Falsification is FRAUD Introduction: Falsification of any kind is wrong. Falsification of a hospital patient record to get money from the patient is illegal. It is Fraud. When performed by a California licensed practicing physician, that is not only unethical, it is morally wrong. When this grievous crime is covered-up by the Hospital and Physicians involved, it becomes twice as wrong. When the Judicial System refused and continue to refuse to investigate these crimes of falsification or frauds, it becomes three times as wrong. The evidences are all in writing. The records of the crimes were made as the crimes were taking place. In other words, recorded in real time, they are not hearsay either. These are first-hand, written, recorded information. There were ten eye-witnesses to the crimes. My name is Lino Dial. I am the victim of these crimes committed by doctors in California, U.S.A. The First Crime The first crime took place in the city of Vallejo, in Solano County in the State of California, in the United States of America. This is what happened: An old lady and her husband were traveling by car. When they got to the city of Vallejo, the old lady got sick. She was taken to the Emergency Room of the hospital at XXX Hospital in the city of Vallejo, California. In most XXX Hospitals all over the United States of America there is a list of specialists or physicians to whom the emergency room doctor could refer a patient as needed. This old lady was referred to a specialist in Internal Medicine because her problem required the services of physicians in that specialty. This old woman was a resident of Central Point, Oregon. She was just passing through or driving through the city of Vallejo when she got sick. She did not know anybody in town. I call this the first crime because there were several other crimes that were committed by Doctors in the city of Vallejo. The Hospital and Doctors who practice in the hospital had to cover-up the first crime because it was a Big mistake. Not only that, they do not want any publicity because that is bad for business. In covering-up the first crime, they committed more crimes. Just like the person who told a lie, he had to tell another lie to cover-up the first lie, until there are several lies on top of the first one. The first crime is very important because without that then the other crimes probably would not have happened. It was the cornerstone or the keystone or the origin, beginning and foundation of all the other crimes. The victim of the first crime was an old lady from Central Point, Oregon. I have her hospital record. It contains her name, address, birthdate, insurance company and her husband's name, XXX. The first name of the patient is XXX. Her last name starts with the letter X For the present let us call her only as XXX. From the Emergency Room she was referred to a medical doctor whose specialty is Internal Medicine. He was the doctor on call for that day and it was posted on the wall for easy visibility. Specialists in Internal Medicine are called Internists. The Internist admitted the old lady to the hospital. This was properly recorded in the hospital admission record. He was the Physician-in-charge of the patient or the Attending Physician as he is sometimes called. The problem started when a surgeon, specifically a Neurosurgeon, falsified the hospital record of the patient so he could get money from the old woman. At this point, we are going to answer two questions that come to mind:
1. How did the Surgeon falsify the hospital record ? The answer to the question as to how the neurosurgeon falsified the hospital records is very easy. In the practice of medicine in the United States, a physician is NOT allowed to see the patient of another WITHOUT BEING ASKED TO DO SO. Formally we call that a Medical Consultation. Sometimes it happens informally, however, a doctor has to WAIT TO BE ASKED before seeing the patient of another. In this case, the neurosurgeon was NEVER asked to see the patient. In this particular case, the only way that the neurosurgeon could start seeing the patient was to falsify the hospital patient medical record. This is how he did it: The surgeon dictated a surgical consultation. This was typed on paper with hospital letterhead and was made part of the hospital record so that anybody could read it. The first sentence on the surgical consultation was that he was asked to see the patient by the Internist who was in charge or taking care of the patient. This is a lie, a deceit, a falsity, a fraud, and a falsehood because the surgeon was never asked to see the patient. The Internist in charge of the patient wrote in the hospital medical record that he never called that surgeon to see the patient. He did not talk to the surgeon by telephone, in writing and not in person. The answer to the question as to how do we know that the surgeon wanted to get money from the old woman is likewise very easy. I have a copy of the bill from the surgeon. He sent it by mail to Central Point, Oregon where the patient lives. The husband, XXX , complained about the bill. He had a reason to complain. First of all, the husband was present with his wife at the time of admission to the hospital. The admitting doctor was the Internist. In the second place, the husband was already told by the Internist that he never asked that surgeon to see his wife in consultation ( this is in writing ! ) but he went ahead anyway. I have a copy of the letter of the husband complaining about the bill. I made about a hundred copies. The Internist and the Surgeon are practicing medicine in the same hospital. The proper thing to do was to complain. The Internist complained to the hospital administration that the surgeon told a lie in his surgical consultation about the old lady; that the falsification was in writing and that it was made part of the hospital record. It is important to point out at this time that the hospital administration, specifically the hospital board of directors, are the persons who decide whether a person can work in the hospital or not, particularly, doctors. We must all conform to the laws, rules and regulations. Falsification of hospital medical record violates the law of medical ethics.
