No. 12883 WILL OF, FRED D. TRIPPETT, FILED OCTOBER 16, A.D. 1943, W.l. BARNES, REGISTER.

And now, October 16, 1943, Application for Letters Testamentary filed.
LAST WILL AND TESTAMENT.
I, FRED D. TRIPPETT, of the Borough of Waynesburg, County of Greene and State of Pennsylvania, being of sound mind and memory, do hereby make, publish and declare this to be my Last Will and Testament, in manner and form following, hereby revoking any will or wills heretofore made my me.

First, I direct that all my just debts and funeral expenses be fully paid and satisfied, as soon as conveniently may be, after my decease.

SECOND: I will and bequeath unto my beloved wife, Zella Trippett, all my property, real, personal and mixed and wheresoever situate, for and during the term of her natural life. The income from said property to be used by my wife, Zella Trippett, for her maintenance and support and with full power in said Zella Trippett to use and consume any part of all of my said estate, real, personal and mixed, should she find it necessary in her discretion so to do.

THIRD: At the death of my wife, Zella Trippett, I hereby will and bequeath to my legal heirs living at the time of my death the sum of Four thousand ($4000.00) Dollars, to be distributed to them under the Intestate Laws of Pennsylvania.

FOURTH: The balance of my estate remaining at the death of my wife, Zella Trippett, and after the payment of the Four thousand ($4000.00) Dollars to my legal heirs, as provided in paragraph third above, shall be distributed according to the direction of my wife, Zella Trippett, which said direction may be either by last Will and Testament or by a duly executed, acknowledged and written direction to Fred T. Gillogly, one of my Executors, one-half of the said balance first mentioned in this paragraph to be distributed according to the direction of my wife, Zella Trippett, to such of her legal heirs as are living at the time of her death and the other one-half of said balance to such of my legal heirs as are living at the time of my death.

FIFTH: I hereby authorize, empower and direct my Executors hereinafter named, or the survivor of the, to sell, dispose of and convey in fee simple and or all of my real estate, either by public or private sale or sales, without any liability of the purchaser or purchasers for the application, non application or misapplication of the purchase money, and the said Executors, or the survivor of them, to make, execute, acknowledge and deliver to the purchaser or purchasers thereof good and sufficient deed or deeds for the said real estate.

I do hereby make, constitute and appoint my wife, Zella Trippett, of Waynesburg, Greene County, Pennsylvania, and Fred T. Gillogly of Rogersville, Greene County, Pennsylvania, to be my executors of this my Last Will and Testament.

IN WITNESS WHEREOF, I, Fred D. Trippett, the testator above named, have hereunto subscribed my name and affixed my seal, the Thirtieth day of September, in the year of our Lord one thousand nine hundred and forty-three.

Before me, W. L. Barnes, Register for the probate of wills and granting Letters of. Administration in and for said county, personally appeared Emma S. Call and Frank Throckmorton, subscribing witnesses to the foregoing instrument of writing, purporting to be the last Will and testament of Fred D. Trippett late of the Borough of Waynesburg, in the county of Greene, deceased, who, being duly sworn according to law, depose and say that they were personally present and saw and heard the said testator sign, seal, publish and declare the foregoing instrument of writing as and for his last Will and testament, and that they signed their names as witnesses to the said instrument of writing in the presence of the said testator and at his request, and in the presence of each other, at the time of signing the same he, the said testator was of sound and disposing mind, memory and understanding, to the best of their knowledge and belief, and that they shall answer to God at the last Great Day.

Personally came Zella Trippett, who, being duly sworn according to law, says that Fred D. Trippett, late of said county, died on the Tenth day of October 1943 at 12:55 o'clock P.M., and further saith not.

TK has copy of will - Will Book 26, page 463,464, 465, No13930. Will of Zella Trippett filed April 20 AD 1950 Harold Dulaney Register - And now April 20, 1950 Petition for Letters Testamentary filed. My Bequest It is my request that my nephew, Fred T. Gillogly shall receive all of my individual personal property including my accounts in the First National Bank and Trust Company and the First Federal Savings Bank both of Waynesburg, Pennsylvania. In regard to the portion of the estate of my late husband, Fred D. Trippett, as explained in Paragraph Four of his last Will and Testament, I, hereby, direct that the portion of his estate over which I have direction shall be disposed of as follows: (1) That all outstanding bills shall be paid. (2) That the amount of $1,000 shall be paid to each of the following: Margaret Throckmorton, Waynesburg, Pennsylvania; Texa Gillogly, Rogersville, Pennsylvania; and Dorothy Seibert, Harrisville, Ohio. (3) That the balance of said estate shall be distributed equally among my immediate legal heirs. (4) I, hereby, direct Fred T. Gillogly to carry out these requests, of this my last Will and Testament, as executor. I have made these requests of my own free will and fix my signature this the 28 day of February 1948. COMMONWEATH OF PENNSYLVANIA, COUNTY OF GREENE, SS: Before me, Harold Dulaney, Register for the probate of wills in and for said county, personally appeared J. Wood Ganiear and D. W. Lynch, suscribing witnesses to the foregoing instrument of writing, purporting to be the last Will and testament of Zella Trippett, late of the Borough of Waynesburg in the county of Greene, deceased, who being duly sworn according to law, dispose and say that they were personally present and saw and heard and said testatrix sign, seal, publish and declare the foregoing instrument of writing as and for her last Will and Testament, and that they signed their names as witness to the said instrument of writing in the presence of the said testatrix and at her request, and in the presence of each other, and at the time of signing the same she, the said testatrix was of sound and disposing mind, memory and understanding, to the best of their knowledge and belief, and that they shall answer to God at the Last Great Day. Zella Trippett departed this life on the 23rd da of March, A.D. 1950, at 10:15 o'clock P.M., at the age of 78 years.
GREENE COUNTY, SS: I, Fred T. Gillogly, do swear by Almighty God, the searcher of all hearts, that as Executor of the Last Will and Testament of Zella Trippett late of Waynesburg Borough Greene County, PA., deceased, I will well and truly administer the estate of said deceased, according to law, and also that I will diligently and faithfully regard and well and truly comply witht he provisions osf the law relative to transfer and Federal inheritances, and that as I shall answer to God at the last Great Day. And now, April 20, 1950, having considered the testimony offered in this case and filed the same of record, I do adjudge the foregoing writing duly proven as the Last Wil and testament of Zella Trippett, late of Waynesburg Borough, Greene County, Pennsylvania, deceased, and as such I do admit the same of record according to Law. Same day Letters Testamentary granted to Fred T. Gillogly, Executor named in the Will. Harold Dulaney, Register of Wills.

Notes - house numbers were 991, 974. Isaac and Mary were Eli's parents and Nancy was his sister. Eli lived 4 houses up from William and Julia Thomas.
