John4 sold several portions of his 2 CONC inheritance at various times, and gave the remainder to his three sons, 2 CONC John, Benjamin and Richard. Richard deeded his portion to Benjamin Feb. 2 CONC 21, 1780, and settled in the northeasterly part of Cumberland, R. I. See 2 CONC Smithfield Recs. B. 7, p. 298. It lists Phoebe Sprague as the mother 2 CONC of Jonathan Sprague Matley. Jonathan is my great grandfather and was born 2 CONC in Jefferson Co., Indiana. The sheet indicates that the information comes 2 CONC from Civil War records, the Matley family bible, and court records. 2 CONT A year or so ago, I contacted a researcher in Indiana named Colleen 2 CONC Ridlen. She found a deed from a Hosea Sprague who she believes to be 2 CONC Phoebe's father as he is listed as living with Phoebe and her husband 2 CONC William Matley in 1850 according to the 1850 Jefferson County, Indiana 2 CONC census. Ms. Ridlen also reported that Hosea Sprague appeared alone in the 2 CONC 1820, 1830, and 1840 censuses of Jefferson County, Indiana. Neither Hosea 2 CONC nor Phoebe are listed in the 1860 census. Phillips, correspondent. 2 CONT Based upon the 1820 Indiana, Jefferson County Census, Hosea Sprague's 2 CONC household consisted of 1 male 0-10, 1 male to 26, 1 male to 45, 1 male 2 CONC greater than 45 (five males), 3 females to 10, 1 female to 26, 1 female 2 CONC to 45 and 1 female greater than 45 (six females). Of these Hosea and 2 CONC Chloe are two and Phebe might be one. I do not know who the others are. 2 CONT By the 1830 census there were only two males (15-20 & 50-60) and four 2 CONC females ( 1 5-10, 2 10-15 & 1 50-60). Again, I am not sure who all of 2 CONC these are. 2 CONT By 1840, Hosea was living alone and by 1850 he was living with his 2 CONC daughter, Phebe (Sprague) Matley. 2 CONT Between 1816 and 1820 Hosea and his family had moved from Rhode Island to 2 CONC near Lancaster, Graham Township, Jefferson County, Indiana. He continued 2 CONC to show up in the Jefferson County census through 1850, his wife was not 2 CONC in the 1840 or 1850 census. In 1850, he was living with his daughter 2 CONC Phebe, her children and her husband, William matley. He owned several 2 CONC plots of land (40, 40, and 80 acres). He also was deeded an additional 2 CONC 160 acres from the estate of Phebe Sprague (she was probably his sister, 2 CONC although she did not show up in the census records). I have not found 2 CONC either a Probate record for Hosea Sprague in Jefferson County, Indiana or 2 CONC records showing the sale of all of his land (this is not unusual). 2 CONT In the 1820 Jefferson County, Indiana census Hosea and Chloe had 1 male 2 CONC 0-10, 1 male 16-18, 1 male 26-45 and 1 male > 45 (i.e., 4 "dependent 2 CONC males") and 3 females 0-10, 1 female 16-26, 1 female 26-45 and 1 female 2 CONC >45 (e.e. 5 "dependent females"). In the 1830 census he was down to 1 2 CONC dependent male and three dependent females. There he was admitted a 2 CONC freeman in 1671. It is possible he there m. his first wife, the Hannah 2 CONC from whom he was separated by divorce in 1676. But this is uncertain, as 2 CONC he resided alternately on the Island and in Providence. All we know 2 CONC concerning his divorce and the grounds of it is derivable from the 2 CONC following Colonial record, viz.-- 2 CONT 2 CONT "At a Session of the General Assembly, held at Newport May 2, 1676, 2 CONC Voted: Whereas John Belou, of the town of Providence, presented his 2 CONC petition to this Assembly for a legal divorce from his wife Hannah Belou; 2 CONC the Court, upon examination of the matter, finding that from the first of 2 CONC their marriage they lived very discontentedly--she complaining of his 2 CONC insufficiency: for the reason abovesaid, and others, the Assembly doth 2 CONC see cause to divorce the said John Belou from all matrimonial engagements 2 CONC to the said Hannah Belou, and that from henceforth this Assembly doth 2 CONC dedeclare him absolutely free as aforesaid." 2 CONT 2 CONT This looks a little like the easy-going kind of divorces, being granted 2 CONC mainly on account of incompatibility, with the blame charged on the wife. 2 CONC We cannot look behind the record into the merits of the case, and might 2 CONC more properly, as some will think, have ignored the whole matter, but 2 CONC chose rather to unveil it in the interest of truthful history, and leave 2 CONC its lesson of human infirmity for admonition. 2 CONT 2 CONT The following letters from John2 to his brother James (with Nathaniel's 2 CONC previously given) were rescued from oblivion by our pioneer in this work, 2 CONC Ira B. Peck, Esq., and several other long half-buried ancient documents, 2 CONC preserved by the resident descendants of James in their inherited 2 CONC patrimonial domicile. They are quaint and curious enough for careful 2 CONC insertion on these pages. They were written from his residence on the 2 CONC Island, and are as follows.