EPILOGUE: Problems with my divorce situation and the USFSPA began in 1994. It is now 1999 and legal actions are still ongoing. While searching for attorneys and thinking about how an overpayment of more than $18,000.00 had occurred, I realized virtually all of the problems I had experienced with my divorce would not have occurred if: - there was no USFSPA, - the USFSPA provided for recourses for military retirees to petition a Court to stop or reduce ex-spouse military retirement payments after divorce decrees were rendered if it could be demonstrated ex-spouses payments were no longer justified, - overpayment laws were abided by internally within the DFAS organization - I had not served in and subsequently retired from the military In effect, I realized what had occurred was my status as a military Veteran and in completing military service had been used against me mostly by the Court System (i.e., Judges who abused their judicial discretion) in the State of Texas and to a lesser degree by the United States Government. I was defacto penalized because I was an American military Veteran. Furthermore, a State Court system legitimized and sanctioned fraudulent and false claims for military retired pay that were in excess of court orders and in violation of Court orders, USFSPA laws, and all income tax laws. In my situation, Texas State Court system had even carried the USFSPA so far so as to make a foreign ex-spouse such a special individual (who is unlike virtually all other Americans) in that she can receive a U.S. Government payment and be able to avoid American taxes. In turn, I am subject to a double taxation. Other individuals could not be treated in the same way by Courts system because they are not military Veterans. My "only" alternate to correcting the problem with recouping payments wrongfully made to my ex-spouse and her attorney under the laws prescribed in the United States was for me to incur expenses for attorney fees and hope my case is heard by a Judge who would at least consider all laws.. Regardless of the outcome, further time and or money is certain to be lost - d ue to the problems created by the USFSPA.
