Rule 11 Penalty Time Claim
Here is an example of a hypothetical Rule 11 penalty time claim. A penalty claim may be due when a train is run with seven or more revenue passenger cars with a short crew. On a conventional train (ie; Heritage/Amfleet/Horizon) a baggage car worked en route counts as a revenue car. A straight cafe or diner does not count.

The claim will be a "slam dunk" if you have documentation. The best and only available documentation is the train consist in your Train Manifest. Remember to keep it!

Technically, the Assistant Conductor first out on the extra board is entitled to the claim. Practically speaking, the Assistant Conductor first out is usually unaware of the violation and if he was he or she may or may not file a claim. However, the claim is still valid and payable to somebody. The ones next in line to get paid are the Conductor and Assistant Conductor on that train. Provided of course that one or both submit a claim. If both file a claim, the award will be split between them. To file this claim, use the instructions on the "Basic Special Claims" page. Do not send in the original consist in with your special claim. Keep it safe and when it's denied, send it with copies of your paycheck statement and time slip to our Local Chairman Keith Moore. I like to send the original to Keith so he can wave it around and show them it's the real Mc Coy there by being un-deniable. It takes a while for these claims to be processed. On some of them, I've had to wait almost two years! But I did get paid. Any money even "old" money is good!
