Given a rifle told to guard said Armory, one hour latter rifle confiscated given a broom.

Compairing my next six months to this broom, the following events took place which I built into my

own personal code of conduct up to and including my 77th birthday 10-3-2000.

August 1942 went to work for the firm of Gladding McBean, work consisted of carpenter maintenance, fixing doors, windows, screens and repair all of the rolling stock, and all of the wooden pallets. Did this at two of the plants. And was told if an accident happened would have to help clean the furnaces all had to do this as one to keep the quota up.

December 11-1942, Went into the Army Active Service, Was Honorably Discharged November 21st

1946 = 1 year Credit given by the Carpenters Southern California Pension Trust Fund Plan, because of these RELATED TRADES who were our employers made us sign to have money taken out of our pay checks before we received our pay checks and paid to these Union Related Trades of the Carpenters.

In Southern California. Also this time frame Carpenters 1958 back received Non-Union Pension PAST SERVICE CREDIT CARPENTERS SOUTHERN CALIFORNA. Paid ME, ELVIN F. SCOTT, and Others as PARTICIPANT'S PENSION CREDITS FOR THESE TIME FRAMES 1959 BACK.

1947 = 1 quarter Credit Pension keep in mine same rules as for pension credits year 1946, denied Pension Credits for Union Non-Union and Related Trades of the Carpenters, by theTrust saying records destroyed by fire, Mr. Heil, head of the District Council of the Carpenters admitted that they did collect monies from our employers in these time frames, FOR OUR UNION DUES. Keep in mine changed MY PENSION CREDITS TIME AFTER TIME the PAST also FUTURE YEARS.

1958 = 2 Quarters Same as above.

Years 1949, a big 0 for pension credits Carpenters Southern California for Elvin F. Scott , who was In the Carpenters Union Southern California and was suspended May 1949, Non-Union from this date to July 1953.

Mr. Carroll: The issue, I believe, is properly state in the summary, Mr. Chairman, namely, whether Mr. Scott is entitled to pension credit during the years 1949 to 1953 based on his work in the South Seas for Vinnell Construction Company, given the fact that, of course, that work was performed outside the jurisdiction of the 11 Southern California counties. And if you feel that he's not entitled to that, then the appropriate motion would be to deny the appeal. Of course, otherwise you would grant it. The Chairman: Is there a motion? LOPEZ: THE PLAN CLEARLY STATES THAT PAST SERVICE CREDIT IS PROVIDED FOR CONSTRUCTION WORK IN THE JURISDICTION OF THE PLAN OF THE 11 SOUTHERN COUNTIES, AND THE ADMINISTRATIVE OFFICE HAS FOLLOWED THAT CRITERION AND NOT GRANTED PAST SERVICE TIME FOR WORK PERFORMED OUTSIDE THE 11 SOUTHERN COUNTIES.

The Chairman: Mr. Noneman, didn't you refer to a specific paragraph in the plan? Mr. Noneman: Yes. That's contained in Article V1, Section 1 (a ) of the pension plan, Mr. Chairman: Is that perfectly clear in that regard? Mr. Noneman: Yes, I believe so. Mr. Chairman: Does that answer your question? In as much as there is additional evidence to place before all concerned in year 2000, there is a substantial question regarding the disallowance of pension credits for my overseas employment in the years 1949-1953. Additional documentation has been gathered and additional testimony from others regarding the nature of my employment have come to my attention that will shed some day light on years 1947, 1948, 1954, 1955, 1956, 1957 and 1958 past service time. Future Service time from year 1959 through year 1984. In fact for every year denied me by any one. I Mr. El vin F. Scott, ask that under formal direct examination, as well as the additional documentation I have received since my last hearing be placed on a agenda to be conducted by a court or courts not only for me, but all the others that come under these same problem or problems. The Chairman: We have addressed ourselves to that, I believe, C. V., in fact that there is no evidence that shows that Aggas paid him during those years. He may have been employed by Aggas and farmed out to various other places. Mr. Holder: All right, I'll Second it. Mr. Heil: I think further, Mr. Chairman, that it should be noted probably for the record That in the affidavits that were presented by various people in regards to the times and periods that he worked there's quite a bit of conflict in those affidavits that are presented by those persons and notarized that do not really bear out the true facts, as I see it, in this case. I Hereby swear and affirm that the following are factual: Elvin Scott was a member of Carpenters Local Union in 1966. As a member of local 1062 he was dispatched to Walter Scholtz Construction Company on March 28, 1966. This is indicated by a work referral signed by Robert Flett a Business Representative of Local Union 1062. Also Elvin Scott was dispatched for the second time by Robert Flett on a work referral dated April 5, 1966. The project was known as University Village on Stork Road, Goleta, Ca. This not allowed.