-- 2 CONT 2 CONT Feb. 4, 1677. "Loving brother,--My love remembered unto thee, and my love 2 CONC to my grandmother, and to brother Peter, and to my neighbors. They are in a tolerable 2 CONC state of preservation, exhibit an old fashion chirography quite fair in 2 CONC its style, and with signatures peculiarly distinct. The above would 2 CONC afford good fac-similes. A few of the words and phrases puzzled my 2 CONC understanding, but with slight exceptions they are accurately rendered. 2 CONC They have a homely simplicity, but their naturalness of business detail 2 CONC does not detract from their value, especially in a case where we have 2 CONC nothing else to give us even a hint as to the domestic experiences, 2 CONC circumstances and pursuits of these family ancestors. We infer that John2 2 CONC was without companionable wife or child during those days, and dwelling 2 CONC with his mother and sister in their temporary home. James and Peter and 2 CONC grandmother Pike were on their Providence plantation, with occasional 2 CONC business of common interest up and down the shores of Narragansett Bay. 2 CONT 2 CONT It would seem that his widowed mother, and probably his sister Hannah, 2 CONC had been staying with John on the Island. Very likely they went thither, 2 CONC as many others did, just before king Philip's Indians attacked 2 CONC Providence, to escape impending danger. James, however, and his 2 CONC grandmother Pike, either did not flee to the Island, or had already 2 CONC returned to Providence. John took up his abode with the rest of the 2 CONC family before 1681: for he was then admitted a freeman of Providence. It 2 CONC seems, too, that he served in the Indian war and was wounded; for the 2 CONC General Assembly, at their October session in 1684, passed the following 2 CONC order.--"John Ballou is allowed three pounds in or as money to be paid by 2 CONC the General Treasurer for his cure of his wound in the late Indian war." 2 CONC Later the three brothers, John, James and Peter, settled near each other 2 CONC on a large tract of land in the locality then called by the Indian name, 2 CONC Loquasquissuck, afterwards modernized into Louisquisset. I have had no convenient opportunity to examine either 2 CONC the original document or the Probate Record of it. If I had made such an 2 CONC examination, perhaps I could have cleared up some of its obscure 2 CONC phraseology, and precluded the necessity of my explanation concerning his 2 CONC wife Sarah. Whatever exceptions may justly be taken to its orthography 2 CONC and style, it evinces that the testator had a good memory and kind 2 CONC consideration of his kindred, as also a careful ingenuity in providing 2 CONC for possible contingencies. I., formerly Smithfield, and 2 CONC originally Providence. It will interest many readers to understand that 2 CONC he was the grandfather of our celebrated Rev. Hosea Ballou. We have, 2 CONC however, but little biographical material wherewith to illustrate his 2 CONC character, worth, or fame. General tradition reports him to have been a 2 CONC very conscientious and morally exemplary man. We see what a large family 2 CONC he and his companion reared up in their then frontier home, and can 2 CONC easily imagine that their lot in life was one of pioneer toil and hard 2 CONC earned competence. He was a cooper by trade, and probably throve all the 2 CONC better as farmer by his mechanical profits. His homestead joined that of 2 CONC his brother Maturin3 toward the north. The principal memorial he left us 2 CONC is his Will, which may be found on Providence Records, B. Mr. Peck says.--"His gravestone I found in the North 2 CONC Burying Ground at Providence, nearly covered by underbrush, and the 2 CONC letters much obscured." 2 CONT 2 CONT We learn incidentally from this document, besides its fundamental facts, 2 CONC that his daughter Elizabeth was not living, being unmentioned; that his 2 CONC dr. Sarah was living in maidenhood; that his youngest dr. Mercy was 2 CONC living in early youth; and that probably his dr. Amey had been some time 2 CONC deceased. Whether the Olney Jencks mentioned was the son of Amey, or her 2 CONC husband, is left unindicated. We may infer from her being made sole 2 CONC executor, that Mrs. Rebecca, the wife and mother, was a capable, 2 CONC judicious, trustworthy woman. It seems that Peter3 was designated on 2 CONC Providence Records as Peter, Jr., simply, we suppose, to distinguish him 2 CONC from his uncle Peter2. His widow survived him till Feb. 13, 1787, almost 2 CONC 33 yrs.--aged 93 yrs. 9 mos. and 4 ds. Maturin Ballou with Robert Pike and family 2 CONC located in Providence as early at least as January, 1646. 