daughter of JACOB DECK and ELIZABETH BENDER/PAINTER. She was born
1780 in Virginia1, and died 1867 in Macon County, North
Carolina.

Farmer and Merchant. Joseph
was co-partner with Robert Hall and James Truitt, as merchants, under the name
of Joseph Welch and Company in Franklin. This business was sold to John Hall
December 25, 1835.
From Macon County Court
records: April 17, 1866: It appearing to the satisfaction of the Court that
Joseph Welch, late of Macon County, died without leaving Last Will and
Testament, A.B. Welch was appointed Administrator of the estate. He filed bond
in the amount of $1000 with B.W. Bell and James Shepherd as security.
Joseph Welch's Road
There was no road down the
little Tennessee into Tennessee, so in the 1830's my g-g-g-grandfather, Joseph,
sold several of his slaves and went into debt to build the first road down the
river from his place to Bushnell. Neither the state nor the county could afford
to build any roads unless completely necessary so they encouraged everyone who
wanted to risk their own money, to build toll roads or turnpikes, as they were
called in those days. Grandpa Joseph had hopes of making a wagonload of money
but the venture proved unprofitable and he was forced to file bankruptcy. The
road, which was built by Grandpa Joseph's remaining slaves and who ever else he
could get to help, was 25 or more miles long. They used picks, shovels and drag
pans to build the road that became a way for the settlers to reach Chambers,
Hazel and Eagle Creeks. (Edited Source:

