A booking fee of $__50.00_______of the above fee is payable with this contract and the balance of $_________will be paid upon the mare being pronounced "safe in foal". The booking fee is non-refundable. The Stallion Owner or Stallion Manager, requires 48 hours advance notice when the Mare Owner wishes to remove his mare(s) from the farm. If free mare care does not apply please check here____. Mare care will accrue from the date of mares arrival at the rate of $_________per day dry or wet Mare. The States of Washington,Idaho, Montana and Oregon requires a current negative Coggins test, and health certification on mares coming from outside the state. The Mare Owner shall agree that each mare offered for breeding shall be in sound breeding condition and free from infection or disease. Any mare certified by the attending Veterinarian not to be, in his opinion, in sound breeding condition shall not be bred. A Mare Owner may not substitute another mare within that breeding season unless specifically approved and entered into in writing by both mare owner and stallion owner or manager. The Stallion Owner and/or manager, agrees to diligently try and settle the above named mare and shall have sole discretion of determining the best method of breeding such mare. If, however, the mare does not settle, the Stallion Owner and/or manager shall be held harmless. There will be no guarantee of a live foal for any mare leaving the Stallion Owner/Manager or its mare facilities before being checked "safe in foal" by ultrasound from 18 to 38 days of conception by the attending Veterinarian. Live Foal Guarantee. Live foal means the foal shall stand and nurse. It is understood if the mare proves barren, aborts her foal or if the foal is stillborn, a return season will be guaranteed for the 2003 breeding season only, providing notification is given.

Proper notification shall be defined as follows: written certification by a licensed veterinarian within seven days that the mare has slipped or produced a non-viable foal. Mare Owner certifies that such abortion or death did not result from any act or omission of the Mare Owner subsequent to the mare's departure from High View Ranch, or its mare facilities. The breeding season in force for this contract shall begin March 20, 2002 and close July 1, 2002. It is further agreed that should the above named Stallion die, or become unfit for service, or, If the above named mare dies, during the breeding season then the Mare Owner may request refund of breeding fee's, booking fee is non-refunded.
A breeder's certificate will be issued to Mare Owner after ALL expenses have been paid in full and upon notification of the birth of the foal and visual or photographic proof of foal with mare is provided to
High View Ranch or Charles E. Smith.
Waiver of Liability. It is understood that High View Ranch, its owners, employees, veterinarians, and guests shall not be liable for any injury, escape, disability, or death of any horse on its premises or mare care facilities. The above named Mare Owner, whose horse(s) are under the care of High View Ranch and its mare care facility , will not be liable or responsible for any damage, injury, or death to the breeding farm stallions, employees, veterinarians, or other animals In the care of High View Ranch or mare care facility , whether or not caused by his horse.
This contract is non-assignable and non-transferable. This contract is entered into the State of Washington , and will be interpreted and enforced under the laws of Washington State . If any clause in the contract is against Washington State law, then that clause shall be null and void.
The mare owners signature on this contract attests to the fact that the owner has read and understood all the terms outline herein and accepts this contract as a legal and binding instrument on behalf of the owner, owners heirs, successors and assigns. This contract constitutes the entire agreement between the parties. No other agreements, whether verbal or implied are included. This contract is made and entered into, in the county of Spokane, regardless of the manner of solicitation , and shall be interpreted ,enforced and transacted within said county under the laws of the State of Washington

Stallion Owner, Charles E. Smith assigns No Other person permission to enter into this contract in Stallion Owners place.

RULES FOR STALLION SERVICE

Please Read Carefully!! If you do not understand something please ask us to explain!!
A. The Stud Fee for Make It So is $500. The non refundable Booking Fee of $50.00 is due with the signed STALLION SERVICE CONTRACT and will not be deducted from total stallion fee. Mares should be booked early. A Copy of the MARE'S REGISTRATION PAPERS (both sides) must also be included with the signed Contract along with a completed REPRODUCTIVE HISTORY QUESTIONNAIRE contained in inclosure 1.
B. Grade mares: Booking and breeding fee are the same as above. Reproduction history is not required. HEALTH CERTIFICATE IS REQUIRED PRIOR TO BOOKING GRADE MARES.
C. Balance of Stud Fee, is due before mare is removed from premises along with other fees incurred. High View Ranch/Charles E. Smith, will provide a detailed listing of services given to mare for which additional charges have occurred. MARE WILL NOT BE RELEASED UNTIL ALL FEES AND CHARGES ARE PAID".
D. Live Foal Guarantee: If the Mare does not produce a live foal in 2003, a rebreed will be allowed for the same mare or a substitute mare for the 2004 season only.
