Drafted in the Year Four Hundred Forty-Four BE by Grand Vizier Atticus Valdemar
Article. 1.
Section. 1.
The executive Power shall be vested in a Chancellor of the Eternus Ordo Veneficus. He shall serve a life term along with the Grand Vizier he so appoints. The Chancellor is the Guild’s Official Head of State.
The Chancellor comes to power through an ancient chain of command. In Case of the Removal of the Chancellor from Office, or of his Death, Resignation, or Inability to discharge the Powers and Duties of the said Office the Grand Vizier will take the oath and become Chancellor. In Case of multiple governmental figures simultaneous inability to take command of the guild, this chain of command will dictate which official rises to power; Grand Vizier, Chief Magistrate, Commandant, Chief Envoy, Chief Emissary. Should the loss extend deeper than the aforementioned list, all remaining members of the guild shall hold a ballot to select the new Chancellor.
No Person except a confirmed member of the Eternus Ordo Veneficus shall be eligible to the Office of Chancellor; neither shall any Person be eligible to that Office who shall not have attained to the level of twenty, circumstances permitting, and been four weeks a member within the Eternus Ordo Veneficus.
Before he enter on the Execution of his Office, he shall take the following Oath:--"I do solemnly swear that I will faithfully execute the Office of Chancellor of the Eternus Ordo Veneficus, and will to the best of my Ability, preserve, protect and defend the Constitution of the Eternus Ordo Veneficus."
Section. 2.
Upon the Chancellor’s ascension to the throne, he must appoint a Grand Vizier who will work both with him, and keep his actions in line. The Grand Vizier must be wise and knowledgeable of the laws that govern the guild. The Chancellor is to consult the Vizier before passing new laws, and it is the Vizier’s responsibility to keep the Chancellor informed on every unique perspective of an issue.
The Vizier is the guild’s official Head of Government; it is his duty to ensure that the Chiefs and members of Executive Departments are performing their duties fully and lawfully. Complaints against the performance of the Chief Ministers should be directed toward the Grand Vizier and appropriate steps will be taken. If the Vizier deems it necessary to select a new Chief Minister or member in any position due to poor performance, he may do so with the advisement of the Chancellor. As the Grand Vizier is responsible for the entire government’s functioning, it is wise for him to keep only the most qualified and worthy members in important positions.
Section. 3.
The Chancellor shall be Commander in Chief of the Army of the Eternus Ordo Veneficus; he may require the Opinion, in writing, of the principal Officer in each of the executive Ministries, upon any Subject relating to the Duties of their respective Offices, and he shall have Power to grant Reprieves and Pardons for Offences against the Eternus Ordo Veneficus.
He shall have Power, with the Advice of the Grand Vizier, to make Treaties, and he shall nominate, and with the Advice of the Grand Vizier, shall appoint Ambassadors, other public Ministers and Consuls, Magistrates of the High Council, and all other Officers of the Eternus Ordo Veneficus, whose Appointments are not herein otherwise provided for, and which shall be established by Law: but the Chancellor may by Law vest the Appointment of such inferior Officers, as he thinks proper, in the Heads of Departments.
Section. 3.
The Chancellor, Grand Vizier, and a Chancellor-appointed recruitment officer known as the Chief Emissary will have the power to recruit new Guild members. It is the Emissary’s duty to ensure that there is always a healthy supply of members within the guild and to keep its numbers high. New members will be accepted on a personal observation basis only. The prospective member's skill level and qualifications will be taken into account; when a recruit is approved and is recommended as a good asset to the guild, with the approval of one of the aforementioned officers, an invitation to join our Guild and our forums will follow.
Section. 4.
The Chancellor and Grand Vizier are required to uphold the laws of the guild and this Constitution in every situation;
To set an example for the other members of the guild;
To promote guild members showing exceptional service and valor;
To ensure domestic tranquility within the confines of the guild.
Section. 5.
The Chancellor shall have the power to hear suggestions from guild members, and with the agreement of the Grand Vizier forge them into law; to make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the Eternus Ordo Veneficus, or in any division or officer thereof.