2. Maturin died 2 CONC somewhere between Feb. 24, 1661, and Jan. 31, 1663, and of course all his 2 CONC children were born previous to the latter date. 3. John, his eldest son, 2 CONC was admitted a freeman at Newport May 1, 1671, prob. soon after he was 2 CONC twenty-one years of age. 4. Samuel Ballou, Maturin's youngest son, was 2 CONC drowned while yet a lad, June 10, 1669--as is proven by the following 2 CONC verdict of Inquest by a jury: "We find, according to the evidence given 2 CONC in, that the lad, the widow Belloo her son, named Samuel Belloo, going 2 CONC into the river which runneth to the mill in Providence to wash himself, 2 CONC was by a providence of God drowned." See particulars in a book entitled 2 CONC "Deeds Transcribed" p. 455, City Clerk's office, Providence. The critical 2 CONC reader can calculate for himself and understand the probable proximate 2 CONC correctness of our given birth-dates; which it was deemed proper to place 2 CONC two years apart. The small river in which the lad Samuel was drowned bore 2 CONC the name Moshassuck. John Ballou's admission as a freeman may be found in 2 CONC Colonial Records B. II. under date of May 1, 1671. The death of Maturin 2 CONC Ballou is proximately determined by the following data. 1. He had land 2 CONC laid out to him as late as Feb. 24, 1661; 2, a Receipt from Roger 2 CONC Williams, &c., to his widow, viz.--"Providence 31, 11, '63, (so called) 2 CONC [i. e. We say recd at ye 2 CONC appointmt of ye town by us. 2 CONT 2 CONT Roger Williams, 2 CONT John Fenner." 2 CONT 2 CONT We find no particulars concerning the death of Maturin1, but presume it 2 CONC must have taken place while yet he was in the prime of middle age, to the 2 CONC great affliction of his wife, children, relatives and friends. Next the 2 CONC family mourned the loss of Samuel, in 1669, by drowning, and next, in 2 CONC youthful manhood, that of Nathaniel, probably not far from 1677 or 78. No 2 CONC record of the precise date has been found, and the only mementoes he left 2 CONC of his existence are two dateless letters--one to a brother, and one to 2 CONC his mother. These are thought too precious to omit. They are as 2 CONC follows:-- 2 CONT 2 CONT "Dear and loving brother,-- 2 CONT 2 CONT My love to thee, and all the rest, and to all that ask after me. Let this 2 CONC give thee to understand that I have received thy lines, and am glad to 2 CONC [know) that thou dost harken to my council, to think of thy latter end. 2 CONC Indeed, that will do the only good that thou canst seek after: and it is 2 CONC my heart's desire that thou mayest so do, and not put that day of 2 CONC salvation far from thee. Remember my love to my brother John, and to my brother 2 CONC James, and to my brother Peter, and to my sister--wishing all their 2 CONC welfare in this life, and if it may be in that which is to come also. 2 CONC Mother, being very weak, I have wrote a few lines to you, desiring you to 2 CONC consider this one thing, that there is no fleeing from the grave. For it 2 CONC is that which I do look for, to put off this earthly tabernacle. And when 2 CONC you shall hear this news, I pray thee, let not this trouble you: for I 2 CONC know this, that I shall have my part in the first resurrection, and shall 2 CONC live forever. So I bid you all farewell, and rest your dutiful son. 2 CONT 2 CONT Nathaniel Ballou. 2 CONT Brother James, I pray thee not to forget me." 2 CONT 2 CONT Where Nathaniel was when he wrote these letters, what were his pursuits, 2 CONC and why he was away from the parental home, no hint is left on record, 2 CONC and conjecture is useless. It would seem, from his mentioning his 2 CONC grandmother and not his grandfather, that the latter, Robert Pike, had 2 CONC gone the way of all the earth, probably sometime between 1673 and 1678. 2 CONC His two letters show that he was a deeply religious young man, as well as 2 CONC very affectionate towards his family relatives; and the last one 2 CONC indicates that his death was at hand. Happily he was ready to depart, and 2 CONC his soul anticipated with undoubting confidence a joyful entrance into 2 CONC immortal blessedness. We regret that no more can be told of him. 2 CONT 2 CONT After the four surviving children came of age, the estates of their 2 CONC father and grandfather were legally divided between them and their 2 CONC mother. It runs north and south from a 2 CONC point supposed to be seven 2 CONT miles west of Fox Hill, though it actually measures more. It is now the 2 CONC dividing line between 2 CONT Smithfield, Johnston and Cranston on the east, and Seituate, Glouceater 2 CONC and Burrillville on the 2 CONT west. It was the western boundary of the early division of Providence 2 CONC town lands. They subsequently 2 CONT divided the land on the west side of the line. 2 CONT 2 CONT Secondly--that the sixty acres of upland in ye 2d division & ye share of 2 CONC medow in ye same division in ye right of ye said Matureene Belloo & one 2 CONC half ye right of common, reckoning so far west from ye town of Providence 2 CONC as ye seven mile line, & a quarter part of ye right beyond ye seven mile 2 CONC line, & one acre of swamp land adjoining to ye aforesaid share of medow, 2 CONC & half a six acre lot lying in ye neck between ye land of John Brown & ye 2 CONC land of Shadrach Manton, it being the west end or west half of said six 2 CONC acres of land, together with all and every of their appertances, to be 2 CONC unto ye said John Belloo, to him & his heirs & assigns for ever. 2 CONT 2 CONT Thirdly--that the sixty acres of land in ye 2d division in ye right of ye 2 CONC said Robert Pike, & ye ten acres of land in ye said division in ye right 2 CONC of ye said Robert Pike in lieu of a share of medow, and a piece of swampy 2 CONC