WILL OF GEORGE PUCKETT Russell County, Virginia Will Book 5, Page 1 Executed 08 Sep 1835

In the Name of God amen I George Puckett being weak in body but of sound mind and disposing memory and wishing to settle my worldly affairs to my mind, do make this my last Will and Testament revoking all other wills or parts of wills by me heretofore made (to wit) first it is my will and desire that John Pucket my son and George Pucket my son have what I have given them in my lifetime and no more.

Secondly my three daughters Nancy Wright, Jane Smith and Sally Hicks I do will and bequeath them one dollar each.

Thirdly it is my will and desire that three of my sons namely Robert Samuel and James Pucket have my plantation within in the bounds of the old survey containing eighty acres be the same more or less and that they pay my two sons William Puckett and Drewry Pucket fifty dollars each.

Fourthly it is my will and desire thhat WWilliam Puckett and Drewry Pucket have a certain bond (or note) on John Davenport for two hundred and fifty dollars to be equally divided between them in addition to the fifty dollars that each of them will have coming from Samuel, Robert and James and no more.

Fifthly it is my will and desire that Daniel Pucket my son have a certain tract or parcel of land containing sixty acres more or less being a later survey than the old plantation lying on the south side of the old survey next to Copper Ridge and a dark bay mare and no more.

Sixthly it is my will and desire that Samuel and James have also two two year old horse beasts that they now properly claim and no more.

Seventhly it is my will and desire that my wife Jane have half the property about the house and kitchen and my bay mare and two cows that she may choose and her dower in the land during her natural life (or widowhood) and that she also have all my hogs and cropse.

Eighthly it is my will desire that my daughter Rebecca Pucket have the other half of the property about the house and kitchen not bequeathed before and one cow and yearling to take next choice after my wife.

Ninthly it is my will and desire that my two daughters Lucy Shoemaker and Phebe Tigner (to wit) that Lucy have one dollar and Phebe five dollars and no more.

Tenthly it is my will and desire that the residue of my property be sold and my debts collected and all my just debts paid and so soon as there can be money procured, that my son Daniel be paid five dollars I owe him and after my debts are paid out and what I have bequeathed that my wife have the residue if any to dispose of as she may think proper.

And lastly I do appoint my wife Jane Puckett and my son Robert Pucket my executors. Signed sealed and delivered in the presence of us the 11th day of August one thousand eight hundred and thirty-five.

    Virginia, At a court held for Russell County on the 8th day of September 1835.

    This instrument of writing was exhibited in court as and for the last Will and Testament of George Puckett Senr. deceased and proven by the oaths of William K. Colley and William Kelly the subscribing witnesses thereto, and ordered to be recorded. And on the motion of Jane Puckett and Robert Puckett executrix and executor therein named who made oath, and together with Emory Thompson and James Sykes their securities entered into and acknowledged a bond in the penalty of $500 conditioned as the law directs, certificate is granted the said Jane Puckett and Robert Puckett for obtaining probat of the said will in due form.

    An indenture of bargain and a sale of land from George Puckett and Lucy his wife, John Puckett and Sally his wife, Eruicus Smith and Rosanna his wife, Daniel Price and Judith his wife, Caleb Fraley and Betsey his wife, George Fennall an Phoebe his wife, Drury Puckett, Nancy Puckett and Robert Puckett to Jessee Vermillion was produced in Court and acknowledged by the said George, John, Euricus, Daniel, Caleb, George, Drury and Robert and the said Lucy, Sally , Rosanna, Judith, Betsy, Phoebe and Nancy were privily examined as the law directs and is thereupon ordered to be recorded. Same from John Puckett, Salley his wife, Euricus Smith, Roseanna his wife, Saniel Price, Judith his wife, Cabel Farley, Betsey his wife, Drury Pucket, Nancy Puckett, George Fennell,Phebey his wife and Robert Puckett to George Puckett was produced in Court and acknowledged by the said John, Euricus, Daniel, Caleb, Drury, George, and Robert and the said Sally Rosanna, Judith, Betsey, namcy and Phebe were privily examined as the law directs and ordered to be recorded.

Decision in favor of pltf. On motion of Def. for overturning case, one reason was that one of the parties had died. Appealed, appeal granted.

    This indenture made the twentieth day of July in the year of our Lord One Thousand seven Hundred and Ninety Seven between George Puckett and Lucy his wife, John Puckett and Sally (Sarah) his wife, Ericus Smith and Rosanna his wife, Daniel Price and Judah (Judith) his wife, Caleb Fryley and Besty his wife, George Fennell (Finney?) and Phebe his wife, Drury Puckett, and Nancy Puckett heirs of Drewery Puckett deceased and Roben (Robert) Puckett of Russell County and Commonwealth of Virginia of the one part and Jesse Vermillion of the said county of the other part witnessed that the s’d George Puckett and Lucy his wife, John Puckett and Sally his wife, Ericus Smith and Rosanna his wife, Daniel Price and Judith his wife, Caleb Fryley and Betsy his wife, George Fennel and Phebe his wife, Drury Puckett, Nancy Puckett, Roben Puckett for - pounds current money to them in hand paid by the said Jesse Vermillion the receipt whereof they do hereby acknowledge hath granted, bargained and sold by these presents do grant, bargain and sell unto the s’d Jesse Vermillion a certain tract or parcel of land containing one hundred and Forty acres lying and being in the said county of Russell adjoining the spurs of the River Mountain and cornered as follows viz Beginning on the end of a spur of the River Mountain near the head of a steep hollow at a black oak and a white oak running thence S. 56 degrees I. 80 poles crossing a small branch to a maple and white oak S. 14 degrees W. 50 poles crossing the s’d branch to a sugar tree on the side of a brushy hill S. 54 degrees W. 168 poles to a black oak and two white saplings in the head of a hollow N. 24 degrees W. 108 poles to a large Chesnut on a old line then with the old line N 60 degrees E 153 poles to the beginning together with the appurtenances unto the said Jesse Vermillion his heirs and assigns and the said George Puckett and Lucy his wife, John Puckett and Sally his wife, Ericus Smith and Rosanna his wife, Daniel Price and Judath his wife, Caleb Fryley and Betsy his wife, George Fennell and Phebe his wife, Drewery Puckett, Nancy Puckett and the s’d Roben Puckett will forever warrant and defend said tract of land with its appurtenances unto the s’d Jesse Vermillion his heirs and assigns against the claims of all persons whatsoever in witness whereof the said George Puckett and Lucy his wife, John Puckett and Sally his wife, Ericus Smith and Rosanna his wife, Daniel Price and Judath his wife, Caleb Fryley and Betsy his wife, George Fennell and Phebe his wife, Drury Puckett, Nancy Puckett and Roben Puckett have herein unto subscribed their names & affixed their seals the day and year first above written.
