Comment: private Maryland Continental Line; enrolled on January 10, 1827, under act of Congress of March 18, 1818, payment to date from October 18, 1826; annual allowance, $96; sums received to date of publication of list, $708.64.--Revolutionary Pension Roll, in Vol. xiv, Sen. Doc. 514, 23rd Congress, 1st session, 1833-34.

He applied for a pension in Tuscaloosa Co, AL 17 July 1826 for service as a private, corporal & sergeant in 4th Regiment Maryland Line in CAPT Oddom's Company commanded by Colonel Samuel Smith and General Smallwood. This regiment was made up of men from Anne Arundel Co, Maryland.

He stated on his pension application that he first enlisted 28 Jan 1778 in Maryland and was discharged in 1781 in the State of North Carolina and he received no pay and only one suit of clothes. He stated that he was in many a bloody battle and was wounded 4 different times in battle. He said he was in that glorious battle at Stoney Point under the command of General Wayne, and could state many more battles in the South where he got his discharge.

Thomas Cates stated that he was living in New Lexington, Alabama about 20 miles north of Tuscaloosa when he received his pension of $8.00 per month. He stated that when he enlisted they told him he was to receive a bounty of land, but he had never received it. He was twenty years old when he enlisted in the Continental Army.

The Minutes of the Old Salem Baptist Church, New Lexington, Alabama, stated that he died 1 Feb 1848. The exact burial place of Thomas Cates and his wife, Martha is not known. It is possible they are buried at Old Salem Church Cemetery, Boone Cemetery, or Espey Family Cemetery. Markers for Thomas and Martha Cates were placed in memory for them at the Wiley Espey Family Cemetery by Walter Espey DOCKERY.

Passport - 7 Oct.1808 Wilkes Co. State of Georgia We the justices of this district, do certify that Thomas Cates and John Cates are good and lawful citizens of our district and have demeaned themselves as good citizens and wish to pass and repass to the territory of Mississippi, we therefore do wish and hope that a passport be granted to that effect.

In the name of God Amen. I Thomas Cate of the county of Orange and state of No. Carolina being well of body and in perfect mind and memory thanks be given unto God. Calling to mind that it is appointed for all men once to die, do make and ordain this my last will and testement that is to say, principally first of all I give and recommand my soul into the hands of almighty God that gaveth my body. I recommand to the earth to be buried in a Decent Christian burial at the discreetion of my Executors nothing doubting but at the general resurrection I should recieve the same.

Again by the mighty power of God and as touching of my worldly estate whereunto it has pleased God to bless me in this life.

I give and dispose of the same in the following maner, I first that all just and lawful debts to be paid. I give and bequeath to my beloved wife MARTHA CATE all my movable property, only she must give out of it my son THOS. CATE & JOHN S. CATE & my daughter DORATHA CATE as much as we have to them is of age whenever they come of age & the rest of it she is to have during her natural life or widowhood & then to be equally divided among all my childern & as my land I give unto my childern in the following manner.

The hundred acres of land I got of Austin I give to my two daughters POLLY & MARTHA CATE. Polly to have fifty acres next to the widow Thom --------- & Martha to the other fifty on the east side.

Then to layoff one hundred acres of my old tract joining James Chandler beginning next Crutchfield land running north through the tract that is to be divided between ISAIAH & THOMAS CATE.

My son Isaiah (is) to have the half next to Chandler Thomas the other half next to Crutchfield. JOHN S. CATE my son is to have fifty acres Joining of the Austin tract & my daughter DORATHA CATE is to have fifty acres next to Crutchfield & to my wife I give sixty five acres of land lying in between John and Doratha, during her natural life & then to be sold and POLLY & MARTHA to have fifty dollars apiece & the balance to be divided between all my childern, but none of them are to sell their land as long as she lives without the consent of her, but having the settling of it I also constitute and appoint my well beloved friend JOHN SYKES, my beloved wife MARTHA CATE the executor of this my last will and testement. I do hereby dissolve all and every other former testement & wills that are anywhere before named.

I ratify and confirm this to my last will & testement in witness whereunto I have set my hand and seal this 17th day of December in the year of our Lord 1811. Signed and sealed in the presence of us