land which was laid out in exchange from ye new field in ye right of ye 2 CONC aforesaid Matureene Belloo, & half of ye right of common reaching from ye 2 CONC town of Providence so far west as ye seven mile line in ye right of ye 2 CONC aforesaid Robert Pike, with what lands are divisible upon it, & one 2 CONC quarter part in ye right of ye aforesaid Matureene Belloo in ye land 2 CONC beyond ye seven mile line, & one quarter part of a six acre lot lying in 2 CONC ye neck betwixt ye land of John Brown and ye land of Shadrach Manton, the 2 CONC which said quarter part of ye said six acre lot is to be at the east end 2 CONC thereof, all the said lands & Common & all and every of their appertances 2 CONC to be unto ye said James Belloo afore named, to his heirs and assigns 2 CONC forever. 2 CONT 2 CONT Fourthly--that the ten acres of land which was bought of Samuel Whipple 2 CONC lying westward of ye brook called Robbins brook & Southward from 2 CONC Walling's furnace, & eleven acres of swampy land lying in ye great swamp 2 CONC in ye neck, the which is both in ye right of Robert Pike aforesaid, & 2 CONC also of ye aforesaid Matureene Belloo, and half a right of Common 2 CONC reaching from ye town of Providence so far west as ye seven mile line 2 CONC with ye lands yet divisible upon it in ye right of ye said Matureene 2 CONC Belloo, & a quarter part of ye right of ye said Matureene in ye land 2 CONC beyond on ye west side of ye seven mile line, and one quarter part of a 2 CONC six acre lot in ye neck which lyeth between ye land of John Brown & ye 2 CONC land of Shadrach Manton, the which said quarter part is to be between the 2 CONC aforesaid John Belloo his share of ye six acres & ye said James Belloo 2 CONC his share of ye said six acres, to be, all and every part of the said 2 CONC lands & common & all & every of their appertances, unto ye said Peter 2 CONC Belloo to him, his heirs & assigns for ever. 2 CONT 2 CONT Fifthly--that in case it shall so fall that ye aforesaid Hannah Belloo, 2 CONC widdow, shall stand in need of assistance with maintainance for her 2 CONC relief, then shall the said John Belloo & James Belloo & Peter Belloo 2 CONC each of them and their executors, heirs & administrators, be at equal 2 CONC charges for her maintainance to the end of her natural life. 2 CONT 2 CONT Sixthly--that four written instruments be made the which shall all 2 CONC correspond & agree each with the other, and that each one of ye aforesaid 2 CONC concerned persons shall sign and set his seal to every one of ye said 2 CONC four written instruments, that any one of ye said four written 2 CONC instruments shall be good to all intents and purposes for each of said 2 CONC persons their heirs, executors, administrators and assigns to hold and 2 CONC maintain their lands and estates by the which are therein contained and 2 CONC mentioned for each one their part, and that this instrument is one of ye 2 CONC said four written instruments. 2 CONT 2 CONT This being covenant conclusion, determination and full & joint agreement 2 CONC made by ye aforesaid Hannah Belloo, widdow, John Belloo, James Belloo, 2 CONC Peter Belloo & Hannah Belloo, daughter of ye said deceased Matureene 2 CONC Belloo; in witness thereof they do all hereunto set their hands & seals 2 CONC this first day of March, in ye year one thousand six hundred eighty and 2 CONC five, six." II. p. 112, &c. 2 CONT 2 CONT This is certainly a very important instrument, remarkable for its 2 CONC clearness and strength of specification, considering its date, and 2 CONC invaluable for its historic details. It puts us in possession of 2 CONC authentic facts respecting the early circumstances and affairs of Maturin 2 CONC Ballou's family almost indispensable to a fair start of their genealogy. 2 CONC It would seem from its silence concerning Mrs. Catherine Pike, widow of 2 CONC Robert, that she had followed him to the world of spirits--probably 2 CONC sometime between 1680 and 1685. Whether we can infer from the orthography 2 CONC of the name, "Matureene Belloo," anything conclusive as to the early 2 CONC pronunciation of it, is doubtful; though it is probable that the 2 CONC draftsman of the instrument, an evidently legal gentleman, gave nearly 2 CONC its usual phonetic pronunciation. But the scribes and clerks of 2 CONC subsequent date made such incongruous work of writing it and the sur-name 2 CONC generally, that we are only amazed at their multiform whimsicality. We 2 CONC know, however, by the original letters of Nathaniel and John, sons of 2 CONC Maturin, that they spelled their surname as we now do--Ballou. 2 CONT 2 CONT What next occurred in the experience of the family? It is probable, if 2 CONC not certain, that the widow Hannah Ballou and her daughter Hannah resided 2 CONC for several years on the original homestead in the northerly section of 2 CONC Providence. Meantime the three brothers, John, James and Peter, settled 2 CONC within a short distance of each other on their respective divisions of 2 CONC inherited common land in a locality then called Loquasquissuck, but now 2 CONC Louisquiset. This tract was then in its wilderness state, but had several 2 CONC attractive open meadows, created by the ancient beavers, yielding 2 CONC annually large crops of nutritious grasses, much needed in those days for 2 CONC the sustenance of cattle. It was situated only a few miles northwest of 2 CONC the parental homestead, in what is now the westerly part of Lincoln, 2 CONC between the villages of Manville on the north and Lime Rock on the south. 