Ed Adkins - Co D - Died 7/20/1862 from injury received in railroad accident near Augusta, Ga., A J Reese letter dated 7/21/1862 tells of the accident "I am sorry to say that we happen to have had a very unfortunate accident resulting in the death of one of the Polk Rifles. He was sitting in the door of one of the car boxes just before me. By some means (I did not see him as the post struck him) he was knocked out and killed. I have thought of the poor fellow several times since then."

Cpl Terrell Brown - Co E - 1906 Roster Commission Roll states "Wounded Gaines Farm, Va. Died of wounds", Service records show him WIA at Cold Harbor 6/1/1864 and on wounded furlough 7/22/1864, In this case it turns out that the 1906 Roster Commission roll was incorrect since he his shown on South Carolina's 1901 roll of pensioners living in Greenville County, He is listed as a class C pensioner which indicates a veteran disabled by wounds, His disabling wound is listed as being to the right thigh, He is listed here as a clarification entry

Thomas K Brown - Co C - Captured at Louisa Court House, Va 6/11/1864 and imprisoned at Elmira NY, Died 3/13/1865 of small pox, Buried at Woodlawn Cemetery, grave 2435, Elmira, NY

Virgil V Brown - Co D - WIA June 1864 at Cold Harbor and furloughed home to Ga, Dec 1864 notation states "Captured at home and murdered by the enemy", An article about him in Bartow County Heritage Volume I states "although not yet recovered from his wounds, Virgil left (his home at Van Wert, Ga) by horseback to join Confederate troops in the area, but was soon captured by Union soldiers. Even though he was in uniform, the young soldier was accused of spying and ordered to be executed. He was brought home and allowed to say goodbye to his family. Virgil was then taken to the enemy camp at Burnt Hickory where he was executed, According to his niece and nephew he was blindfolded, forced to kneel down and then shot in the back"

Jesse Cain - Co E - 1906 Roster Commission Roll states "Died in W.Va. 11/9/1861" Pension applications from his widow Mary in the 1890s state that he died between 11/9/1861 and 12/20/1861 in W.Va or Dublin, Va. of measles. In these applications, three veterans of Co E attest to his death by disease in 1861

Levi C Cason - Co D - Muster roll dated 10/31/1861 showed him "sick at Meadow Bluff" (W.Va.) and there are no other entries after this in his service record, 1906 Roster Commission roll states "died in 1861",Postwar pension application of his widow Sarah Lankford witnessed by J M Scott of Co D says that he died of measles 12/14/1861

R R Catchings - Co A - Last appears on June 1862 roll as "hospital sick", Document ordering coffin for him and return of body to Greensboro found in Daniel B Sanford papers at GC&SU Milledgeville makes it clear that he died in June or early July 1862

William M Dyer - Co E - Service records indicate he deserted at Cleveland, Tn 11/8/1863 BUT later records show him captured at Elgin Creek, Tn 6/21/1864, Imprisoned at Camp Douglas prison in Chicago until he takes the Oath of Allegiance to the Union and joins Co I of the 5th US Infantry 4/15/1865, Enlistment shows him to be 22, 5' 6 & 1/2" tall with brown eyes and brown hair, Died at Fort Dodge Kansas Post Hospital on August 6th 1865 from "inflammation of the bladder"

Coatesworth "Coates" Hamilton - Younger brother of Captain Joseph Hamilton of Co E, Coates was a 14 year old cadet at Georgia Mlitary Institute at Marietta when war broke out, Governor Brown detailed the cadets to drill new troops volunteering for service and Coates was soon hard at work as a drill master, When he indicated his desire to join one of the companies he had been drilling his father stepped in and asked older brother Captain Joe Hamilton to take him along with his Legion infantry company as a volunteer aide figuring that the boy would soon tire of service and return to his studies at GMI. It was not to be. On the long brutal retreat out of the mountains of western Virginia that November, Coates succumbed to one of the diseases that was ravaging the Legion at that time. A letter written by Cpl A F "Gus" Boyd from Peterstown, Va on November 27th, 1861 states simply, " Cotes Hamilton has died and Captain Hamilton has taken him back to Ga."

Ephraim Holland - Co B - Enlisted 8/6/1861, Age 37, Appointed teamster 10/27/1861, Shown on sick furlough Apr/May/June 1862 rolls, Turns out he had enlisted in February 1862 at Dalton as 1st Lt of Co B of the 36th Ga Infantry, Served with this unit in the Army of Tennessee until May 1864 when he deserted taking the Oath of Allegiance at Chattanooga 5/24/1864, He had made the statement that he was quitting if Johnston retreated past the Etowah River and did so, Then enlisted in the Federal 12th Indiana Artillery (using the name Alexander Holland) as a Private on 10/17/1864 and served with that unit until he died of small pox at Nashville 5/21/1865, His widow received a Federal pension

John A Jolley - Co M - Died 1/26/1864 in Cobb County, Ga of chronic dysentery

Thomas B Jolly - Co B - MWIA 7/3/1863 at Gettysburg per General W T Wofford letter 8/13/1863 and UDC burials book shows him buried there, His wife, Eliza Tye Jolly, filed a death claim on him with Confederate authorities Sept 1863 BUT Federal records show him captured at Gettysburg and then exchanged in May 1864. He is next recaptured at home in Dalton, Ga. July 1, 1864 and reimprisoned in Ohio until June of 1865. 1870 census shows him as town Marshall in Dalton, Ga. living with wife Eliza! He is still in Dalton in the 1880 census. They then moved to Alabama as a pension application filed there by his widow Eliza states that Tom died 7/11/1893 in Jefferson County, Alabama. An amazing story of a dead man who wasn't!

John Kavanaugh - Co F - Service record ends with notations that he was "missing in action 6/3/1864" and at "hospital wounded" but there are no hospital records for him. A postwar pension application from his widow Mrs M A Kavanaough states that he was wounded in the hip at Cold Harbor and then burned to death when the woods caught fire
