Judge Rice Will

The will of Judge Ambrose Rice is on record at the Wood County Probate Court, Bowling Green, Ohio. The following is transcribed from a photocopy provided by the court.

Last Will of Ambrose Rice, Dec’d

I Ambrose Rice, being of sound and disposing mind and memory do make and publish this my last will and testament, hereby revoking all other wills and testaments by me heretofore made and published, that is to say:--

Item First -- I do hereby give and bequeath to Ambrose Rice Lee of Alleghany County, in the State of Pennsylvania, and unto Ambrose Rice Gage of Morgan County in the State of Ohio - A note against Jesup W. Scott, dated October 1st 1837 for two thousand dollars principal secured by mortgagees. Two notes against Willard V. Way of Perrysburg Ohio, dated November 25th 1836 for five Hundred Dollars principal each, secured by mortgage, on one of which notes there is an endorsement of Two Hundred Dollars, One note against Willard V. Way dated September 25th 1835 for One Hundred Dollars principal, on which is an endorsement of Eleven dollars -- Also one Bond against James Waugh, dated September 18th 1837, for the sum of Three hundred Dollars principal secured by mortgage. One Note against Henry Bennett, of Wood County, dated September 26th 1835 for the sum of Four Hundred Dollars principal. Also one note against William P. Reznor, of Wood County, dated July 18th 1840 of Eighty dollars principal. One note against Mortimer D. Hibbard dated April 12th 1839 for ninety one dollars and sixty cents principal.

Item Second -- I do further give and bequeath to Ambrose Rice Eckler of Catskill in the State of New York a certain Island, called Eagle Island, or Rice’s Island near the head of Sandusky Bay, containing one hundred and thirty four acres, and forty two hundredths of an acre. Also Lot Number Three, the North west fractional quarter of fractional Section Number twenty six, of Township Number Six North, Range number Sixteen and, ontaining Forty three acres and ninety one hundredths of an acre. Also fractional section Number Six, in Township Seven North, Range Sixteen East containing one hundred and eighteen acres and Ninety hundredths of an acre. Also the North West fraction of fractional section Number Thirty-five, Township Number Eight North, Range Number 15 East, containing ninety four acres and forty eight hundredths of an acre. Also Fractional section Number Thirty, Township Number Eight North, Range Number Fifteen East containing one hundred and Nineteen acres, and forty two hundredths of an acre. Also Fractional Section Numbers thirty, Township Number Eight North Range Number fifteen East, containing One hundred and Twenty four acres, and eighty hundredths of an acre. Also, Fractional Section Number Twenty Five Township Number Eight North Range Number fourteen East containing Five hundred and nine acres and thirty four hundredths of an acre. Also the North west quarter of the North West quarter of Section Number five Township Number seven North, Range Number Fifteen East containing Forty two acres and twenty nine hundredths of an acre. Also the south half of the South west quarter of Section Number Thirty Two, Township Number Eight North, in Range Number Fifteen East containing Eighty acres.

Item Third. -- I do further give and bequeath unto Ambrose Rice 2d of Allen County Indiana. The North East fraction of section of Section Number Four [repetition in original document] -- Township Number Thirty seven North, Range Number Thirteen East, and the North west fraction of section Number three, Township Number Thirty seven North Range Number Thirteen East, containing altogether Twenty three acres twenty one hundredths of an acre. Also the East fraction of section Number Twenty Two, Township Number Thirty seven North Range Number Thirteen East containing six acres and twenty two hundredths of an acre. Also the North East quarter of Section Number Twenty Two Township number Thirty seven North Range Number Thirteen East containing Sixty two acres and Seventy hundredths of an acre. Also the North East fractional quarter of Section Number twenty, in Township Number Thirty seven North, Range Number Thirteen east containing twenty one acres. --

Item Fourth. -- I do further give and bequeath to Ambrose Rice Murry, of the State of Michigan Town Lot Number One Hundred and Twenty, east of Monroe Street, in the village of Monroe and State of Michigan. Also the South half of the south east quarter of section Number six, and the North East quarter of the south east quarter of the same section Number six, Township Number seven North in Range Number Fourteen East, and the South west quarter of the South west quarter of Section Number five, all in Township Number seven North and Range number Fourteen East containing one hundred and forty acres: --