Joseph Welch, pioneer
settler of Macon County. Joseph purchased land from the State of North Carolina
when the lands acquired from treaty with the Cherokees were put up for sale in
Waynesville in September 1821. This property was in the Cowee Community where
Joseph first settled. In September 1831 Joseph sold to Joshua Hall 224 acres on
the Tennessee River including the old Indian town house.
In November 1833 he sold
other lands to Humphrey Posey. Later Joseph moved his residence to the mouth of
the Tuckasiege River. An election precinct was established at his residence in
September 1847, and in census records it is called Welches District. The
General Assembly of North Carolina appointed 33 leading citizens to serve as
the first Board of Magistrates for the newly formed Macon County, and Joseph
Welch was among those taking the oath of office on March 29, 1829. He was a
prominent citizen of the early days of the county. He served faithfully
throughout the years in all activities of the county, as a Magistrate, juror,
tax lister, election official and road overseer. Joseph had a charter for a
turnpike from the mouth of the Tuckasiege to the Tennessee line. The
Magistrates presided at the sessions of the Plea and Quarter Courts, which were
regular jury courts. The affairs of the county were decided at these sessions.
The tax rate was set each March, and Juries were appointed to view and lay off
the county roads. The appointed overseers and neighborhood men were required to
build the roads and keep them passable. Guardians and Administrators were
appointed by the Magistrates. Joseph
was given as security for the performance of the contract for the building of the
first Macon County jail in 1829. He was one of the Commission appointed for the
reviewing and laying out the streets of Franklin April 9, 1835. Joseph was
co-partner with Robert Hall and James Truitt, as merchants, under the name of
Joseph Welch and Company in Franklin. This business was sold to John Hall
December 25, 1835. The Cowee Baptist Church was organized March 15, 1828, and
among the charter members was Joseph Welch. All of the charter members came
from the Franklin Baptist Church.
Joseph and Catherine moved
back to the Cowee Community near their daughter, Narcissa Welch Shepherd, when
they had grown old. Joseph grew old in service to the new county and his sons,
Thomas, Joseph Jackson and Albert Burton Welch followed his example as good and
useful citizens of Macon County.
1821 Jan 4 Joseph Welch pays
Elizabeth, relict of John Alexander, deceased, 500 pounds to relinquish all
dower claims vs estate of her husband.
1821 May 8 Elizabeth
McGaughey (Mrs. John) of Rutherford County, heir-in-law of John Alexander,
deceased, appoints her brother Joseph Welch of Lincoln County as attorney to
sell her share of 200 acres on the West side of the South Fork (Catawba River)
Rutherford County.
1821 Aug 11 John Welch and
James Welch of Monroe County, Kentucky heirs-at-law (as above) have right to
share in 255 acres on South Fork, Catawba River in Lincoln County and appoint
their brother Joseph Welch to sell the land and divide among the heirs, etc.
1829 Along with the law
creating Macon County, from Haywood County, the North Carolina General Assembly
appointed 33 leading citizens to the area to serve as magistrates. Joseph Welch
was one of the men appointed. The counties were governed by a Court of Pleas
and Quarter Sessions. These courts consisted of two dozen or more men, or
justices, who received their commission from the Governor. Our Joseph was one
of the justices. They held office for life and received no pay. The court met
four times a year, hence the name Quarter Sessions.
Joseph was a very busy man.
He was given as security for the builders of the new jail. Joseph was one of
the members of the jury to lay off the road from Franklin down the river to the
mouth of the Tuckasegee to connect with a turnpike which Joseph had a charter
for to the Tennessee line. He was also in the group of men to lay out the
streets of Franklin. (Joseph's father, Thomas Welch, Sr. was on similar
committees when the town of Rutherfordton was laid out in the 1700's.) Joseph
was in faithful attendance at all sessions of the Pleas and Quarter Sessions
Courts in Franklin until he was an old man, following the footsteps of his
father who had done the same in Rutherford County.
Cowee Baptist Church Book
Volume 1: "The Constitution of the Baptist Church at Cowee in the Cherokee
Purchase, Macon County, North Carolina, March 15, 1828. The presbytery
consisting of Elders Humphrey Posey and Stephen White, met at Cowee by request,
and after worship and a discussion on the subject of the meeting, fifteen
members were found in readiness for a church. all of them members of the church
at Franklin." These fifteen charter members were: Samuel Rose, Levi Truit,
George Caler, Peter Mason, Joseph Welch, Jacob Caler, Lucrecy Rose., Susanah
Truit, Hannah Dickey, Jaly Hibberts, Polly Edwards, Sarah Mason, Mary Mason,
Roda Russell, and Sarah Fortune. On the same day, Samuel Rose and Levi Truit
were examined and set apart by ordination to the office of deacon. George F.
Caler was elected first clerk and treasurer. Humphrey Posey was elected as
pastor on June 14, 1828.
At its organizational
meeting the church set the third Sunday and preceding Saturday of each month as
its regular meeting time and agreed that meetings would be held at Caler
Schoolhouse, located at the forks of the road at the mouth of Caler Creek and
Cowee Creek.
On June 26, 1830, George F.
Caler, Elijah Shepherd and Samuel D. Bryson were appointed trustees and
were instructed to locate
and purchase a spot of ground on which to build a church. The land was deeded
to the church by Samuel Decater
Bryson and was located on a knoll in front of the present church
building. The first building
was a log structure which was used until 1868.

One researcher has listed
Catherine's father as Mathias Van Dyke of the Netherlands, but Mathias
daughter, Catherine, married George Simmerly (Lincoln County marriage bond: May
6, 1794). Lorena S. Eaker's research has one Jacob Deck (Tack) marrying
Christina Binder/Painter abt 1780 (Revolutionary War pension #S7677) and moving
to Rutherford County after April 28, 1790 when twins sons were baptized (names
not given). Jacob as the father of Catherine seems more probable, though I have
not seen documentary evidence to prove this. I am going on the weight of the
evidence.
Mathias Deck owned land in
the Killians Creek area (present day Lincoln County), deeding a tract to his
son Adam in 1763. For further information, see Eaker, Lorena S., German

