SECOND REQUEST FOR AN APPEAL HEARING However, I knew my then-wife's opposing attorney claim about not knowing about the appeal was false. I knew my then-wife's attorney had been aware of the pending appeal because I had included appeal documents with the Texas State Bar Association Misconduct Report I filed for the November 1995 investigation hearing. Then the State Bar Association notified me the attorney for my then-wife was given copies of all documents I submitted for the investigation. Furthermore, the appeal was discussed in the recorded hearing in which I was present that was also open for review by properly designated officials. Consequently, my attorney re-filed a request for my divorce case to be heard before the Court of Appeals based on the evidence I submitted to the State Bar Association the previous November. About one month later, the Court of Appeals (seemingly reluctantly) granted the request to hear my divorce case.
