[Summary of planning act in discussion paper source#1, Mb regs and guidelines, p.2 ]The Planning Act Under the authority of the Planning Act, local governments can adopt district or municipal development plans to designate lands for certain uses such as agriculture and intensive livestock production operations, and to adopt municipal zoning by-laws that define requirements for their siting and development.
The Planning Act also prescribes procedures for the preparation, review and approval of local development plans and zoning bylaws. The requirements include public notice and public hearings for initial adoption and future amendment of local development policies and zoning. There is also provision to appeal development plan and local zoning decisions.
The act was last amended in January 1999 to streamline the development review process. The changes revised the notice provisions for the conditional use process commonly used to review and regulate proposed new or expanding livestock operations. A procedural manual has been prepared to assist planning administrators.