Superior Court
A paper writing purporting
to be the Last Will and Testament of Thomas Welch, deceased, which are in words
and figures following:
In The Name of God, Amen. I,
Thomas Welch of the County of Macon and State of North Carolina, being of sound
mind and memory and bearing in mind that it is appointed for all men to die, do
make, publish and ordain this my Last Will and Testament. This is to say, First
of all, I will and desire that my body shall be buried in a decent and
Christianlike manner and that all my just debts be paid by my executor,
hereinafter named. Secondly, I will and bequeath my beloved son, Joseph W.
(Wilburn) Welch,. all that tract or tracts of land lying on the Tennessee River
known as the Queen place which I purchased from John Queen. Also Two Hundred
acres of land lying in the forks of Tuckasiegee River and Tennessee River, and
below the
mouth of the Tuckasiegee on
the north side of the Tennessee River and also one-half interest in Six Hundred
and Forty acres of mountain land lying on the top of the Smoky Mountains to the
left of the *High Rocks. Thirdly, I will and bequeath to my beloved daughter,
Louisa A. Huggins and her children after her death,
all my house, land and
plantation on the waters of Burningtown Creek, consisting of several tracts and
joining. Also all my land in Cherokee County being Two Hundred acres, lying on
a small creek which empties into the Tennessee River about 46 miles below
Franklin, and also one-half of Six Hundred and Forty acres lying on the Smoky
Mountains mentioned in the foregoing section. And also all my household and
kitchen furniture and all my livestock and grain of every description except
such is specifically herein after disposed of otherwise. And also all my farming
and smith tools and all the iron I have on hand and loaned out and wagons
unfinished except one which I owe J. W. Welch. Fourth, I will and bequeath to
my grandson, Thomas Allen, one horse, bridle and saddle worth One Hundred
Dollars, one cow, one bed and furniture and one rifle gun to be paid to him by
my executor when he attains the age of twenty one years. Fifth, I will and
direct that all the balance of my land, being mountain land, be sold by my
executor on a credit of one, two and three years, and the proceeds thereof
equally divided between my two daughters, Marianne Drenon and Amanda Allen.
Sixth, I will and direct that my three work oxen be sold by my executor after
taking the range one summer season, and the proceeds applied to the payment of
a debt which I owe James Bryson due in the Fall 1861, being part of the price
on my Queen land, and so far as they do not pay and satisfy the same,
my son, J. W. Welch, pay the
balance since to him the land, in that event, will belong.
Seventh, I will and direct
that all debts due me be collected and applied to the payment of my debts and
expenses of winding up and settling my business and the surplus, if any, to be
equally divided between my two children, J. W. Welch and Louisa A. Huggins, and
if the amount should not be sufficient for those purposes, then the deficiency
is to be paid equally by those two, viz, Joseph W. Welch and Louise A. Huggins.
Lastly, I nominate and appoint my friend, Henry G. Woodfin, Executor of this my
Last Will and Testament, and hereby revoke and disclaim all other wills by me
made and other paper writing purporting to be such.

set my hand and seal on the 21st day of March, 1861.

Amanda, and Mariann Drenon, two of the heirs at law and next of kin of said
Thomas Welch, came into court and entered a Caveat to the Probate thereof, and
say that the same is not the Last Will and Testament of said Thomas Welch or
any part thereof. And there upon the Court directs the following issue to be
made up and transmitted to the Superior Court to be submitted to a jury, to
wit: Is the paper, the writing or any part thereof, if so, what part, the Last
Will and Testament
of the said Thomas Welch or
not. And on motion it is ordered that a citation issue against Joseph Huggins
and wife, Louisa, and J. W. Welch, two heirs at law and next of kin of the said
Thomas Welch, who reside within the state, to appear at the next term of
Superior Court to see proceedings in the case and make themselves parties to
the said issue if they shall think proper to do so.

It appearing to the
satisfaction of the Court that a paper writing has been offered to this court
purporting to be the Last Will and Testament of, Thomas Welch, deceased, and
certain of his heirs at law and distributees having entered a Caveat to the
probate it also appears to the satisfaction of the Court, that the interest of
the estate requires the appointment of an administrator during the litigation
in relation to the Last Will and Testament aforesaid, and R. C. Slagle applying
for said administration,
it is therefore ordered by
the Court that the said R. C. Slagle be appointed administrator and that he
enter into bond and security in the sum of $1000, which bond is accepted by the
Court and J. S. Grey as security, and the said R. C. Slagle is duly qualified
by taking the oath of office and letters issued.

