1191 English Origins of American Law

This course examines the origins and development of English law and legal institutions with a view toward understanding the foundation of the American legal system. Keeping in mind that law is shaped by social, economic and political considerations, we attempt to answer the vital question, “How, and by what processes, dud English society solve certain problems with which all societies must eventually cope?” In answering this question we will be concerned with the various mechanisms for resolving legal disputes (e.g. trial by jury, the common law writ system, proof and evidence); rights in land and personal property; and legal relationships between people (e.g. contract, marriage). In addition, we will deal with certain issues in English constitutional law (e.g. the rule of law, ideas of legal sovereignty).

This course considers the efforts underway to globalize ideas of rule of law and democrary. In the movement to promote rule of law governments, human rights and market economies, conflicts regarding culture, identity and local politics arise. This course will focus on the social psychology aspects of the criminal justice system. Topics covered include victim reporting police discretion, pretrial processes, interaction in the courtroom, juror decision-making, the sentencing decision, the prison experience, parole decision-making, and return to society. A lecture format will be used. Films will be used occasionally.
