                      D e c r e e

The Regionalradio- und Cablebroadcastingauthority has adopted the
following decision with  the judgemeber 
Dr.Barbara HELIGE as head,in presence of the member Dr.Sepp
BRUGGER,Univ.Prof.Dr.Walter DILLENZ,Dr.Robert HINK,Dr.Michael
HOLOUBEK,Kurt LUKASEK,Christoph RONGE and Dr.Heinz WITTMANN and the
substitutemebers Mag.Maria WINDHAGER and Dr.Ludwig STAUDIGL as well as
the writing secretary Dr.Martin ATTLMAYR in their meeting on 
5.august 1997:





                       Sentence:

The application of Mister Mag. Franz Josef GLASL 

"1.)for granting a permission for the show of radio
    and TV(Paragr.1(1)RRG) and
2.) for granting all broadcasting licences for the whole Federal territory
    and beyond it
3.)to permit the Programms
   Die Welle,Die Spezialwelle,Die Gegenwelle
   The Wave,The Special Wave,The Counter Wave

4.)granting a written permission for the show of broadcasting
   and TV for an unlimited time without revocation 
   the permission of show for regional and local
   radio and TV  in the frame of the basic supply
5.)granting all broadcasting licences for the whole federal territory
   and beyond it for an unlimited time without revocation in writing
6.)granting  all broadcasting licences in writing for regional radio 
   for the whole federal territory and beyond it for  an unlimited time 
   without revocation 
7.)for granting   all broadcasting licences in writing for local radio 
   for the whole federal territory and beyond it for  an unlimited time 
   without revocation 
8.)for granting of all broadcasting licences in writing for
   the distribution of the programms with similar contents in essence
   and subjectprogramms for the whole federal territory and beyond it for  
   an unlimited time without revocation 
9.)for granting all  broadcasting licences for regional and local radio
19.)for granting all  broadcasting licences for show
    of radio and TV with the programms
12.)to ascertain that the Regionalradiolaw with orders,
    announcements,standing orders,state treaties(with the EU,EWR)
    are unconstitutional,unlawful, unjustice and in conflict with the
    human rights
    and to ascertain,that the authority has objections against the
    application of the regulations because of being unconstitutional,
    unlawful, unjustice and in conflict with the human rights


All applications are submitted at the same time for TV."

according to § 19 Abs.2 of the Regionalradiolaw, BGBl.Nr. 506/1993,in the
edition of Federal law BGBl. I Nr.41/1997 is dismissed

                        Statement of reasons:

With the writing submitted with the Regionalradio- und Cablebroadcasting-
authority on  12.June 1997 the applicant filed the applications as
stated in the sentence. The applicant was then with the writing of
11.Juli 1997 (GZ 611.193/3-RRB/97) of the Regionalradio- und Cablebroad-
castingauthority informed that his apllication doesnot contain 
essential information according to § 2a and § 19 of the Regionalradiolaw
and invited to provide more information in view of the legal
regulations. 
With the writing dated "21.7.1996" the applicant declared objectiond against
the writing of the Regionalradio- und Cablebroadcastingauthority
and again submitted  an application  of granting permission also
for TV what is not considered in the regionalradiolaw and was not
sufficient specified.

Of the application there couldnot be drawn sufficient decisionbasics
therefore the application has to be dismissed.

Against this decree there is an ordinary remedy inadmissible.

                          Remark:

Against this decree can a complaint be submitted within 6 weeks 
from service on. It must be signed by a lawyer.
