Unclaimed or Lost Property Information:

The first frequently asked question from anyone dealing with this issue is, "What is abandoned or unclaimed or lost property?" While state laws vary in periods of the dormancy (inactivity), a wide range of reportable property includes dormant checking and savings accounts, uncashed money orders, cashier checks, unclaimed insurance benefits, mineral royalty payments, safe deposit box contents, unused gift certificates, unclaimed security deposits, cash dividends, stock, court deposits, and utility deposits.

The second question frequently asked is, "Once property is identified as unclaimed, where or in what state is it held?" An important U.S. Supreme Court decision, Texas vs. New Jersey, 379 U.S. 674 (1965), provides a guideline in reporting unclaimed property. Briefly summarizing, unclaimed property is to be returned to the state of the property owner's last known address. If there is no owner's address associated with the property, then it should be returned to the state in which the business remitting the funds is incorporated.

National Association Unclaimed Property Administrators (NAUPA) member states regularly exchange property and related information. Numerous states are able to accept automated reports with owner information on a diskette or magnetic tape. Through reciprocity and streamlined reporting, assets are properly reported and placed in the custody of the state of the owner's last known address.

Who May Claim:

All NAUPA members have procedures and forms to use when claiming unclaimed property and nearly all states maintain the unclaimed asset as custodian forever.

The processing time for claiming an asset may vary, however, states attempt to expedite claims in a timely manner when sufficient ownership documentation is provided. Often a claim requires a review and approval by more than one agency, or payment is issued by an agency which is not associated with the program administration. We offer assistance to eliminate unnecessary delays in documentation requests and payment of the unclaimed asset, such as.

(1) Ensuring that supporting proof of ownership is filed with the claim;

(2) Ensuring there is sufficient information available to verify property ownership;

However there are some things we just can't help with, such as:

(1)Some states issue an annual listing of all owners of unclaimed property which causes an influx of claim-related inquiries and processing requirements;

(2)Additionally, states have reporting deadlines for businesses to follow when remitting unclaimed assets. These peak periods of reporting and owner notification can have an impact on the time frame needed to process a claim for approval.