Section. 6.
Matters of treason are to be brought directly to the Chancellor.
Treason against the Eternus Ordo Veneficus shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in a trial by the Chancellor and Grand Vizier.
The Chancellor shall have the power to decide the punishment for treason.
Section. 7.
The Chancellor always retains the authority to, with consensus of the Grand Vizier, overturn any act passed by any organization, public or private, within the Guild.
Section. 8.
He shall from time to time give to the Guild members information of the State of the Guild, and recommend to their Consideration such Measures as he shall judge necessary and expedient; he shall receive Ambassadors and other public Ministers; he shall take Care that the Laws be faithfully executed, and shall Commission all the Officers of the Eternus Ordo Veneficus. The Chancellor may call a meeting of the Senior Executive Officials when he so deems necessary.
Section. 9.
The Chancellor, the Grand Vizier and all other civil officers of the Eternus Ordo Veneficus, shall be removed from office on Impeachment for, and Conviction of treason. In order to convict the Chancellor of treason all chief ministers and the Grand Vizier must come to a consensus that the Chancellor has waged war against or aided the enemy in harming the Eternus Ordo Veneficus. Frivolous or fraudulent attempts to incriminate the Chancellor or any other member of the guild will be met with immediate exilement for the accuser.
Article. 2.
Section. 1.
The powers of judicial review will reside in the hands of a High Council, which shall be regulated by the Chancellor. The Supreme Official in this ministry, the Chief Magistrate, will be appointed by the Chancellor and confirmed by the Grand Vizier. This official will uphold the Constitution and its laws.
The Chief Magistrate's official role in the guild is the keeper of the law. It is the Chief Magistrate's responsibility to ensure that all laws of the guild are interpreted clearly and carried out in accordance with the Constitution. It is important that this individual is exceptionally gifted in the art of law and is very well versed in the constitution.
The Chief Magistrate’s main duty is to accept complaints from members of the Guild concerning the breaking of rules. He must, to the best of his ability, investigate any grievance brought to his attention and impose a fair punishment on the offender, if found guilty.
Section. 2.
The proceedings of the High Council will go as follows:
Complaints may be filed publicly in the appropriate area set up by the Chief Magistrate. The High Council will look over the complaint and launch an investigation into the incident, securing any necessary evidence and logging it. If he decides that there is sufficient evidence against the defendant he must pursue the case as Prosecutor. Next, the Chief Magistrate submits his findings privately to the Chancellor, and recommends a punishment. The defendant is then permitted to give his side of the dispute and present any evidence in his favor. Once the Chancellor has looked over the evidence he will either accept the Chief Magistrate’s ruling or reject it, the High Council will publish the result, and see that the appropriate actions to be taken.
Section. 3.
The Chief Magistrate may be granted a Deputy Magistrate to assist in the legal proceedings of the guild. This official must be extremely well versed in the Constitution and experienced with the governmental procedures of the Guild.
The Deputy Magistrate's duties include: sharing the caseload of the Chief Magistrate, investigating crimes, ensuring that all guild activities are within the boundaries of the Constitution, and serving as an extension of the Chief Magistrate. Also, the Deputy is to take notes during proceedings and call any matters to attention that may have been overlooked by the Chief Magistrate.
Article. 3.
Section. 1.
A Commandant appointed by the Chancellor and confirmed by the Grand Vizier will command the army of the Eternus Ordo Veneficus. The Commandant’s duty is to oversee all facets of the military and ensure that all soldiers receive the proper training, and that correct procedures are being carried out.
Section. 2.
Three Captains, appointed by the Grand Vizier, will be responsible for initiating interguild combat. No Battles may take place without the presence of at least one Captain, or the Commandant himself. In addition, the Captain or Commandant must have expressed consent of the Chancellor to initiate a battle. The Captains are responsible for training the soldiers in the army and must routinely bring them on practice missions to build skill as often as possible.
Soldiers are recruited as Conscripts and may work their way up the chain of command by receiving promotions for excellent service. The ranks from the bottom up are: Conscript, Lieutenant, Lieutenant Commander, and Commander. With each promotion comes more respect within the guild’s ranks.
