CRIMINAL COMPLAINT

John Farwell, of the Eau Claire Police Department, being first duly sworn, states that:

Count 1: POSSESSION OF TETRAHYDROCANNABINOLS (THC)

The above-named defendant, on or about Tuesday, December 05, 2006, in Eau Claire County, Wisconsin, did knowlingly possess a controlled substance, Tetrahydrocannabinols (THC), contrary to sec. 961.41(3g)(e) Wis. Stats., a Misdemeanor, and upon conviction may be fined not more than One Thousand Dollars ($1,000), or imprisoned for not more than six (6) months or both.

And the Court shall suspend the defendant's operating privileges for not less than six (6) months nor more than five (5) years.  If the defendant's driving privileges are already suspended, any suspension imposed must be served consecutively.

PROBABLE CAUSE:

The complainant is in possession of police reports by Fellow Officer Carvalho, which form the basis for this complaint.

Officer Carvalho reports that on December 5, 2006, he was detailed to 2536 Harrison Street, which is located in the City and County of Eau Claire.  Previously, an animal control officer had gone to the residence and smelled the strong odor of marijuana.  Officer Carvalho went to the residence and was allowed to go inside and noticed a very strong odor of marijuana.  The defendant admitted to being the one who smokes marijuana for medical purposes and gave the officer a Ziploc bag with marijuana inside, two joints and rolling papers.  Later, the green, leafy substances tested using the narcopouch test kit and received a positive result for the presence of THC.

Based on the foregoing, the complainant believes this complaint to be true and correct.
