Will of Thomas Shepherd:
In the name of God, Amen, I,
Thomas Shepherd, Senior, of Macon County, North Carolina, being of sound body
and perfect mind and memory, Blessed be God, do this twenty second day of April
in the year of Our Lord One Thousand Eight Hundred and Forty One make and
publish this my Last Will and Testament in the manner following, that is to
say,
First, I give and bequeath
to my beloved son, Joseph Shepherd, a negro woman by the name of Fillis, a
negro girl by the name of Salle and sall also Mariah Rachel, also a negro boy
by the name of Anderson, also a girl by the name of Betsy, another girl by the
name of Mariah, another girl by the name of Manda and Harriett and another boy
by the name of Bob, also Sam.
I also bequeath to my son,
Elijah Shepherd, a negro woman by the name of Jinn, and a boy by the name of
Harry, also a girl by the name of Salle, this is Jinn's youngest child, also a
boy my the name of Will. I also give to my son, Elijah, all the land that I
claim where he now lives (to wit) six tracts that my deed covers.
I also bequeath to my son,
Thomas Shepherd, a negro man by the name of Dick, also Dick's wife by the name
of Vitel, also Vitel's Salle and all her children, and a negro boy by the name
of Leander and a boy by the name of Squire, and a boy by the name of Nelson,
and another Zackery, and Alford, and Jason and Burton. I also will my son,
Thomas Shepherd, Junior, all the tracts of land that myself and Thomas bought
in Co., and also all the land that I have and possess or have any title to in
District No. 10, which land is lying on Cowee Creek and its waters, and is in
different tracts, all of which is to belong to him, the said Thomas.
I also bequeath to my son,
William Shepherd, the following lands (to wit) one tract of land in District
No. 11and Section 1d1, containing 140 acres, also a part of the tract of land
purchased in Co. with myself and George Dickey. I will that Dickey make the
right of my part of that tract to William Shepherd, a negro boy by the name of
Ben, also a boy by the name of Little Dick.
I also bequeath to my
daughter, Nancy Hurst, a negro woman by the name of Sealy, also another woman
by the name of Lucinda.
I also will to Susannah
Bradley, my daughter, a negro boy by the name of Sam, also a negro boy by the
name of Lucinda.
I also will that my son,
Thomas, pay to the heirs of Martin Angel which he had by Rebecca, my daughter,
One Hundred and Fifty Dollars to me paid in some good trade at the country
selling price.
I also will that my son,
Joseph Shepherd, pay One Hundred Dollars to my son, John Shepherd, in some
suitable trade. Also that my son, Joseph Shepherd, pay Elizabeth Wilson One
Hundred Dollars in some suitable trade.
I further will to my son,
Thomas Shepherd, all my part of the stock of all kinds, horses, cattle and
hogs.
And after my funeral charges
and all my lawful debts are paid, I hereby make and ordain my worthy friend,
Jonathan Phillips, and Thomas Shepherd, Jr., my Executors to this my Last Will
and Testament. I have hereunto set my hand and seal this day and date first
above written. Signed, sealed, published and delivered by Thomas Shepherd, Sr.,
the Testator, as his Last Will and Testament in the presence of us who was also
present at the time of signing and sealing thereof.

Know all men by these
presents that whereas The late Thomas Shepherd Senior deceased made & hath
left a last will & Testament disposing of his effects unequally amongst his
children with which some have been dissatisfied now that there by no further
difficulty or contention in the matter we Thomas Shepherd, Joseph Shepherd,
Elijah Shepherd, John Shepherd, William Shepherd, Martin Hurst, Asa Bradley
& Elizabeth Wilson, and by these presents do bind ourselves to make the
following amicable disposition of the matter Viz 1st Thomas Shepherd is to have
all the property left him in Said will by making the following allowance to Asa
Bradley & Martin Hurst To Asa Bradley three tracts of Land two on which
Bradley now lives & one Joining above and to Martin Hurst one Tract of Land
where Elijah Shepherd formerly lived on Cowe also one note on Said Hurst for
$76.50 and to William Shepherd one Tract of Land lying Joining (?) Wm Shepherds
land & a negro boy named Will An Joseph Shepherd is to hold all left him in
the will except the following The Said Joseph Shepherd agrees to let John
Shepherd have five good mules and a good wagon and Thomas Shepherd is to have
all left to him except the following He agrees to give to Elizabeth Wilson a
negro woman named Sal & her two children & a Sorrell horse and all the
others are to have all the property left for them in the will and we do hereby
Covenant & agree that with the foregoing distributions of the effects of
The Said Thomas Shepherd Sen. dec'd we will be content and this agreement shall
on each of our parts forever bar any further litigation on the Subject In
witness whereof we hereunto Set our hands and Seals this 13th day of September
1842

In the name of God Amen I
Edward Wilson of the County of Yancey and state of North Carolina being of
sound mind and memory but having far exceeded through the pleasure of heaven
the number of years usually alloted to men and ____ at my advanced age of
approching desolution do make and declare this last will and testament
commanding my soul to its maker I desire that my Executor hereinafter named
shall provide for my body a decent burial and pay all funeral Expenses together
with my just debts if any Exist against me.