2 CONC This locality was originally in the town of Providence and included in 2 CONC the tract of common territory called the Outlands of Providence. In 1730 2 CONC those Outlands were divided into three towns, viz.: Smithfield, 2 CONC Gloucester and Scituate. Thenceforth the Ballou locality of the second 2 CONC generation was in Smithfield. In 1871 Smithfield was subdivided so as to 2 CONC constitute wholly or in part four towns, viz.: Smithfield, North 2 CONC Smithfield, Woonsocket and Lincoln. Burrillville was set off from 2 CONC Gloucester in 1806. The ancient James Ballou homestead lies about half a 2 CONC mile westward from the village of Albion. A portion of it continues in 2 CONC possession of their descendants to this day. 2 CONT 2 CONT At length the mother and daughter began to stand in need of special care 2 CONC from one or more of the sons. They preferred that of James, and entered 2 CONC into the following Agreement with him, Oct. 22, 1707: 2 CONT 2 CONT "Whereas there are two house lots or home shares of land, each lot 2 CONC containing about four acres of land be it more or less, the which are 2 CONC situate lying and being in the town of Providence, in the Colony of Rhode 2 CONC Island and Providence Plantations, in the Naragansett Bay in New 2 CONC England--lieing and being in the row of house lots whereon the town is 2 CONC seated, and towards the northern part of the town--the which said lots of 2 CONC land, one of them formerly belonged unto Robert Pike formerly of said 2 CONC Providence but now deceased, the other of them formerly belonged to 2 CONC Matureene Belloo formerly of said Providence but now deceased--The which 2 CONC said two house lots or home shares of land do now belong to us, Hannah 2 CONC Belloo, formerly wife of the sd Matureene Belloo but now his widow, and 2 CONC Hannah Belloo, daughter of the aforesaid Matureene Belloo, both of ye 2 CONC aforesaid town of Providence, and are our proper estates, both the said 2 CONC lots: And whereas we, the sd Hannah Belloo, widdow of the aforesaid 2 CONC Matureene Belloo, and Hannah Belloo, daughter of the aforesaid Matureen 2 CONC Belloo, are now fallen into the care and providing for of James Belloo, 2 CONC of the aforesaid town of Providence, son of the aforesaid deceased 2 CONC Matureene Belloo and of the said Hannah Belloo, widow of the aforesaid 2 CONC deceased Matureene Belloo: And whereas it is requisite that the said 2 CONC James Belloo should be considered as with respect to his care and charges 2 CONC as to our providing for and maintainance so far as we are capable, and if 2 CONC it shall so fall out at any time with us or with either of us, that we or 2 CONC either of us may not be in a capasity to answer the said James Belloo as 2 CONC to his care, charges and disbursements concerning us or either of us, the 2 CONC sd two lots of land shall be under such circumstances as to make 2 CONC restitution unto the said James Belloo or his heirs for what he hath or 2 CONC may yet expend upon us or on the longest lived of us. Per me Richard Waterman, Clerk." 2 CONT 2 CONT It furthermore appears that the mother and daughter made a deed bearing 2 CONC this same date of October 22, 1707, whereby they conveyed to James Belloo 2 CONC all their right, title and interest to lands on the west side of the 2 CONC seven mile line, as specified in the divisional agreement hereinbefore 2 CONC copied. This deed, which is still extant in its original form, purports 2 CONC to have been recorded in "Providence Records," Book II. pp. 195 and 196, 2 CONC June 13, 1711, by Thomas Olney, Clerk. 2 CONT 2 CONT Under date of Jan. 28, 1711-12, Hannah Ballou, the widowed mother, 2 CONC executed a deed whereby she conveyed to her son James "my two six acre 2 CONC lots situate and being within ye Town of Providence & lying between land 2 CONC of James Brown on ye south & the land of John Arnold on the North, and 2 CONC butting on ye Town street on the west--one of which sd lots did formerly 2 CONC belong unto my well beloved husband, Matureene Belou deceased, the other 2 CONC did formerly belong to my much honored father, Robert Pike deceased--as 2 CONC also one half Right of common on ye east side of ye seven mile line. And 2 CONC also fourteen acres of land laid out unto me adjoining to the lands of my 2 CONC said son, James Beleu, together with all my household stuf and other 2 CONC moveable Estate of what kind and nature soever." Providence Records, Book 2 CONC III. p. 90. 2 CONT 2 CONT At this same date James bound himself in the penal sum of ¶40 to his 2 CONC mother "to find for and allow unto her meat, drink, washing, lodging, 2 CONC appariel and tendance, with all things else needful and necessary 2 CONC respecting both her age and times of sickness," during her whole life. 2 CONC Providence Records, B. III. p. 90. 