Supervisors Liable for FMLA Violations

A supervisor may be held personally liable for violating the Family and Medical Leave Act (FMLA), according to recent court rulings. In one instance, an employee who was fired for missing time after having surgery sued the supervisor who fired him. The supervisor tried to have the case dismissed by arguing that he was not an “employer,” only an agent acting on behalf of the employer. The court disagreed, stating the person acting in the interest of the company is considered an employer. This differs from Title VII of the Civil Rights Act, which states that a supervisor is merely the agent of the employer and that it is the employer who is responsible for the action of its agents. Many FMLA violations stem from the misconception that an employee must specifically ask for leave under the FMLA. This is not the case. If a supervisor knows, or has reason to believe, that an absence is for an FMLA-covered condition, it must be given the protection of the law, the court said.