And whereas my four sons
William, John, George, and James and my daughters Lucinda Edney deceased
Received advancements invested in land and whereas my daughters Ceilia Lewis,
Polly McMahan, Sarah Angel Received a negro the two latter of whom without my
consent or appreciation deprived of or having parted with said property I
dispose of all my Right Title and interest in and to said slaves as follows.
I give and bequeath to my
daughter Polly McMahan during the term of her natural life to her sole and
separate use not subject to the control or debts of her husband a negro girl by
name Harriett heretofore Placed in her possession and the increase of said girl
and at the death of my said daughter said girl and increase to be equally
divided between her children share and share alike.
2. I give and bequeath to
the children of my decd. daughter Sarah Angel a negro girl named Winne and her
increase if Ever Recovered, to be divided equally between them share and share
alike.
3. I give and bequeath to my
daughter Ceilia Lewis during the term of her natural life a negro girl, Jane
now in her possession together with the increase of said girl Jane and at the
death of my daughter Ceila said girl Jane and her increase I give and bequeath
to the four children of my daughter Cecila.. Rufus, Oscar, Louisa (Woodfin) and
Mary to be equally divided between them share and share alike and in case any
one of the four die before their Mother leaving no children then the share of
him or her to go over to his or her surviving Brother or brothers sister or
sisters.
Having made there
dispositions and taking into consideration that my daughter Lucinda Edney and
her family have been advanced during my lifetime at least one thousand dollars
additional over and above the advancements received by my other children with
the Exception of my daughter Cecilia Lewis and family by whom a similar
advancement has been Received,, and wishing to make an Equal division of all my
worldly goods and chattels lands and tenements among my children and the
descendants of my deceased children Representing their parents. I dispose of
all my Earthly Effects as follows.
I wish and will that my
Executors here inafter named shall sell all the Estate remaining at my death
Perishable Personal and Real of whatever kinds or nature and whether in
Possession or Expectancy both legal and equitable and whether specifically
mentioned here in or not including all the crops that may be on hand household
and kitchen furniture. farming utencials wagons stock of all kinds sheep cattle
horses hogs all my lands where ever situated The home place and all other
tracts all the negros of
which there are some
nineteen. 1. Gabe 2. Jacob 3. Tilly and her children 4. Tempie 5. John? 6.
Clerisa 7. Rob 8. Neely 9. Jordin 10. Andy 11. George 12. Madison (2 words
unreadable) 13. Eliza 14. Hester 15, John 16. Millard 17. baby Clerissa's
children 18. Jacob 19. Columbus. together with all their increase. I wish and
will futher that ______ Executors collect all debts owing to me all notes and
accounts and _____ Proceeds of sales and collections after all expenses cost
and _____settlement are defrayed shall constitute ____ to (Bottom line of page
unreadable). Charges against my daughters Cecila and the children of my
deceased daughter Lucinda as a clous? for illustration dispose my Estate amount
in value to twenty two thousand dollars then add two thousand. each of my sons
and also my daughter Polly McMahan would receive three thousand where as my
daughter Cecila would receive two thousand only and the children of my deceased
daughter Lucinda a like sum.
With this Explanation and my
Entire Estate converted into money or its Equivolent with the Privilege to my
Executors of biding at the sale and to the Entire value two thousand dollars
added as afore said I give and bequeath there of and thereout as follows.
1. To my son William one
Eighth a full part or share to him and his heirs forever.
2. To my son John one Eighth
a full part or share to him and his heirs forever.
