    After careful consideration and much reflection I have decided to run for the New York State Park Police Supervisors Union. Clearly the New York State Park Police has moved into a new era. Division oversight after the New York City Region / Shelly Reed debacles, Low Morale, Embarrassing Low Pay, Inadequate Contracts, Low Entrance Exam Turn Out and Even Lower Recruit Retention have changed the NYS Park Police Force forever. Both Management and Labor must work together to over come these obstacles. We can no longer continue a relationship driven by petty personalities in OPR&HP, individual political agenda, national & state politics and upstate downstate resentment.
    As the Union President it is my promise to:

    1)Aggressively represent all members throughout New York State.
    2)Clearly document and inform the membership of grievances, arbitrations and Labor Management agreements.
    3)Provide an open forum for members to be heard.
    4)Provide representation and strict adherence to the contractual parameters.
    5)No longer deal in indulges of petty personalities and whims of those in OPR&HP.

    New York State has a budget surplus thanks to the diligent policies of Governor Pataki. This Republican Governor has an opportunity now because of his diligence to correct a great wrong. Between governor’s Carey and Cuomo and their Democratic administrations they ruined the New York State Police Services. Through mismanagement and a failure to bargain in good faith during contract negotiations the New York State Police services have fallen woefully behind in salary and benefits. The smartest and brightest no longer look to a career in the New York State Police services. But rather leave for municipal Police departments that provide higher salary and better benefits. Now is the chance of a life time Governor Pataki prove your pro law enforcement correct these inequities or go down in history as another jerk off Governor as the two that preceded you.
    Lets review over the last several years:
    Last year all elected officials gave themselves a 38% pay raise. In eight years of covered under prior contracts we received four years of zero raises, had increase in health benefits and had numerous legislation to benefit the State Police Services veto only to have similar legislation that benefits the municipal Police Department signed into Law. Currently we have been without a contract since March 31 1999 Our current salary and benefits lags between 50 to 100% behind compared to comparable municipal Police Departments. That’s right 50 to 100%, a Suffolk County Police Sergeant earns $98,000.00 per year works ten less days per year due to rotational schedules and receives other pay incentives. Suffolk is not an isolated incident Nassau, Westchester, Rockland, Orange, Putnam, Dutchess and Erie counties also receive similar such pay. Even among state Police agencies there are discrepancies. State University Police remain the lowest paid and Division of State Police Members receives almost $20,000.00 more per year.
    Approve the COLA (cost of living adjustment) for retirees. Approve a unified pay standard for All State Police services. Approve unified benefits for All State Police services. Approve equitable pay raise to raise all State Police pay to match that of the municipalities.

Subject: Updates
  • C82 Executive Board-
    Meeting was conducted this past Monday. John Reidy will be offered the job of organizer for C82. He will be responsible to seek out municipal and county police departments and bring them into the Council 82 ranks. John was the Vice Chair of Law Enforcement Policy prior to the decert. He also got more than 80% of the Park Police to sign cards to come back to C82.
  • Life Insurance-
    C82 will reinstate a life insurance policy for the membership. It will start at $5000. If this works and our budget remains good we will increase it at a later date. Everyone should be receiving cards within the next couple of weeks. You MUST fill them out and return them in order to be covered. If you do not receive them after 2 weeks call C82 @ 1-800-724-0482.
  • Contract-
    Books have not been printed as of yet the state has tried to change some of the language. In particular they placed dates on items that we did not have dates on. This in effect would stop items from being retro back to the beginning of the contract. Once everything is straightened out they will be printed and sent to each member.
  • PERB Carve out-
    So far in the meetings the biggest stumbling block has come from the state and not NYSCOPBA. With the EnCon Lts the state doesn't seem to want to allow them to be carved out from a group with corrections to be put into our group with Corrections. There is another meeting scheduled for January 5, 2001.
    In case I do not post anything further in the next week or so I would like to sincerely wish each one of you and your families the very best in the upcoming holiday season and coming year. May you all remain safe and find peace in the coming year.

    TheLUSOSARGE GRIEVANCE & RESOLUTION SECTION

      Subject:Supervisors Seniority
    • The Issues: The Supervisors contract clearly deals with the filling of Supervisors positions. These positions are to be filled via seniority from the existing pool of Supervisors. If at no such time any current Supervisor seeks the position the Agency may then promote to the vacant position.
    • The Agencies Position: The Seniority section does not apply in between Regions in this situation. Further the Agency can promote within NYS Civil Service Guidelines whomever they want rather then allow a transfer. Seniority will only apply under certain situations.
    • The Problem: This policy has effectively created fragmentation amongst the ranks. Are we one State Agency or are we 11 Regional State Agencies? The policy of sometimes we are sometimes are not is not applicable under union contract and State Law.
    • The Resolution: At Arbitration the Arbitrator resolved that the union and Agency should at labor management level come up with a uniform transfer policy. The Agency positions of sometimes we are and sometime we are not was wrong. A labor management meeting was held at which The LUSOSARGE was present and it was Resolved that all Supervisors positions will be offered to current supervisors and filled via seniority as per the contract. Once the every supervisor has had the opportunity to transfer the remaining open position whereever it maybe will then be promoted off the appropriate list.

    • Subject: Illegal release of Personnel File To Public
    • The Issues: The State and OPR&HP released in violation of Section 50 of the NYS Civil Rights Law to my ex wife’s attorney my Personnel File.
    • The Agencies Position: NYS OPR&HP does not have to abided by Section 50 of the NYS Civil Rights law and can release the file with nothing more then a request from the public.
    • The Problem: This policy which is in VIOLATION of NYS LAW also poses a threat to not only the police officer but his FAMILY as well. Included in the everyone’s Personnel File is information on both the Police Officer and his/her FAMILY.
    • The Resolution: At Arbitration the Arbitrator resolved that the State and OPR&HP acted in a callous and illegal manor in safe guarding the Police Officers Personnel File thus by placing the Police Officer and his FAMILY at risk. The Arbitrator further ordered the State and OPR&HP to follow state law. Additionally the Arbitrator ordered that any person in position of the Police Officers Personnel file returns same to him immediately. The Arbitrators decision further supports the claims of retaliation by the State and OPR&HP for a lawsuit brought against the State and OPR&HP by the Police Officer and 6 other co plaintiffs.

      Subject:Overtime Meal Pay
    • The Issues: While working in the Palisades Region none of the members received overtime meal pay despite the fact that the issues was clearly defined in the contract. Since every other Agency in the state as well as every other Police Region complied its appears the issues is defined to the Palisades region.
    • The Agencies Position: The issues has been brought to Capt. Gregory Stewart of the Palisades Region several times but as of yet has not been resolved for some unknown reason. These issues should soon be heading to GRIVEANCE unless resolved.
    • The Problem: This regional policy has for years denied the officers money that was rightful owed to them. Issues such as these create an air of distrust between the members and the state.

      The current N.Y.S.C.O.P.B.A contract sucks. I urge all POLICE personnel to vote yes to the carve out petition before PERB. As POLICE OFFICERS we will never ever get good or fair representation while part of a CORRECTION OFFICERS UNION. NYSCOPBA is a CORRECTION OFFICERS UNION. The current contract SUCKS! They should be embarrassed to have submitted this contract?
