Garrard County, Ky., Deed Book K, Page 127. Heirs of James Kennedy to Andrew A Kennedy.
This indenture of bargain and sale made and entered into this 22 day of June 1829 by and between all the heirs of James Kennedy deceased by their Commissioner, William Jennings of the one part and Andrew A Kennedy of the other part. Witnesseth that whereas the said James Kennedy dec'd died intestate leaving as a part of his estate a tract of land lying in the County of Garrard on the waters of Paint Lick Creek and containing one hundred thirty four and a half acres and whereas said heirs are numerous and the land but a small tract would be of little value were it equally divided among them all.
Wherefore there was a bill filed by one of said Heirs praying a decree to Sell at the Sept term 1826, a derectal order was entered up to sell and S G Tillet was appointed commissioner to execute Said decree and upon the 17th day of Oct 1826 he sold said Tract of land for the price of $810.00 and said Andrew A Kennedy became the purchaser, and at the June term, 1829, William Jennings was appointed by said court to make conveyance to said purchaser. Now be it known by these presents that all the afs heirs of James Kennedy by their commissioner, William Jennings, hath this day bargained alive and sold and by these present do bargain, sell and convey unto the said Andrew A Kennedy the afs tract of land lying on the waters of Paint Lick Creek in the County of Garrard and containing by actual survey 134 1/2 acres and bounded as follows (to wit), Beginning at a stake on the preemption line of Thomas Kennedy and a corner to Shumate thence S 95 1/2 poles to a white oak thence down a branch with its meanders and the line of John Courtney as consented by him. East 44 poles to an elm and hickory on said branch thence crossing said branch North 72,East 45 poles to an elm and buckeye; thence S 81, E 46 poles to a sugar tree, thence S 62, E 78 poles to a walnut then S 80, E 43 pole to a white oak, thence N 96 to Kennedys preemption line. thence with the same N 80, W 53 poles to the Beginning, to have and to hold the said tract or boundary of land be the same more or less to hime the said Andrew A Kennedy his heirs and assigns forever, and the said Heirs of James Kennedy by their Commissioner William Jennings do agree by these presents to Warrant and defend the title of the afs tract of land to the said Andrew A Kennedy, his heirs, free and clear fromthe claim of all and every person whatsoever. In testimony of which I have by virtue of the aforesaid power appointing me Commissioner. Subscribed and neames of all the said Heirs and my own name the day and date first above written.

I, Benjamin Letcher, clerk of the circuit court for the County aforesaid do hereby certify that the foregoing Deed of conveyance from William Jennings Commissioner to Andrew A Kennedy was produced in open court at the June term 1829, acknowledged and ordered to be recorded and the Same together with this certificate is truely admitted to record. Teste.
