Puppy Contract

Seller and Buyer agree to the following purchase terms and conditions:

Show puppies are Co-owned until AKC Champion Titled

1.Puppy’s registered name shall be Chienbrun’s name as both parties will agree on.

2. Health guarantee: Seller guarantees that the puppy is of good health at the time of pickup/delivery, and has been wormed and immunized as appropriate for its age. Seller will supply a record of vaccinations and wormings to Buyer. This health guarantee is in effect for a 72 hour period, during which time the puppy should be examined by a licensed veterinarian at Buyer’s expense. If for any reason Buyer is not satisfied with the puppy’s health during this time, the puppy may be returned (within 72 hours of the vet’s visit) for a full refund or replacement with another Chienbrun puppy (if and when one of suitable quality is available), provided the puppy has not been injured in any way.

3. Buyer agrees that the puppy throughout its life: will be provided with adequate opportunity and room for exercise, protection from the elements, predators, automobiles and other hazards; will not be permitted to run at large habitually; will receive regular care from a licensed veterinarian, including Heartworm preventative. Heartguard (Ivermectin based) will NOT be used at any time during its life, due to possible complications. Puppy will be kept free of parasites such as fleas and worms; will receive a quality food, (not generic) and fresh water. Puppy and will have its coat kept clean, and in well-groomed condition and toe nails done regularly. Buyer agrees to keep the puppy throughout its life as a house pet, in that it will spend a significant portion of the day in the house with its person/people. Buyer agrees that the puppy will not be crated for long periods of time (over 6 hours) on a regular basis since this can cause physical and mental problems and otherwise be detrimental to the puppy, and that the puppy will not be kept on a tie-out chain or line since this can promote aggression and otherwise be detrimental to the puppy, nor will puppy be trained by a shock or electric type collar. Buyer agrees that the puppy will never be transported loose or tied in the back of a pickup truck.

4. Buyer agrees to register the puppy in the AKC or appropriate registry (application will be furnished by Seller) within one month of assuming ownership of the puppy. Buyer shall send to Seller a photocopy of the puppy’s registration papers within one month of receipt of the papers from the registry. This puppy’s registered name shall be assigned by breeder with some assistance of Buyer at time of purchase and will be assigned a name with beginning letter __, as stated in previous paragraph 1.

5. Buyer agrees to socialize the puppy through exposure to people, other dogs and new environments in order to ensure confidence and steady temperament until the puppy is at least 18 months old. However, the puppy should not be taken to public places such as dog parks, where the risk of contracting disease is high, until after immunizations are complete. Seller guarantees that, with adequate socialization the puppy will be of sound temperament in that it will be neither so shy nor so vicious as to render it an unfit companion. If, in spite of adequate socialization by Buyer, and reasonable proof thereof, the puppy remains excessively shy or aggressive at two years of age or older, Seller will replace with another Chienbrun puppy when available.

6. Buyer agrees to enroll the puppy in puppy socializing class, conformation or entry level obedience class within 4 weeks of receiving final puppy vaccinations and/or taking possession of the dog, and to attend obedience classes through novice level and/or conformation classes/practice. Seller will assist Buyer in finding training classes and training clubs as needed.

7. Buyer agrees that after completing novice level obedience classes, he/she will choose a performance activity to do with the dog, such as competition obedience, agility, herding, or tracking,(within 3 years) or will make every effort to do some activity on a regular basis once the puppy is old enough to do so. With ANY AKC performance title a $50 award will be given to buyers as an incentive to attain a title.

8. Buyer agrees to join the American Belgian Tervuren Club (ABTC) national breed club (application and sponsorship signatures will be furnished by Seller) and to maintain membership throughout the life of the dog.

9. Buyer agrees to keep Seller informed as to progress, accomplishments, and problems of the dog. Seller will provide support and advice to Buyer throughout the life of the dog. In the event that any of Buyer’s contact information changes (address, phone, email, fax), Buyer promptly shall inform Seller of such change.