2 CONT 2 CONT Thus we find James Ballou in legal possession of all the property that 2 CONC had belonged to his mother and to his sister Hannah--he giving bonds as 2 CONC aforesaid. As his sister is not mentioned in either of these two 2 CONC instruments bearing date Jan. 28, 1711-12, she had undoubtedly deceased. 2 CONC This determines her death to have taken place some time between Oct. 22, 2 CONC 1707, and Jan. 28, 1711-12, which is the nearest approximation we are 2 CONC able to make to the date of that event.(*) 2 CONT 2 CONT The foregoing arrangement appears to have been quite unsatisfactory to 2 CONC John Ballou, the eldest son of Maturin and Hannah (Pike) Ballou. It 2 CONC seemed to him that his brother James had inveigled himself into an undue 2 CONC share of his mother's estate, and he complained of it. He died some 2 CONC little time before his mother, and left his grievance to be cherished by 2 CONC his eldest son, John Ballou, Jr. When his grandmother had passed away, 2 CONC this son insisted that his uncle James should hand over to him a share of 2 CONC the estate, pleading that the three sons and their heirs had all been 2 CONC bound for the old lady's maintenance, and ought to share her property. 2 CONC His uncle James contended that he had borne all the care and expense of 2 CONC her maintenance, and that the entire estate made over to him would hardly 2 CONC make him whole. But John, Jr., 2 CONT (*) Aug. 20, 1885. Our friend John O. Austin, an expert Rhode Island 2 CONC genealogist, has recently 2 CONT discovered and communicated in part a record of the testimony given on 2 CONC trial of the case between 2 CONT John Ballon3 and his uncle, James Ballou2, in 1718, which reports Peter 2 CONC Ballou2 as declaring that 2 CONT his sister Hannah "died fore part of January 1712." This seems to settle 2 CONC the date almost to a day. 2 CONT 2 CONT brought suit against his uncle, which was tried before the "General Court 2 CONC of Trials" at Newport in Sept., 1718. It seems that the plaintiff lost 2 CONC his case. There are some peculiar and quaint papers extant relating to 2 CONC this case, which we cannot afford to have buried out of sight. They will 2 CONC repay preservation, and, as curiosities, if nothing more, demand a place 2 CONC in these pages. The first of these documents is a Release or discharge 2 CONC made by James, the uncle, to John, his nephew. 2 CONT 2 CONT "Whereas my brother John Ballou did oblige himself and heirs to be at 2 CONC equal part of the expense of maintaining my mother and sister, now 2 CONC deceased, with me and my brother Peter, I do now therefore discharge John 2 CONC Ballou, son and heir of the said John Ballou now deceased, from all costs 2 CONC and charges which have occurred for the support of my mother & sister. 2 CONT 2 CONT James Ballou. 2 CONT Feb. 7, 1717-18." 2 CONT 2 CONT This is only an extract from the instrument, containing the pith of its 2 CONC substance, but is sufficient for our purpose. It looks as if uncle James 2 CONC executed it to foreclose any plea on the part of nephew John, that he and 2 CONC others might be held liable to pay charges for the maintenance of his 2 CONC grandmother and aunt. But it is chiefly interesting as showing that the 2 CONC uncle intended to insist on no unjust claims, and more especially to us 2 CONC of this generation, as indicating proximately the death-dates of his 2 CONC mother and brother John. Another recorded document, discovered by 2 CONC Frederick M. Ballou, Esq., after the foregoing was written, shows that 2 CONC John had deceased previously to "March 4, 1714-15." Hence it is somewhat 2 CONC probable that the mother and her eldest son died not far apart--he during 2 CONC the year 1714, she early in 1715. These instruments are our only 2 CONC dependence for fixing their death dates. We have, however, two much more 2 CONC curious documents relating to this family controversy. Here is a 2 CONT 2 CONT 2 CONT DEPOSITION BY DEPUTY GOV. JOSEPH JENKS. 2 CONT "I Joseph Jenks, being of Lawful age, Do testify & Say, that Som years 2 CONC ago I was Desired by James Beleu to write a Deed of Some percils of Land, 2 CONC which he told me his mother was minded he should have in Satisfaction for 2 CONC ye Charge which he had already been at for her maintainance, As also for 2 CONC her further maintainance During her life, he also desired me, that when I 2 CONC had writ Sd Deed I would bring it up to his house & Se it Executed, & 2 CONC accordingly when I had writ the Deed I carried it to his house, & when I 2 CONC came there he Sent for his brother Peter Beleu to come to his house to 2 CONC See the Executing of Sd Deed, he also Sent for Some persons for 2 CONC witnesses; & whilst the messengers were gon (which I suppose was about an 2 CONC hour) I fell into Discourse with the Ancient woman, James Beleu's mother, 2 CONC & asked her Several questions--& to my thinking She answered very 2 CONC Rationally to them all, & as Rationally as She could have done at any 2 CONC time, for many