according to law and that the same be recorded. Ordered by the court that a
Provendo issue, together with a copy of this record to the Justices of the
County Court, commanding them to proceed in the premises according to law. It
is agreed by the court that the defendant pay the cost of the same.
WILL: December 15, 1861 -
Macon County Superior Court
R. C. Slagle, Administrator
of Thomas Welch, deceased, issues an inventory of the estate and tenders his
resignation as Administrator which was accepted by the Court. H. G. Woodfin is
appointed in his stead, and files bond in the sum of $1000 with J. G. Crawford
and G. C. Sellers as security. The oath of office was administered and letter
issued. The Court ordered that the said Woodfin in take charge of and expose
for sale the following property - to wit: 2 head of horses, 3 head of young
cattle, 3 head of sheep, 14 head of hogs and a claim of wild hogs, and the rent
corn, supposed to be about 165 bushels and that he take care of the balance of
the property.
Ordered by the Court that H.
G. Woodfin, Administrator of Thomas Welch, deceased, be allowed to list the
taxables of said estate to the clerk.

The proceedings issued from
the Court of Law of Macon County in the case of H. G. Woodfin against D. H.
Allen and Others, was returned, whereupon H. G. Woodfin was duly qualified as
Executor of the Last Will and Testament of Thomas Welch, deceased.
BIOGRAPHY: Thomas was the
first Welch to settle in the Burnington section where he became a large
landowner owner through purchase from individuals, land grants and entry and
claim. By 1860 he had amassed 3400 acres valued at $9640 and personal property
valued at $1918.
Thomas and Hester first
lived in the Cowee section for the Macon County records show that on March 28,
1829 Thomas Welch, Thomas Shepherd, Jr., Joshua Dickey and B. S. Brittain were
members of the County Patrol for the Cowee Community. The new county was divided
into militia companies with a leader and patrols.
From May 23, 1835 Cowee
Church Records:
Chose Brethren Isaac Truett,
Henry Burnett, Joseph Kilpatrick and Thomas Welch to meet and labor with
members, Thos. Daves and James Gilbreath.
They lived near the
Burningtown Creek where Thomas operated a gristmill. The location is often
referred to in the old Macon County records: June 10, 1845 - Ordered by the
court that Richard Clampett be appointed overseer of the Burningtown road from
the ford in the creek below Thomas Welch's mill. May 1854 . . . to work out a
road beginning at the lower end of Zachariah Downs' field through the Saldeer
Gap and to intersect the Burningtown road near Welch's mill.
Thomas was also a
blacksmith. A blacksmith was a skilled artisan with many talents. Besides
putting shoes on horses, he built and repaired wagons and he made most of the
tools and many of the utensils for the house and farm. In his will in 1861, he
gave to his daughter, Louisa Huggins "all of my farming and smith tools
and all the iron I have on hand and loaned out and wagons unfinished except one
which I owe J. W. Welch."
Thomas was very active in
county and community affairs. He and his wife were charter members of the
Burnington Baptist which was organized June 15 1839. He was the first Clerk and
Treasurer and served in those offices for many years. He was a Deacon and
served on many committees and as a delegate to the Baptist Convention and
Association.
January 19, 1841: Thomas was
appointed as a Justice of the Peace and served until his death. He was elected
to the Board of School Superintendents many times. He served as tax lister and
an election official in the Burnington precinct. Thomas served as a road
overseer when the first roads of Macon County were being laid out and built by
men of the community. He was often given as security for bonds by
administrators of estates, guardians of minors and office holders throughout
the years. He was often a member of the Select Courts and on committees to
settle with administrators of estates.
Hester Parton Welch and son,
William, had died by the time of the 1860 Census. The
Mortality Schedule of 1860
lists their deaths. Hester's death was caused by tuberculosis and William's
death from bronchitis. The account book of Henry Hardin Ray, a carpenter and
storekeeper of the Burningtown community, shows that Thomas paid for 3 coffins,
"one for William, one for wife and one for self." There is no date
for this entry.
The 1860 Census shows that
Thomas Allen, age 13, son of D. H. and Amanda Welch Allen, is living in the
household with his grandfather, Thomas Welch. He is remembered in Thomas's will
written in 1861. "Fourth, I will and bequeath to my grandson, Thomas
Allen, one horse, bridle and saddle, worth One Hundred Dollars, one cow, one
bed and furniture and one rifle gun to be paid to him by Executor when he
attains the age of twenty one years."
Thomas must have died after
a brief illness for his name appears in the December 1860 County Court records
as having been drawn for jury duty at the March 1861 term of Superior Court.
The Burningtown Baptist Church had also appointed him to a committee shortly
before his death. His will which was made on March 21, 1861, two days before
his death, was contested by two of his daughters, Emily Amanda Welch Allen and
Isabel Marianne Welch Drinnon, when it was filed for probate June 10,
1861. The will was
transmitted to the Superior Court to be submitted to a jury. On September 9,
1861, the jury: T. J. Kimsey, R. A. Phillips, A. B. Angel, Andrew Justice, M.
A. Russell, A. Conley, Hugh Elmore, John Elmore, John Ramsey, Peter Davis,
William Patton and F. Barnett, found the will to be the Last Will and Testament
of Thomas Welch. Joseph Wilburn Welch and Louisa Welch Huggins were the chief beneficiaries
of their father's estate. Emily Amanda Allen and Marianne Drinnon were to
receive
the proceeds from the sales
of mountain lands owned by Thomas. His will is a part of his history.
Thomas and Hester were
Charter Members of the Burningtown Baptist Church which was organized June 15,
1839.
MACON COUNTY, NORTH CAROLINA
June 15, 1839
On the day and date above
written, we, the following united Baptist preachers, met at the meeting house
on Burningtown Creek as presbytery, according to the request of a number of
members of our order, for the purpose of examining their strength in order to
become a constitution, which we have done carefully. Therefore, believing that
we have found them possessed with strength and ability, we have constituted
them a church of Christ by the name of the Burningtown Baptist Church. And also
have ordained Brethren Jacob Shope and Thomas Welch to be deacons. 2nd The
church proceeded to appoint Brother Welch as their Church Clerk and Treasurer.
3rd Chose Brother Caler to supply them for the present. 4th Opened the door and
received Disey Lou Allen by experience.

