March 1863 Bye - Laws

The new Bye - Laws were forwarded to the Secretary of State as required by the Improvement Act of 1845 .They were to take into account the Market & Fairs Clauses Act 1847 .

1 No stall , standing or Table shall be placed , nor shall any goods be exhibited for sale in any part of the Streets of the said City and Borough ; or in the Exchange , here to fore appropriated for Market purposes .
2 That the covered Market in Northgate - Street situate between the end of Princess - Street and Hunters walk , shall be appropriated for the sale of Butchers Meat
3 That the new market in Northgate - Street , called the Public Market , shall be appropriated for the sale of all sorts of provisions , the food of man , except livestock (save poultry rabbit and pigeons ) and also the Gardeners plants flowers and roots Growing and garden seeds and any garden stuff , and such other marketable articles as shall be approved by the market committee of the council ; but no fish whether cured , or uncured shall be sold in the market , except in that portion forming the recess at the North West end thereof without the sanction of the markets committee.
4 That the two covered Markets in Northgate - Street , hitherto used for the sale of Butter , Eggs and Poultry shall be appropriated for the sale of such marketable Articles as may from time to time be directed by the market committee
5 That the piece of enclosed ground , in front of the Fire Engine House , Northgate - Street , shall be appropriated for the sale of potatoes .
They also cover the times of opening and closing of the Markets , it states all Markets were to be closed on Sundays &c , Gives Regulations as to stalls in the Markets , Headings Only

8) Regulations as to Stalls in the Markets . - 9) Handcarts &c. not to be brought into the Markets .
10) Tenants must themselves occupy Shops &c. and not underlet 11) Any person , not a Tenant , using a Shop &c liable to a Penalty .
12) Names of Tenants to be put up . - 13) No Refuse or Garbage to remain about any shop .
14) Shops to be washed - 15) Fishmongers to wash Scales &c. daily .
16) Exposure of Articles for Sale. - 17) Obstructions .
18 )Hawking or Crying aloud . - 19) No Person to call to attract attention or custom .
20) Unwholesome Meat may be seized . - 21 ) No Live Stock Shall be left at night , nor any Poultry plucked in any of the Markets .
22) No Fish coloured as to give the same as deceptive
appearance to be brought into the Markets .
23) No Tobacco to be smoked in any of the Markets . - 24) No Orange Peel to be thrown in the Markets .
25) Penalty on Persons not complying with directions
of Superintendent .
26) Swearing , &c. - 27) All persons to quit Markets &c.
28) No Person to injure or alter any of the Gas Fittings - 29) Dogs not to be taken into , or kept in any of the markets .
30) Fouling of Water of the Markets . - 31) If Rent of Shop , stall &c. not paid, the same to be re-let .
32) Open Standings . - 33) All cleaving shall-be open Blocks .
34) Tenants to extinguish Lights , and stop
Water and Gas Pipes before closing .
35) Defacing Stalls &c. - 36) Wagons and Carts not to remain longer than necessary .
37) Wagons and Carts to unload &c - 38) Articles left in the Markets.


1884 The Chester Improvement Act

Was passed and this Act deals with markets and fairs in part VI. section 78 incorporates the provisions of the Market & Fairs Clauses Act 1847 .
