1.This statement made by me accurately sets out the evidence which I would be prepared, if necessary, to give in court as a witness. The statement is true to the best of my knowledge and belief and I make it knowing that, if it is tendered in evidence, I shall be liable to prosecution if I have wilfully stated anything which I know to be false or do not believe to be true.
2.I am 26 years of age.
3.On Friday the 6th November 2002 about 10:10am I was walking towards the post office in Hurstville, I was on McMahon Street. I saw two males who looked to me as though they were wrestling. They were standing by an open car that was parked in the car park in Patrick Street. I would describe the first male to be of Asian appearance about 5.2 tall, medium build wearing a white shirt and shorts. The second male was of Caucasian appearance about 5.7 tall, solid build with short dark hair. He also had tattoos, I think his arms, I can’t really remember. The second male was quite hard to see as he was shielded by the open car door.
4.As I got closer to both males, I saw the second male hit the Asian male. I would say the Asian male got hit 3 or 4 times with a closed fist to the upper body area and face. I also saw the second male try to bite the Asian male. Throughout the whole incident I did not see the Asian male strike the second male, all he did was attempt to block the blows that were coming at him. I would have been about 10 feet away from the males at the time. Because I saw the second male attempting to bite the Asian male I did not want get to close. I said, "Stop". The second male did say something back to me but I don’t know what it was. I do however know that he was Australian because of his accent.
5.The Asian male then asked me repeatedly to contact the Police, but because I am from overseas I did not know the number for the emergency services from my mobile phone. At this point the second male reached into his car and pulled out a mobile phone and threw it I would say about 25 yards across the car park. I said, "Get in your car" to the second Male and "walk away" to the Asian man. The second male got into his vehicle and drove away but before he left I got his registration details and put them in my mobile phone. His registration was NVK780 it was an old car, I can’t really describe it any further, as I am unfamiliar with car models in Australia. A female then approached and stated that she witnessed the whole incident and advised that the police be contacted. I believe that she gave her contact details to the Asian male.
6.The Asian male then contacted the Police, but I ended up talking as he was pretty shaken up and he has only limited English. The Asian male was at this stage bleeding from his mouth area, he also had some redness, scratching around his chin area, it also appeared that a few of his teeth were chipped as a result of the assault. I later discovered that it was actually the Asian males mobile phone that was thrown across the car park.
7. A short time later an Ambulance arrived and treated the Asian male, Police were also in attendance. I attended Hurstville Police Station to make a statement about the incident.
