by his brother John in Apr 1682; but Cokayne believes that this James must be
the one bur in 1670 and the one shot was the younger James (below); Cokayne
must be right because Scots Peerage says the younger James was b.1676, and he
presumably would not have been called James had his eldest brother been alive)

of Stair (20 Jul 1673-9 May 1747); m.1 Mar 1708 Eleanor (d.21 Nov 1759), dau of
James Campbell, Earl of Loudoun, and widow of Viscount Primrose; in 1707 he
obtained a novodamus of his Peerage titles, with remainder to his issue
male, then to such descendants of the 1st Viscount whom he would
nominate, then to the second and subsequent sons of his brother William, and
then to heir smale of the body of the 1st
Viscount; this was done to keep separate the Stair and Dumfries titles; he
nominated his nephew John to succeed him in his titles and estates, but the
House of Lords ruled that such nomination was invalid as to the Peerage titles,
so the next provision was followed as below
