Gerald Niles has been incarcerated in 20 different Florida prisons since 1991. He has a reputation as a Writ Writer, and has suffered violence and abuse by staff as a result of his litigation, including beatings, innumerable bogus DRs, 2 shank setups, lots of time in confinement including a total of 18 months in two terms of Close Management Confinement.
U.S.Constitution Amendment VIII
Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.Niles was recently let out of the hole when Tallahassee overrode the prison in ending his year long confinement for the false shank setup.
U.S.C. Title 42 Section 1997d. Prohibition of retaliation No person reporting conditions which may constitute a violation under this subchapter shall be subjected to retaliation in any manner for so reporting.
Washington CI Targeting Writ-Writers
Writ Writer, Greg Nelson has been moved Taylor but is grieving past treatment at Washington CI. His access to the law library was cut off. He has 3 pro se lawsuits pending litigation. He's been held in C.M. "...for no reason for 4 years. "
The U.S. Supreme Court states in Hutto, ibid. (note 8) that "The court holds that the policy of sentencing inmates to indeterminate periods of confinement in punitive isolation is unreasonable and unconstitutional......and makes bad men worse. It must be changed."
The patterns of retaliation, particularly on prisoners whose prior charges include any resistance or aggression to enforcement in uniform, has convinced me that the ongoing harassment and abuse he's suffered at the hands of errant guards is a result of his charge of battery on a correctional officer.
On 5-31-00 Nelson wrote about the terrible conditions he was forced to live in.
"We've [Nelson and Ray Von Boatman] been assaulted and have proof and many witnesses. I need to be transferred or obtain a restraining order against these officers."
The two of them have been retaliated against in a variety of ways. Nelson was threatened, poisoned, refused a shower, left with no clothes whatsoever, spit put in his food trays, all the above done by staff, "Sgt. Ferrell, Sgt. Shaw, Officers Brannon, Kirkland, G. Brown, Knight, Shoe-mocker, and Winfro." He reports a beating by Sgt. Sample and other officers. He states that Inmate Ray Von Boatman, DC# 089151 has been beaten also [See Case 5 - FSP]. He also states Ms. C. Holley is destroying his incoming and outgoing personal mail as punishment for filing hundreds of grievances.

{N}or shall private property be taken for public use, without just compensation.Nelson has an excessive use of force lawsuit pending, an access to court lawsuit pending against Washington CI. and a class action suit covering a number of vital issues involving Washington CI.
He also has a writ of mandamus pending concerning Washington CI for not abiding by the DOC's own rules.
Nelson asked for protective management and was told "It's not available."

It appears the inmates should have gone to administrative confinement, so an "investigation" could take place, as this rule is found under "Administrative Confinement" F.A.C.33-602.2201