years past: & amongest other discourse, I asked her if She 2 CONC could Remember her age. She Replied She could not, but told me that 2 CONC Thomas Olney had kept her age Ever Since She came to Live at Providence: 2 CONC for, said she, when I first came into this Town, we had discourse about 2 CONC our ages, & found that we were both born in one year: & he has kept my 2 CONC age Ever Since. So after Some Time the Messengers Returned; & Thomas 2 CONC Hopkins & Valentine Inman Came for to be witnesses to Sd Deed; but Peter 2 CONC Beleu Came not--he having business which Detained him, as was said; but 2 CONC John Beleu came & Seemed very angery, Saying that he thought he ought to 2 CONC have part of the Land. James Beleu Replied, I do not Covet the Land, do 2 CONC you pay me what Charge I have been at, in keeping my mother, & Hannah, & 2 CONC take my mother & Look after her as Long as She lives, provided She be 2 CONC willing to goe with you, & Do you take the Land. John Beleu Replied he 2 CONC would take her; but She made Answer, I won't go with you, John, what will 2 CONC you do with me? you can't Look after me, or to that Effect. So She 2 CONC proceeded to Sign the deed, being Dim Sighted She asked where She must 2 CONC Sign, & I guided her hand to the place & She Signed the Deed, but John 2 CONC Beleu forbid the witnesses Signing, but they proceeded & Signed as 2 CONC witnesses: & I heard not one word, neither from him nor them, of the old 2 CONC woman's being Childish, or Incopassitated for such a business. It 2 CONC appears to be in the hand writing of Richard Browne, Esq., who swore the 2 CONC deponent, excepting only the signature, Joseph Jencks, which is probably 2 CONC his own, as it is spelled with a c in it before the k, unlike "Jenks" at 2 CONC the beginning, and shows a lighter use of the pen. Joseph Jenks was a 2 CONC distinguished man and official functionary among the early Rhode 2 CONC Islanders. The deed and bond to which he refers, as having assisted to 2 CONC execute, bear date January 28, 1711-12; which has been shown on a 2 CONC preceding page. The deponent is understood to refer first to "John 2 CONC Beleu," the elder brother of James, and last to "John Beleu," the nephew. 2 CONC He makes neither of these Johns appear to very good advantage in 2 CONC comparison with James, who seems to have been a high minded, fair and 2 CONC just person. Hannah Ballou, the aged widow of Maturin, is shown to have 2 CONC been a discriminating, shrewd woman, with downright common sense and a 2 CONC positive will. She was not to be trifled with. This deposition gives us 2 CONC our best indications concerning Hannah (Pike) Ballou's age, yet is not 2 CONC desirably definite. Mr. Olney and she were born the same year. They were 2 CONC eighteen years of age when she first came to Providence. But when was 2 CONC that? Her parents, she and her husband dwelt for a time with Mr. Olney's 2 CONC father. Was she then already married to Maturin Ballou at the age of 2 CONC eighteen? Or is it only meant that he who became her husband lived in 2 CONC Pike's family? There is constructive room for conjecture; and it is a 2 CONC reasonable conjecture, that the Pike family, with Maturin Ballou, may 2 CONC have come to Providence as early as 1644, though their land grant is 2 CONC dated in Jan., 1646. We have no means of settling these points. We shall 2 CONC assume, however, that they were living at Mr. Olney's in 1644, that 2 CONC Hannah Pike had not then been married, was at that time eighteen years 2 CONC old, and was probably married two or three years later. If so, she was 2 CONC eighty-five years of age or thereabouts in 1712, when she executed the 2 CONC deed to her son James, which Joseph Jencks wrote and took her 2 CONC acknowledgment of. And if so, she must have been eighty-seven or over at 2 CONC her death, which probably took place not far from 1714. If we have not 2 CONC mistaken facts in assuming that the deponent spoke first of John Ballou, 2 CONC Sen., and afterwards of John Ballou, Jr., then it would seem that John 2 CONC Ballou, Sen., must have died perhaps before his mother: i. e. during 2 CONC 1714, and she early in 1715, as already conjectured. This point must be 2 CONC left in some obscurity and uncertainty, for want of requisite explicit 2 CONC data. 2 CONT 2 CONT ANOTHER KINDRED DOCUMENT 2 CONT now demands consideration. It explains itself, and is literally as 2 CONC follows:--"Whereas there hath been: and yet is a Contention betwixt John 2 CONC Ballou, and his uncle James Ballou, both of Providence in the Colony of 2 CONC Rhode Island &c: Concerning certain Lands lying within the Township of 2 CONC Providence aforesaid, the which said Lands the said James Ballou 2 CONC purchased of his mother, Hannah Ballou, as by two deeds of Sale under her 2 CONC hand & seal may appear, nevertheless the said John Ballou, sence the 2 CONC decease of his Grandmother the sd Hannah Ballou, layeth Claim unto said 2 CONC land as being heir unto it: and their strife about the same is risen to 2 CONC such a height that they have had one tryal at the last General Court of 2 CONC tryals held