Article. 4.
All guild members are created equal and they are guaranteed a list of inalienable rights, these rights are enumerated as follows:
The Freedom to assemble, freedom of expression, and the right to petition the government for a redress of grievances
To never be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation
The freedom to join in any division or group so desired and encounter no discrimination because of, profession, level, sex or any other circumstance
The right to leave guild at any time, for any reason
The right to disobey an immoral order issued by a superior
The right to have an audience with the Grand Vizier or a Magistrate in order to discuss legal matters or intraguild grievances.
Article. 5.
Section. 1.
The Guild shall maintain laws in order to ensure justice and order within its ranks. Laws are to be followed in the Guild Forums and whenever the Guild crest is borne. These laws include the following:
Dishonest behavior, up to and including the impersonation of Guild officials is a serious offense; lying, defrauding, forging, or any other form of deceptive or fraudulent conduct is unacceptable.
Guild members are not permitted to ask their superiors for promotions. A notification may be made that states an interest in a promotion, but asking for a promotion will be met with a disqualification and disciplinary action.
There shall in no circumstance be any sexually explicit content, cursing, hateful, or any form of offensive language used in any guild related areas whatsoever.
Officers of ranks above that of ones own must be followed in every circumstance not deemed immoral.
No member of the guild should ever be harassed in any way by another member of the guild.
Under no circumstance is a guild member permitted to be a member of another guild; this is considered treason and is punishable by exilement.
Section. 2.
The forums are place to interact with other members of the guild and should never be taken advantage of for unlawful practices. These unlawful practices, in addition to the aforementioned in Section 1, include:
Intentionally derailing the topic of conversation from the posted subject.
Editing or altering any text left by a Forum Moderator in your post.
Posting Advertisements, chain letters, or commercial solicitation.
Posting content designed to inflame, incite or that has no purpose at all.
False reporting of posts or conduct, and abuse of the right to report unruly members.
Evading or attempt to evade warnings, bans, or other Moderator and Administrator actions.
Never release any inside information about the guild to outside sources. All information located within the member forums must be kept secret
Do not stay idle in the forums for prolonged periods of time without prior consent.
Ignorance is not a valid defense, members are expected to know every law that the guild has, and if one is broken they will be dealt with
Section. 3.
Petitions to one's superiors should follow the proper chain of command; a guild member should first contact the Officer directly superior to himself. If this officer is unable to meet the demands of the member, the petitioned officer will contact his superior, and so on. Members must contact their closest superior, and may not skip over him, unless that direct superior is the subject of the problem, in which case, that first superior to that problematic officer in question will be contacted. Conscripts should always contact one of their Captains, the Captain contacts the Commandant, the Commandant contacts the Grand Vizier, and the Grand Vizier contacts the Chancellor. Members of other Ministries are to contact the Chief Minister of their department. If there are ever legal concerns between guild members, such as violations of rules or rights, all members are urged to contact the High Judicial Council.
Section. 4.
All of the aforementioned laws are enforceable by the High Council. Violators will be prosecuted by the Magistrate and tried by the Chancellor or Grand Vizier.
Article. 6.
The Government of the Guild, whenever four-fifths of an assembly consisting of all of the Chief Ministers, the Chancellor, and the Grand Vizier deem it necessary, may ratify amendments to this Constitution. Amendments may be proposed with the consensus of at least two of the aforementioned Officials.
Article. 7.
This Constitution, and the Laws of the Eternus Ordo Veneficus, which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the Eternus Ordo Veneficus, shall be the supreme Law of the Land; and the members in every division shall be bound thereby.
The Chancellor, Grand Vizier, the Officers before mentioned, and all the leaders of the guild shall be bound by oath to support this Constitution; but no religious test shall ever be required as a Qualification to any Office or public Trust under the Eternus Ordo Veneficus government.
Article. 8.
The unanimous ratification by the Chancellor, Grand Vizier and all of the Chief Ministers, shall be sufficient for the Establishment of this Constitution of the Durance of Fate.