10. a) Show puppy: Buyer agrees to show puppy in AKC Conformation shows until acquiring an AKC Championship title. Purchaser may enter UKC shows and any working type trials they become interested in. Breeder agrees to assist at any shows that are local or within a 3 hour drive if breeder will be at same show sight. Puppy must first obtain it’s championship title prior to any breeding, and “stud dog” shall have approval of Nancy A. Vida/breeder.

b) Pet puppy: All pet puppies will be spayed/neutered between the ages of 6-9 months. Any puppies resulting in breeding of pet puppies are not eligible for registration. A fee of $1,500 per puppy will be owed to Nancy A. Vida if there is a litter produced of Hybrid puppies. Pet puppies will be required to do puppy socialization class and 1 obedience class by a professional or a local dog training club.

11. Buyer agrees to obtain all of the health clearances specified below and to send photocopies of registry certification(s) to Seller promptly upon receipt of the certification(s) a. screening of eyes at age 6-12 months, to be repeated annually or no less than every 2 years thereafter until the age of 10, with results submitted to CERF (copies of original ophthalmologist’s report as well as CERF registry certification to be provided to Seller).

b. screening of hips and elbows at age 2 and no later than age 2 1/2, with results submitted to OFA (copies of certifications to be provided to Seller); Seller will assist in finding a veterinarian to do x-rays without anesthesia if preferred. This will help breeder to affirm that her breeding program is producing passing OFA’s.*Buyer may choose to notify breeder via email that paperwork has been sent in to AKC or CERF, and breeder will affirm with AKC.

12. Seller guarantees the dog to be free of the following hereditary diseases:
a. hip or elbow dysplaysia until the age of 2 years, such that there is a clinical effect upon the dog in that its condition would greatly affect its lifespan, cause severe pain and/or disability, and/or cause death or require euthanasia as recommended by a veterinarian.
b. congenital eye disease until the age of 3 years, such that the dog develops a progressive, vision affecting problem, excepting late onset cataracts due to natural aging.
c. primary epilepsy until the age of 4 years, such that seizures occur regularly without an obvious, non-inheritable secondary cause, such as severe trauma, illness or poisoning. Buyer has been made aware of the possibility of a dog having seizures due to the insecticides/ weed killers that are used in some subdivisions by homeowners.

13. Seller agrees to offer a replacement Chienbrun puppy when available, if the dog develops any of the above hereditary diseases as described in paragraph 13. Euthanasia is ONLY acceptable in cases of severe illness and may NOT be performed without the written consent of Seller.

14. Ownership of the dog may not be transferred without the permission of Seller. If for any reason other than the conditions previously stated in this contract, Buyer cannot or chooses not to keep the dog, Buyer, or a representative of Buyer, must return the dog and its registration papers to Seller at Buyer’s expense. If Buyer or Buyer’s representative returns the puppy to Seller, neither Buyer nor Buyer’s representative, heirs or assignees shall be entitled to any refund money. The dog cannot be inherited except by permission of Seller, which would be given after Seller is satisfied that the heirs would provide adequate love and care.

15. Definitions: “Adequate,” “protection,” “habitually,” “generally accepted.” “significant,” “excessively,” “regular,” “well-groomed,” and “sufficient,” as used in this contract, shall be defined by the judgment of Seller, based on Seller’s standard of care for her dogs. The terms “puppy” and “dog” are synonymous in this document. Except where specified, the term “puppy” does not denote a particular life stage of the puppy/dog.

16. If Buyer is unable or unwilling to meet any or all of the conditions of this agreement, Seller reserves the right to reclaim the dog and its registration papers, with no refund or replacement puppy due to Buyer. Failure to observe time limitations voids any obligations of Seller under this agreement and Buyer shall have no other rights or options. Any legal proceedings shall be carried out in Seller’s own state and county.

17. This agreement shall be effective upon the signature of both Buyer and Seller.
