The Anti-Corrution Agency, ACA, Would Have To Come Out With Convincing Methods To Deal With The 6-Year-Old Eusoff Chin-Lingam Photographs

We need political will to fight corruption. The Malaysian Anti-Corruption Agency, ACA, Director-Genral (Operations) Datuk Ahmad Said Hamdan says that ACA monitors information on alleged corruption in the Internet as a means of intelligence gathering to combat graft. This includes the allegations on the six-year-old photographs of Malaysian Chief Justice Tun Mohd Eusoff Chin and Datuk Lingam holidaying in New Zealand in December 1994. Datuk Lingam is a defence lawyer.

The Deputy Director-General confirms that the agency's intelligence section monitors such information, whether they were sourced from newspapers, magazines, the Internet or from people who went personally to the ACA to lodge a report.

It is logical for ACA to go on the new technology which will evolve into a more advanced virtual world. We look forward to ACA becoming more (Information Technology) IT-savvy in handling the intricate world of corruption. We require the Government to have the will, the determination and increased funding to make ACA perform its functions. ACA must be truly independent. At present, whatever the Government's justifications, it is seen as an appendage of the Prime Minister's Department.

Chin-Lingam photographs. For example, is it prepared to present its report on the photographs in Parliament? For years, we have advocated that ACA should sever its umbilical cord with the Prime Minister's Department so that it is directly responsible to Parliament.

Similarly, ACA has been investigating the mutibillion-ringgit losses of Perwaja Terengganu Sendirian Berhad (Private Limited), the national steel conglomerate, since 1996. We are still waiting for its report on the continual fiascos of Perwaja at the expense of the tax-payers.

In the intricate world of corruption, it is difficult to prove the allegations including those on the Eusoffe Chin-Lingam photographs. Although some alleged that Lingam paid for his trip, Eusoffe Chin stated this month that he paid for his holidays.

The people have always had the impression that the judiciary is independent of the Legislature and the Executive (the Government). The famous photographs have confounded the public. Hence, the DAP National Chairman Lim Kit Siang has proposed a Royal Commission of Enquiry on the matter.

That the Cabinet has extended the tenure of the Chief Justice for another six months starting from today has aroused much anxiety. The six moths will pass quickly. But, the conundrum of the independence of the judiciary remains.