Thomas Welch's death was
recorded in the minutes of the Burningtown Baptist Church on April 13, 1861.
"The church meeting was held at the upper house and preaching was had by
Elder Joshua Ammons and Elder May. The fellowship being called for and found to
exist, the church proceeded to ordinary business in which the obituary notice
of Brother Thomas Welch was read and adopted. Brother Thomas Welch departed
this life March 23, 1861, aged 54 years, 9 months and 5 days." The church
dates differ from the cemetery dates.
LAND:
1835 Feb 18 - James Truitt,
High Sheriff of Macon County, to Thomas Welch of Macon for $501, land of Joseph
Welch and Gideon F. Morris to satisfy a judgment of court for $424, sum
recovered by Thomas W. P. Poindexter. Court commanded sheriff to sell 53+ acres
to satisfy judgment. Advertised and sold the tract on north bank of the
Tennessee to where the Tennessee and Tuckaseegee intersect at sale February 18,
1835. Thomas Welch by his friend, David England, had high bid of $501.

301 - 100 acres on the east side of Burningtown Creek, joining land already

Morrison of the State of Alabama of the second part, witnesseth, that we
parties of the first part have this day bargained and sold and do hereby
transfer and convey for the consideration of Six Hundred ($600) Dollars to us in
hand paid unto the parties of the first part one half of the turnpike road
leading from or near the mouth of the Tuckaseegee River to the Tennessee line
in Poindexter Gap of the Smoky Mountains, which road was chartered by us by an
Act of the General Assembly of North Carolina, passed and ratified the 9th day
of January 1845. We, the said Thomas Welch, Joab L. Moore B. W. Bell and Thomas
Shepherd,
do bind ourselves, our heirs
and representatives and each of them to warrant and defend the title to said
half of said road to said Samuel Pride, John S. Craig, James Barnes, Samuel
Ghormely and Joseph W. Lemon and William Morrison, their heirs and
representatives forever according to said Charter. Witness our hands and seals
