Silver Gardens' understands and complies with confidentiality requirements.
Any health information we maintain about Residents' particular health status is covered by this policy.
This policy statement covers procedures for disclosure, and it describes how we use Resident health information. At Silver Gardens we have internal needs for Resident health information, and, from time to time, we must review it with collateral health care providers. Here are the policies on disclosure:
HIPAA and Confidentiality at Silver Gardens
1. Privacy Practice Act – HIPAA
The Health Insurance Portability and Accountability Act of 1996 (HIPAA) governs confidentiality issues involving Residents and employees. This regulation includes communications and transactions involving Resident and employee Private Health Information (PHI). Penalties and sanctions for violations under HIPAA vary from facility deficiencies or financial penalties to employee imprisonment.
Confidentiality does not mean ignoring someone else's on-the-job illegal, unethical or prohibited conduct. To the contrary, such adverse at-work conduct should be reported to either of Silver Gardens' General Partners. Confidentiality in this setting means employees do not share Resident information, inappropriately obtained, for business or personal purposes with others who have no need for confidential health information.
All Silver Gardens' staff are required to individually sign a STATEMENT OF CONFIDENTIALITY as a prior condition of employment. Any employee who improperly uses or discloses confidential business or personal information (related to Silver Gardens, its Residents and clients, and/or employees) will be subject to disciplinary action up to and including termination of employment and legal action, even if he or she did not actually benefit from the disclosed information
2. Confidentiality Statement
Staff are required to sign the following contractual statement prior to hiring:
As a condition of hiring and employment, I have been formally instructed in maintaining the full confidentiality of all medical and personal information about Residents residing at Assisted Living at Silver Gardens, LLC.
I have been advised, except as needed to conduct daily business, any Residents' medical/personal health information may not be discussed with anyone either inside or outside the residential care home. All medical and personal information is limited to the family members/guardian/responsible agent of the Resident.
Complaints, Contact Person, Effective Date, and Acknowledgement Questions and inquiries are encouraged, in an effort to resolve issues before they become problems. If there are complaints or grievances about potential violations of privacy rights, please make them to the General Partners or to the Secretary of Health and Human Services. While questions and early problem-solving are encouraged, there will be no retaliation for filing a complaint. Complaints may be filed with Silver Gardens by writing to a General Partner. All staff are required to read and sign the following two agreements prior to and as conditions of hiring. These statements represent a limited baseline on the issue of Resident confidentiality. As the organization grows, these policies will elaborate to meet increasingly complex needs.