As a Business Representative of Local 1062, Santa Barbara, Ca, in February 1966, I Elmer W. Kirkwood dispatched member and/or members of the Brotherhood, to Walter Scholtz Construction Company. The project was known as University Village on Stork Road in Goleta, CA. I signed work referrals for the following Brotherhood members. "7 members" not allowed. As a Business Representative of Local Union 1062, in April 1966, I hereby attest that on April 10, 1966, Elvin Scott was dispatched as a STEWARD to the Margate Construction Company. Job site also known as San Roque Filtration Plant. A work referral dated April 10, 1966, to job site for Margate Construction Company, La Vista Road, San Roque area of Santa Barbara, CA makes this, and the above a matter of Record. It was not the obligation of the Local union at that time, to collect delinquent funds due the trust funds. At that time, in question, the trust paid Deviloux and Cox, for the collection of delinquencies due the trust. NOT Allowed TO BE PUT ON THE RECORD AT MY APPEALS HEARING. Honorably submitted, Elmer W. Mr. Kenny Scott, FINANCIAL SECRETARY of Carpenters Union 25, in Los Angeles California who said, " He was told and ordered not to help any of the Participant's and/or members to bring up their CARPENTER'S UNION PAST SERVICE TIME, to use any means including stalling lying ETC. He said this at Union meetings, in his OFFICE and in private to me, and others who were present this was to do the carpenter's period out of their pensions and fringes for their (SERVICE PENSIONS). CONSPERIES: Out of 5 people who were going to testify including three who were Financial Secretaries one Business Agent one member of the Brotherhood and one Financial Secretary who told me, they would see to it that no one would show up. Not to tell them his name. TWO WERE ORDERED NOT TO APPEAR THEY TOLD ME, THEY WERE ORDERED TO A MEETING PERIOD, ONE NO MORE HELP, ONE WHO HELPED ME, BY GIVING (ME), UNDER THE TABLE FACTS EVIDENCE AND THE Knowledge BY PASSING ME OUT SOME OF THE MATERIAL FROM THE UNION AND THE TRUST, AND ANOTHER WHO HELP BY GIVING ME MORE INFORMATION OVER THE YEARS AS HE INFORMED ME MR. LOPEZ , INFORMED HIM NOT TO HELP ME , ONE WHO SAID WITH ALL OF THESE PEOPLE GOING TO YOUR APPEALS HEARING YOU DON'T NEED ME.. This was not enough the (TRUSTEES) added 5 years on to the CARPENTER'S in the STATE OF CALIFORNIA 30 years. Between SOUTHERN & NORTHERN CA, SO MUCH THE BETTER. THEY BOTH WOULD PENALIZED YOU. Carpenter Trust's in the State of California did not notify the participants in writing or by any means of these changes. On your SERVICE PENSIONS. NO WAY YOU COULD HAVE YOUR BENEFITS WORK IN YOUR BEHALF. I never received any of this information in writing until after the fact. EXAMPLES: IN BOTH SOUTHERN AND NORTHERN CALIFORNIA UNION OFFICERS AND OFFICIALS AND OTHERS WHO WERE SECRETARIES OF DIFFERENT UNIONS SAID, " THEY HAD KNOWLEDGE OF THE OPTION SOUTHERN & NORTHERN CARPENTER PENSION AND HEALTH AND WEFARE TRUST FUND PLANS ALL THROUGH THE STATE OF CALIFORNIA WERE ALSO INCLUDING ALL FRINGES" THESE TRUSTEES, WHO MADE THESE NEW RULES AND EXCEPTIONS FOR THESE FIRMS OR EMPLOYERS TO PROTECT THEIR EMPLOYEES IN THE DIFFERENT GEOGRAPHICAL AREA OR AREAS AND THE DIFFERENT JURISDICITIONS FOR THEIR SERVICE PENSIONS 25 YEARS AND YOU ARE OUT FULL BENEFITS. THIS WAS AND IS A CONSPIRACY TO KEEP THE CARPENTERS IN THE STATE OF CALIFORNIA FROM RETIRING IN 25 YEARS AND OUT. ALSO IN THESE TIME FRAMES THE CARPENTERS HAD BY-LAWS BOOKS AND IN THIS ONE GIVEN OUT BY OUR CARPENTER LOCAL UNION 1062, TO ITS MEMBERS IT STATED ALL MONEY WILL BE THERE FOR YOUR BENEFITS IF YOU HAD BROUGHT TO THE ATTENTION OF YOUR UNION THAT MONEY HAD NOT BEEN PUT INTO YOUR BENEFITS IN THIS TIME FRAME. I , OTHERS BROUGHT ATTENSION TO THE FACT EMPLOYER AFTER EMPLOYER HAD NOT PAID INTO OUR UNION BENEFITS IN THIS REQUIRED TIME (FRAME), STATED IN THIS CARPENTERS BY-LAWS BOOK. EXAMPLES: !960, 1964, Allied Construction and Associates 8-8--60-8-15-60-8-22-60-8-29-60 & 9-6-60-9-12-60-9-19-60, I brought up that Allied was not paid me, for three weeks and was not paying our benefits, I was sent out by my Carpenters Local Union 1062, as acting Steward and they paid me, and all others their Vacation money for year 1960. Year 1964 they also paid me my vacation money as it shows on my Carpenters Health and Welfare. Carpenter's Trust allows me no Pension Credit for these two years Interesting for year 1964 Allied Carpenters Local Union had me, an about 12 others pulled in to the District Attorneys office because Allied was using oil on their nails. This gave me, and others of Local Carpenters 1062 members more work. For Example: This is what is on the 11 County Carpenters' Vacation Plan now these other years are on this same Vacation Carpenters Plan in Southern California, as all of my Employers are on each and every year that they claim my benefits were not paid in. I have copies of most of these Vacation Plans from year 1962 forward.

EQUAL BENEFITS FOR RETIRES OCTOBER AARP BULLETIN Therefore many employers have reduced or eliminated retiree health care benefits at age 65, when Medicaid eligibility kicks in now if the ruling stands, employers could be faced with choice of increasing benefits for older retirees, slashing them for younger retirees or terminating them for all retirees.