at Newport in September last past, and design to have another 2 CONC at the next General Court of tryals there; and inasmuch as neither of the 2 CONC said deeds of sale do so exactly and plainly declare how much money the 2 CONC sd James Ballou gave for the said Lands, as they might have done, 2 CONC therefore some persons have taken the groundless advantage as to say the 2 CONC sd James Ballou obtained the aforesaid Lands of his said mother for a 2 CONC very small sum, if any thing, or at least nothing near the true worth 2 CONC thereof: Therefore the said James Ballou Earnestly desired us whose names 2 CONC are here under written, to give our Judgment as to the true worth of the 2 CONC said Lands: and also to Examine the books of the accounts of the dealing 2 CONC between his said mother and himself; that so it may be known for the 2 CONC future whether there was any wrong done in that affair or not. Govr." 2 CONT 2 CONT 2 CONT Whether this unique document was ever used at any trial of the 2 CONC controversy to which it relates, we do not know. Its procurement by James 2 CONC Ballou seems to have been mainly designed to satisfy candid inquirers 2 CONC into the case, that he had done no wrong in the obtainment of his 2 CONC mother's lands, nor given any just cause of complaint to his contentious 2 CONC nephew in the matter. This was creditable to his self respect, as well as 2 CONC to his sense of justice. He was evidently an upright, prudent and 2 CONC honorable man. If his nephew was wanting in any of these qualities, for 2 CONC any reason, he was no exception to multitudes of kindred minds in our 2 CONC world. And if the Ballous of this generation take no pride in this feud 2 CONC of their progenitors, they may draw useful lessons from it in avoiding 2 CONC what is censurable on one side, and imitating what was commendable on the 2 CONC other. They can see that human nature was active in their ancestors, as 2 CONC in themselves, and treasure up the admonitions of wisdom. 2 CONT 2 CONT Here we may close all that need be said of Maturin Ballou, his widow, 2 CONC Hannah (Pike) Ballou, and the three of their children who died unmarried. 2 CONC Maturin Ballou1, our patriarch, died not far from 1661, and was buried 2 CONC probably in the oldest Providence Grave Yard. No lettered stone marks the 2 CONC spot. Samuel, his youngest son, was drowned June 10, 1669, a mere lad, 2 CONC and buried near his father. Nathaniel, next older than Samuel, died and 2 CONC was buried away from the family home; but where no record yet found 2 CONC informs us, perhaps about the year 1678. Hannah, the only daughter, was 2 CONC never married, and spent her last years with her venerable mother at the 2 CONC residence of her brother James Ballou, on his homestead about half a mile 2 CONC west of the village called Albion, in then Providence, afterwards 2 CONC Smithfield, and now Lincoln. She died between 1707 and 1712, the precise 2 CONC date unascertained. Her remains were undoubtedly buried in that brother's 2 CONC family cemetery. Hannah, the widow of Maturin1, styled by Deputy Gov. 2 CONC Jencks "the ancient woman," died, as we have assumed, on the same 2 CONC premises, aged not far from eighty-eight years, and her ashes repose in 2 CONC the same humble cemetery. It was located only a short distance from the 2 CONC original home-site. There rests the dust of James Ballou2, of his wife, 2 CONC mother, sister, and a portion of his posterity. No sculptured marble 2 CONC distinguishes the oldest graves from each other. It ought to be a 2 CONC hallowed depository to the descendants of James2, and may hereafter be 2 CONC fitly honored with some deserved monument of commemoration. 2 CONT 2 CONT 2 CONT ARRANGEMENT OF THIS GENEALOGY. 2 CONT The proper construction and arrangement of this work has been a subject 2 CONC of considerable solicitude with the author. At first he was disposed to 2 CONC present its details in three General Parts, quite distinct from each 2 CONC other, so as to treat separately of John Ballou2 and his descendants, of 2 CONC James Ballou2 and his descendants, and of Peter Ballou2 and his 2 CONC descendants. But on finding that the descendants of Peter2 were so few as 2 CONC to be very disproportionate in number to those of his two elder brothers, 2 CONC he concluded to carry the whole along together in the order of their 2 CONC generations. On the advice of an experienced genealogist, he thought, for 2 CONC awhile, of placing the female branches of descent, wherever they forked 2 CONC off from the male lineage, with full family records in a compact series 2 CONC together from case to case. But after mature reflection, he decided to 2 CONC avoid such broad blocks of eccentric specification, out of the regular 2 CONC chronological line as this must occasion, and to let both male and female 2 CONC branches of descent flow along in their natural order. He has proceeded 2 CONC accordingly, and the reader will please seek both for male or female 2 CONC descendants in the regular range of successive generations; care being 2 CONC taken on his part to guard against obscurity and mistake.
