the President or NBTC(A) delegate for that purpose. If the President and Secretary reside in different States/Territories then the Secretary can appoint a member of his/her club as the countersignee for the bank account. The countersignee is not to be a spouse or partner.

c. The membership fee shall be such amount as the NBTC(A) shall from time to time determine. See By-law No.3

d. The financial year of the NBTC(A) shall be from 1st January to the 31st December in each year.

e. At the Annual General Meeting in each year the NBTC(A) shall appoint an auditor, with accountancy experience. Such auditor shall hold office until the first meeting in the following year, but shall be eligible for re-appointment.

f. An audited statement of receipts and expenditure and balance sheet shall be forwarded to each member clubby the 31st March in each year.

11. BY-LAWS

Subject always to the Constitution, delegates at a meeting by a resolution passed by a majority of not less than 60% of delegates present and voting on this resolution, may make By-laws and from time to time amend such By-laws by variation, deletion or addition as they may think fit, in respect of:

a. The granting of the Title 'National Championship Show' and /or 'Bi-ennial Trophy Show'.

b. The appointment of the President

c. The appointment of the Secretary

d. Membership fees

e. Any matter the delegates consider necessary to carry out the objects of the NBTC(A)

12. ALTERATION TO CONSTITUTION AND BY-LAWS

This Constitution and the By-laws of the NBTC(A) shall not be altered, waived or amended, except at a meeting of the delegates at which at least ninety (90) days notice has been given to the Secretary of such amendment and the Secretary has sixty (60) days notice to all member clubs.

The amendment must be agreed to by a majority of not less than 60% of the delegates present on voting this resolution.

Any alteration to the Constitution and/or Rules or, if incorporated, the Memorandum and Articles Of Assocation must be submitted to the National Breed Club's Liasion Committee for approval.

13. RESIGNATION

Any member club may at any time resign its mebership by giving notice to the Secretary. Such resignation shall not free the club from liability to pay any subscription which is due and unpaid on the date of resignation.

Should any member club that has resigned seek re-admission as a member of the NBTC(A) such re-addmission is to be voted on at a meeting of the NBTC(A) called in compliance with Clause 5d of the Constitution. A majority of not less than 75% of the delegates present and voting in person, wil be required to re-admit as a member club.

14. PROPERTY/WINDING UP

No club or individual shall have any proprietary right or interest in any of the funds or property of the NBTC(A). Such property or funds shall be devoted to the promotion of the objects of the NBTC(A). However, in the event of the winding up of the NBTC(A) the property or funds shall be divided equally among the clubs which are members at the time of such winding up.
