SMILING W STABLE'S RELEASE OF LIABILITY& RIDER AGREEMENT

I. FLORIDA'S ZERO LIABILTY LAW

WARNING: Under Florida Law an equine activity sponsor or equine professional is not liable for the injury to, or death of, a participant in an equine activity resulting from the inherent risks of equine activities.

II. WARNING! THE NATURE OF THE HORSE, MULE OR PONY

Riding, handling and leading horses, mules and ponies are classified as rugged adventure recreational sport activities. There are numerous obvious and non-obvious inherent risks always present in such activities despite all safety precautions. No horse, mule or pony is a completely safe animal. Horses, mules and ponies are 5 to 15 times larger, 20 to 40 times more powerful, and 3 to 4 times faster than a human. If a rider falls from a horse, mule or pony to the ground, it will generally be at a distance of from 3.5 to 5.5 feet and the impact may result in injury to the rider. Horseback, mule and pony riding is the only sport where one much smaller, weaker predator animal (the human) tries to control and become one unit of movement with another much larger, stonger prey animal (the horse, mule or pony), with each having a limited understanding of the other. If a horse, mule or pony is frightened or provoked it may divert from its training and act according to its natural instincts. Such instincts may include, but are not limited to: stopping short, changing direction or speed abruptly at will, shifting its weight from side to side, bucking, rearing, biting, kicking or running from what the horse, mule or pony perceives as danger.

III. MEDICAL COVERAGE REQUIREMENT

Please note--if you have no medical insurance you are advised not to participate in equine activities at, or associated, with Smiling W Stable. See II above.

IV. BASIC STABLE RULES & ATTIRE REQUIREMENTS

All riders are aware of and agree to the following:

A. All activities are instructional in nature. Fundamental awareness of all safety concepts as elaborated upon in The United State's Pony Club's Basics for Beginners, D Level by Susan E. Harris is expected of all riders, participants and guests at Smiling W Stable. Failure to promptly follow instructions will immediately terminate all priviledges at Smiling W Stable with no right to refund or credit.

B. ASTM helmets are required of all riders whenever mounted if under the age of 18 and/or riding in the open and/or working over obstacles. They are available for use at no additional charge. Those who choose to ride without an ASTM helmet are advised to reconsider and shall ride at their own risk.

I assert that I am over 17 years of age and waiver liability of Smiling W Stable and associates for my decision not to wear a helmet. _________ (Initials)

C. Proper attire while on or around the horses is also required. Those who choose to ride without suitable boots may be required to ride without stirrups and shall do so at their own risk.

D. Every rider shall speak out if (s)he feels uncomfortable with an activity as to preserve safety of both horse and rider.

E. There will be no drunks, silliness, showing-off nor rodeoing on Smiling W horses. See A. above.

V. I HAVE READ ENTIRE RELEASE AND AGREE TO IT. I understand that falsifying information within this agreement may be cause for legal recourse on behalf of Smiling W Stable, its owner and its associates.