3. To my son George one
Eighth a full part or share to him and his heirs forever.
4. To my son James one
Eighth a full part or share to him and his heirs forever.
5. To my daughter Cecila
Lewis one Eighth less or deminished by one thousand dollars to be hers and at
her disposal absolutely for ever.
6. To my son James One
Eighth a full part or share in trust to pay to my daughter Polly McMahan during
the term of her natural life upon her sole and separate receipt the annual
interest of said one Eighth and at her death the Principal together with any
interest accrued and unpaid to be devided Equally among her children and the
representatives of any deceased child or children as a _____or _____ to stand
in the place of any so deceased parent.
7. To the children of my
deceased daughter Sarah Angel one Eighth a full part or share to be devided
Equally among them share and share alike and as in item number 6.
8. To the children of my
deceased daughter Lucinda Edney. One Eighth less or diminished by one thousand
dollars to be devided among them share and share alike. Those of them who are twenty
one years of age or married to Receive there respective shares at the first
division of the Proceeds of my Estate and since several of them are minors my
will and desire is that my son James is hereby constituted guardian of all such
to have and to hold the custody and guardaniship both of there
Respective persons and
portions until they severly arrive a the full age of twenty one years and he
hereby Empowered to expend in his discretion in the Education of Each and all a
portion or the whole of the dividend to which such minor may be Entitled and I
especially commend to his care my little grand daughter Jane,,
And I hereby constitute and
appoint my sons James, William, and George Executors of this my last will and
testament in witness where of I the said Edward Wilson do hereunto set my hand

Last Will and testament of
Joseph Shepherd
In the name of God Amen I
JOSEPH SHEPHERD of the County of Yancey and state of N. Carolina being of Sound
mind and memory but considering the uncertainty of my Earthly existence do make
and declare this my last will and testament in manner and form following,
towit:
First that my Executors
hereinafter named shall at my decease provide my body a decent burial suitable
to their wishes and pay all funeral expenses together with my just debts
howsoever or to whomsoever owing out of the first money that shall come into
their hands as a part or parcel of my Estate
Item first I give and
bequeath to my dearly beloved wife MARGARET A. SHEPHERD one thousand dollars in
cash or cash notes one young ----- horse or a Horse worth one hundred dollars
and all the household furniture that is claimed by her at this time and on
condition that she wishes to remain in Burnsville that she is to have the house
and lots owned by me and known as the Adams lots adjoining the buildings in
lieu of the thousand Dollars during her natural life as a homestead & one
hundred dollars in cash.
Item second I give and
devise to my Eldest Daughter JUNE AMANDA BROYLES and her bodily children the
Place where I now live including the following Boundary of land towit Beginning
on a chestnut standing on the top of the main Nob above the graveyard known as
Scotts Corner & runs a southeast course down the top of the ridge with
NATHAN YOUNGS line to the corner of the town Tract thence a south course with
the town Tract to the main road then with said Road a West course to Scotts old
line then south course with Scotts old line to a white oak on A. JOBES corner
then a west course with the fence & Jobes line to a stake at the crop fence
then a north course with the crop fence to the road crossing the road to the
end of the crop fence on the North side of the road & then with the crop
fence a direct course to the top of the main Ridge then runs down between my
old Place and the Sol Ray Place then a north course with the top of said Ridge
to the beginning to have and to hold in fee simple forever together with my
Negro girl RACHEL & her two children HARRIETT & ELBERT to have and to
hold forever unto her & her children.
Item third I give and
bequeath to my second daughter JULIA ANN SHEPHERD the house and all the town
lots joining known as the Adams Property together with my Mulatto boy MILES,
MARIAH, NEWTON & JOHNSON together with the household and kitchen furniture
claimed by her together with nine hundred dollars that I first bequeathed to my
wife if my wife should make choice to live on the lots named in her Item
together with one horse worth one hundred dollars & two cows & calves
of her choice of my stock to have and to hold to her and her children and if
she should die without children or bodily heirs my will is that her property
bequeathed by me be equally between her sisters and their children.