Item Fifth. -- I do further give and bequeath to Ambrose Rice French of Cincinati [sic] Ohio. The South West quarter of the Southeast quarter of section Number Four, Township number Five South Range Number six East, containing Forty acres. Also the North west quarter of the South west quarter of Section Number Thirty Two Township Number one North, Range number six east, containing Forty acres. Also the Southwest quarter of the south west fractional quarter of Section number six Township Number six South, Range Number Three East containing Forty three acres and eighty-seven hundredths of an acre. Also the North fraction of the North east quarter of Section Number Twenty Four, South in Range Number Two East, containing Seventy two acres and eighty hundredths of an acre. Also the South West fraction of the North East quarter of section Number Thirty four, Township Number one North of Range Number Five East, containing sixty nine acres and thirty three hundredths of an acre. Also the South fractional half of the North East quarter of section Number Thirty Three, Township Number Three South and Range Number one east, containing Fifty four acres and sixty one hundredths of an acre. Also the North fraction of the North half of section Number Twenty six Township Number Four South Range Number Three East, containing eighty one acres and thirty five hundredths of an acre.

Item Sixth. -- I do further give and bequeath to Ambrose Rice Pray, of Lucas County Ohio. The West half of the South East quarter of Section Number Thirty three, Township Number Five North Range Number Two East, containing eighty acres. Also the East half of the North West quarter of Section Number Twelve, Township Number Four North Range Number Ten East containing eighty acres. Also the North West quarter of Section Number Twenty Five Township Number Four North, Range Number Ten East containing one hundred and sixty acres.

Item Seventh. -- I do further give and bequeath to Oscar S. Hibbard of Lucas County, Ohio, that part of the South half of Section Number Thirty Two in Township number eight North Range Number Six East, which lies to the East of the County Road, terminating at the forks of Brush Creek. Also that part of the North half of the North East quarter of Section Number Five Township Number Seven North Range Number six East not sold to Michael Ferguson.

Item Eighth. -- I do further give and bequeath to Jason R. Hibbard of Lucas County Ohio, that part of the South half of Section Number Thirty Two, and of the South half of the North West quarter of the same, which lies to the Westward of the said County road terminating at the Forks of Brush Creek. Also the East half of the South East quarter of Section Number Thirty one. Also the North East quarter of the North East quarter of the said Section Number Thirty one, all in Township Number eight North and Range Number six east.

Item Ninth. -- I do further give and bequeath unto Edward Howard of Wood County Ohio. Fractional Section Number Twenty Eight (28) Township Number eight North Range Number seven East.

Item Tenth. -- I do further give and bequeath unto Robert A. Howard of Lucas County Ohio. Fractional section number Twenty Nine (29) Township Number Eight North, Range Number Seven east. Also Fractional section Number Twenty Seven Township Number Eight North and Range Number Five East -- Fractional Section number Twenty six, Township Number Eight North Range Number Seven East. All in Lucas County Ohio.

Item Eleventh. -- I do further give and bequeath unto Mortimer D. Hibbard of Lucas County, Ohio, all my personal property in his possession, papers excepted -- and it is my will that all the residue of my personal and real property should be applied to the payment of my just debts and to defray other expenses -- and after the payment of such demands and the expenses of administration, the residue of the avails of such remaining estate, I do give and bequeath to Ambrose Rice the 2d of Allen County in the State of Indiana. It is further my will that James L. Gage of Morgan County, Ohio, John Webb of Wood County, Ohio and Jonathan H. Jerome of Lucas County, Ohio be appointed executors of this my last will and testament. Given under my hand and seal this 2nd day of December 1840.

Personally appeared in open Court Addison Smith and Hesekiah L. Hosmer the subscribing witnesses to the last will and testament of Ambrose Rice deceased who being duly sworn say that they were called upon by the said Ambrose Rice to sign the same as subscribing witnesses and in his presence and at his request they did subscribe the same, that at the time he was of sound mind and memory of full age, acting under no restraint and that he declared the same to be his last will and testament.
