It is true that society has a right, and properly so, to expect, that the judges of our district and higher courts shall set the standards, create the atmosphere, and with fairness, decency, dignity, and in good faith, uphold the oath of their official office; the laws of the State of Texas, and the Constitution. During the past 4-years my fate (and that of my children who are dependent upon me) has rested in the hands of several Dallas County District judges. Many of these judges have made some unethical, discriminatory, capacious and questionable rulings during the course of the proceedings in the cases pending against me. Carter Thompson, a 54-year-old Democrat from Irving, didn't make a compelling case for his candidacy during our interview. But he has almost three decades of legal experience, most of it as a criminal defense attorney in private practice. We are hopeful that he will rise to the challenge, so we offer a qualified recommendation for Mr. Thompson.

September 20, 2007 general meeting - Our speakers were Hon. Martin Hoffman, Judge, 68th Civil District Court, and Hon. Carter Thompson, Judge, 5th Criminal District Court. Both gentlemen were elected to their benches in November 2006. They discussed the progress Democrats have made in Dallas County, both in terms of getting elected and in terms of making a positive difference once elected."   We also talked about how best to use the November and January meetings, since the March Primary falls before our March meeting.

The only reason the Thomas Miller-El case ("Trial by Fire," by Matt Pulle, November 30) Manny Alvarez claims to be so worried about has to be tried a third time is because the Dallas Republican judges (and district attorney) kept refusing to do what the U.S. Supreme Court told them they had to. As a direct result of the incompetence of Dallas judges and prosecutors who ran and won on the GOP ticket (and who refused to stop "shuffling the juror list" until they'd removed all the black potential jurors), the Miller-El case has been around since '85.

Estimates are the typical capital murder case with appeals costs taxpayers from $3 to $5 million. Miller-El has already had a couple of  'em. We paid for them. The Dallas District Attorney's Office is where soon-to-be-former Judge Manny Alvarez learned all he knows about criminal law. That's the same office that has now screwed up the Miller-El case multiple times, so badly the U.S. Supreme Court, not known for liberal rulings, had to overturn it twice. The Dallas Morning News, the house organ for the GOP, agreed Democrat Carter Thompson was a better choice for voters.

Like almost all the Dallas GOP criminal district judges, Manny was first appointed by a Republican governor while he worked in the District Attorney's Office, then ran as part of the GOP ticket that he thought forever guaranteed him re-election. Manny has never defended a traffic ticket, much less a felony. Why don't you check back with him in a year or so—see how many major murder cases he's successfully defended now that he's finally, for the first time in his legal career, off the public dole and has to go find a real job practicing criminal law and make a living.

Incoming Judge Carter Thompson made legal history in '84 by trying the first successful "battered spouse" murder case in Texas. The Dallas County jurors agreed with the defense he offered. It's been used as a model in Texas and the rest of the nation since then.

5 gay candidates enter Dallas County Democratic primary

A total of 113 candidates are on the ballot for the March 7 Democratic Primary in Texas. Of those, 15 are members of Stonewall Democrats of Dallas, and five of those are gay men, according to Michael Moon, Stonewall president.

"We have a full slate this year, with candidates running at every level, from governor to U.S. senator to constable," said Jesse Garcia, communications director for Stonewall. "We're very happy with the enthusiasm of our local Democratic Party."

Moon said the number of candidates is an important sign that the Democratic Party in Dallas County is gaining ground in a county that has long been a Republican bastion.

"The past two years, the legislature has been called and recalled into sessions and special sessions. They did the worst job ever this last session," Moon said. "Instead of doing something about school financing and tax reform, they spent all their time worrying about cheerleaders and gays. There are lots of folks who are very upset. They created the most negative feelings toward the Legislature in years, and that is beneficial to the Democrats."

Moon said that frustration with the Republican-controlled Legislature means that Democratic candidates running in areas traditionally controlled by Republicans have "a real chance this time."

Gay Stonewall members on the ballot include Andy Smith running for the Texas House in District 107, Jack Borden and Tom Malin facing off for the Democratic nomination in District 108, Jim Foster running for Dallas County Judge and incumbent Mike Dupree running for re-election as constable in Precinct 5.

The other 10 Stonewall members on the ballot are state Representative Rafael Anchia, running for re-election for House District 103; Katy Hubener running for House District 106; Carlos Cortez, running for district judge in the 44th Civil Court; Emily Tobolowsky, running for district judge in the 298th Civil Court; Carter Thompson, running for district judge in the 5th Criminal District Court; Larry Jarrett, running for criminal district attorney; Teresa Tolle, running for judge in County Criminal Court No. 4; Alan Barr, running for judge in County Criminal Court No. 6; Peggy Hoffman, running for judge in County Criminal Court No. 9; and Scott Chase, running for Dallas County Commissioners Court in District 4.

Moon said he was particularly pleased to see so many Democrats running for judicial seats, especially those that are Stonewall members, because he believes them on the bench would better, more fair treatment for GLBT individuals in the courts.

Stonewall Democrats holds its candidate screening session on Saturday and Sunday, from noon to 6 p.m. After the screenings close on Sunday, Stonewall members will vote on endorsements for the primary.

In June 2007, the Honorable Judge Carter Thompson, who is currently presiding over Sharif's felony charges, rescinded all the conditions and restrictions initially imposed on Sharif in Feb. 2007 (see link below for that story)when the judge released Sharif from jail on a personal recognizance bond after he had spent 16 1/2 months in jail awaiting trial on his pending charges. Sharif's was entitled to release according to Texas law and the U.S. Constitution which guarantees everyone the right to a speedy trial. Texas Code of Criminal Procedure, chpt. 17 art. 17.151 requires that a defendant must be released either on personal bond or by reducing the amount of bail required, if the state is not ready for trial within a set time frame following the defendant's detention. The former judge Manny Alvarez who presided over Sharif's felony charges (before losing his re-election bid to Hon. Judge Thompson) chose to ignore and thus violate the law and Constitution by refusing to grant Sharif's many request for release on bail. This mentality perpetuates an all too familar abuse of power by judges that we are witnessing more and more of nationwide. It is a known fact that had the prosecutions'cases been based on something more then the mendacious allegations of Ms. Hawkins and sloppy investigations by police and the D.A.'s office Sharif would of long ago been cleared of these bogus charges and freed without the need for a trial. Sharif is INNOCENT"and has never posed a threat to anyone, including the alleged victim/witness Cathy Jonette Hawkins him.  Hopefully come April 21, 2008, this miscarriage of justice will end now that upholding the Constitution and the laws of this state are what the presiding judge seems most concerned with. https://www.angelfire.com/crazy4/texas/lawbreakslaw.html
