A RESOLUTION REQUESTING THE VIRGINIA DEPARTMENT OF HIGHWAYS AND TRANSPORTATION TO INITIATE A PROJECT FOR CERTAIN STREET OR HIGHWAY IMPROVEMENTS.

WHEREAS, the Council has determined that it is necessary and appropriate for the future transportation needs of the City to initiate certain street and highway improvements; and

WHEREAS, the Virginia Department of Highways and Transportation requires a formal request for each project and certain commitments on the part of City Council, before the Department can initiate work on such highway projects to be funded from the City's annual allocations of urban highway improvement funds; now, therefore be it

RESOLVED by the Council of the City of Charlottesville:

1. That the Virginia Department of Highways and Transportation be and hereby is requested to establish a project within the corporate limits of the City of Charlottesville for improvements to:

        McIntire Road between Preston Avenue and Rio Road.

2. That the City hereby agrees to pay its share of the cost of engineering, acquisition of right-of-way, and construction of such project under the cost formula of 90% from the Department and 10% from the City.

3. The City further agrees that if such project is established as herein requested, and thereafter the City elects not to continue with such project to completion, the City will repay the Department for 100% of the costs incurred by the Department up to the time of such action by the City terminating such project.
