conditions described below. Monarch makes no warranties or representations
other than those expressly set forth in this agreement. The buyer will initial
each item to signify they understand and accept each term and
condition.

Monarch
agrees to sell you the above named cat for the sum of $______. Buyer
agrees to provide carrier and shipping charges if required._______

Monarch
will furnish full and accurate pedigree information on the cat being purchased
and appropriate paperwork for registration. Immunization records will be
provided by Monarch._______
RESTRICTIONS OF
·
Cats
sold as pets must be spayed or neutered by a licensed veterinarian no later
then when the cat reaches seven months of age. Registration information for
pets will be held until documentation of spay or
neuter is received from the buyers licensed veterinarian. Buyer assures and
guarantees that this kitten/cat will not be used for breeding or stud._______

Under no
circumstances will this cat be sold, leased or given away to any pet shop,
research laboratory, humane society or similar facility. This cat is to be
maintained within the household of the buyer and not be loaned, leased, gifted,
traded or resold at any time without written permission in advance from breeder/seller.
Should buyer not be able to keep this animal for any reason, including the
incapacitation or death of the buyer, it is to be returned to breeder/seller
for placement without refund of any kind, unless the above written permission
to transfer ownership is obtained. If such permission is given, new owner must
sign a new contract, identical or similar to this one, with breeder/seller.
Buyer agrees to tell family members about this clause._______
HEALTH AND MAINTENANCE:

You are
strongly urged to follow all care instructions provided to you by Monarch
Cattery for your new kitten/cat. All expenses relating to the cat of whatever
kind or nature are your sole responsibility after the kitten/cat leaves Monarch's
possession._______
·
Kitten/cat
will not be allowed to roam outdoors. Buyer agrees to keep the kitten/cat
indoors in a clean and pleasant environment, uncaged
and with proper nutrition, health care, toys, and companionship._______
·
Kitten/cat
may NOT be declawed. Buyer understands that declawing is a mutilation involving the amputation of a
large portion of the kitten/cat's toes and which is likely to alter the
kitten/cat's temperament and health._______
·
Kitten/cat
is to be given proper medical care including proper vaccinations on a schedule
determined to be proper by a certified veterinarian. All inoculations are
current as of this date. _______
·
Kitten/cat
should receive proper food and have fresh water available at all times. _______
· If at any time this kitten/cat is found to
be neglected and/or mistreated, Monarch reserves the legal right to remove the
animal from the premises and the buyer will surrender said animal and
appropriate papers to the seller unconditionally and without compensation or
refund. Neglect shall include, but is not limited to: being left alone without
human companionship for periods in excess of 72 hours; lack of proper sanitary
facilities; being caged; poor diet; poor health, and otherwise poor condition.
Mistreatment shall include, but is not limited to: lack of proper food, lack of
water, and physical abuse._______
RIGHT OF REFUSAL:
· Monarch strives to provide a healthy cat free of
disease and parasites. Buyer has 72 hours (or three business days) from time of
receiving the cat to have their licensed veterinarian examine the cat. Buyer
has 72 hours to return the cat at their expense if verified to not be healthy.
Written documentation from a licensed veterinarian describing the health
problem must accompany the cat. Failure to have the cat examined within 72
hours of purchase will void this contract. Cats must be isolated from all other
animals during this period. Failure to isolate during this
72 hours will void return policy. If you return the cat within the 72 hour
period in compliance with the conditions set forth above, Monarch will refund
the purchase price of the cat or replace the cat with one of equal value. If no
replacement is available at the time of return, breeder/seller will have six
months to furnish a comparable kitten/cat. All sales are final and
non-refundable 72 hours after the receipt of the cat by you, unless I have been
notified in writing by you of your intent to return prior to the expiration of
the 72 hours._______

After
the initial 72 hour (three business day) warranty period and up to one year, Monarch
will replace the kitten/cat if the kitten/cat dies from a condition associated
with a hereditary or congenital defect or succumb to a fatal illness directly
attributable to Monarch Cattery. A replacement will be made of a cat of
comparable quality and value, as available, at the discretion of Seller. NO
CASH REFUNDS. Proof of said condition must be evidenced by an autopsy report
done by a board-certified pathologist only. Costs to be borne
by buyer. No health guarantee will be honored if this animal dies of a
virus from contact with another cat/kitten not bred at this cattery. It is up
to the buyer to provide burden of proof at the buyer's expense._______
· If the cat needs to be returned for other
than cat related health problems, a fifty percent refund of the purchase price
will be returned to the buyer if the cat is returned within 30 days at the
buyer's expense. This includes any human allergies or pet conflicts that may
arise._______

Failure
to honor any part of this contract shall result in the penalty of not less than
one thousand dollars, payable to seller Nancy A. Cannon as breeder/seller of
said kitten/cat. All legal fees and court costs necessary to enforce this
contract will be the obligation of the buyers including all of those incurred
by the seller. Should any part of this contract be found to be illegal or
invalid or unenforceable in a court of law in the State of (state),
· In
as much as the below signed buyer/buyers have read and understood the terms and
restrictions of the sale and understand that this contract is a legal and
binding agreement, a legal document, enforceable within the confines of this
United States of America and that the costs incurred in inter-state litigation
by the seller are within the accepted responsibilities of the buyer, this
contract is a legal and effectual and enforceable document within and by all of
the boundaries of this United States and Canada._______

Purchase price of ________ includes registration papers (to be provided
when proof of altering received by breeder/seller), pedigree, health record,
and kitten/cat and is payable at time of sale and contract signing and is not
negotiable at a later time and is not refundable after the initial 72 hour
(three business day) trial period except as stated above. Kitten/cat is
purchased as a pet to be altered. Any amendments to this contract after the
date of signing must be obtained in writing from the breeder/seller._______