Item fourth I give and
bequeath to my third Daughter CORDELIA P. ADAMS the following boundary of land
towit beginning on a white oak the old Wilson Corner at the South East end of
the meadow and runs a North Course on the A. JOBES line & the line of the
tract set forth in the Item second to the top of the nob at the Chestnut Corner
then a north Westardly course with the tope of the ridge to the top of the
Green Mountain then a westardly course with the top of the mountain to Hortens
line then down the Ridge with Hortens line to a white oak corner of the ray
tract then down the meander of the branch to the Pine
Swamp branch to J. W.
GARLANDS old line then East with the crop fence to the beginning to have and to
hold unto her and her children in fee simple forever together with my boys
MANSON & JULUS together a note of twelve hundred Dollars with interest on
THOMAS GARDNER, deceased to have and to hold unto her and her children forever.
ITEM fifth I give and
bequeath to my fourth & youngest Daughter TERRISSA E. REYNOLDS all my town
lots with their improvements in the East side of the Cross Street and North
side of the Public Square in Burnsville to have and to hold unto her & her
bodily children in fee simple forever together with a Sixty Acre tract of land
including my Improvements on the top of the Green Mountain and also AMANDA,
TOM, MILLY & ALFORD my Slaves to have and to hold unto her & her bodily
heirs forever.
Item sixth My will and
devise is that the residue of my property & Estate of all and every
description not named in the foregoing Devise be Equally divided among my four
Daughters named in the foregoing Devise, the Debts of all descriptions to be
collected by my Executors & the residue of my Property to be sold at Public
sale and the whole to be equally divided among my four daughters & their
bodily children as aforesaid after paying all lawful expenses of sales
collections and providing for making good the foregoing devises.
I hereby constitute and
appoint my trusty friends and sons in law ISAAC M. BROYLES & JOHN. D.
REYNOLDS my lawful Executors to all intents and purposes to execute this my
last will and testament according to the true intent and meaning of the same
and every part & --------- thereof hereby revoking & declaring utterly
null & void all other will & testaments by me made. In Witness whereof
I the said JOSEPH SHEPHERD do hereunto set my hand and seal this 9th day of
October 1857.

Cowee Baptist Church Book
Volume 1: "The Constitution of the Baptist Church at Cowee in the Cherokee
Purchase, Macon County, North Carolina, March 15, 1828. The presbytery
consisting of Elders Humphrey Posey and Stephen White, met at Cowee by request,
and after worship and a discussion on the subject of the meeting, fifteen
members were found in readiness for a church. all of them members of the church
at Franklin." These fifteen charter members were: Samuel Rose, Levi Truit,
George Caler, Peter Mason, Joseph Welch, Jacob Caler, Lucrecy Rose., Susanah
Truit, Hannah Dickey, Jaly Hibberts, Polly Edwards, Sarah Mason, Mary Mason,
Roda Russell, and Sarah Fortune. On the same day, Samuel Rose and Levi Truit
were examined and set apart by ordination to the office of deacon. George F.
Caler was elected first clerk and treasurer. Humphrey Posey was elected as
pastor on June 14, 1828.
At its organizational
meeting the church set the third Sunday and preceding Saturday of each month as
its regular meeting time and agreed that meetings would be held at Caler
Schoolhouse, located at the forks of the road at the mouth of Caler Creek and
Cowee Creek.
On June 26, 1830, George F.
Caler, Elijah Shepherd and Samuel D. Bryson were appointed trustees and
were instructed to locate
and purchase a spot of ground on which to build a church. The land was deeded
to the church by Samuel
Decater Bryson and was located on a knoll in front of the present church
building. The first building
was a log structure which was used until 1868.

aforesaid county and State being of sound mind but considering the uncertainty
of my Earthly existence do make and declare this my last will and testament in
manner and form following, that is to say:
First My Executor
hereinafter named shall give my body a decent burial suitable to the wish of my
friends and relations and pay all funeral expenses together with all my just
debts out of the first money which may come into his hands belonging to my
estate.
Second I give and bequeath
unto my daughters LOUISA RAY, HASEY YOUNG, CELIA JANE COX, DORCUS REYNOLDS,
SALLIE KATE BYRD and my sons J. G. WILSON and my grandson THOMAS V. SINGLETARY
and my grand daughter MITHE? O’BRINE to be equally divided between them all my
estate whatever it may consist at the time of my death and more particularly

Georgia, Rabun : The court of Ordinary of said county, The
Petition of Thomas Carter County of said county and state respectfully showeth
to the court that his brother James W. Carter, late of said county and state,
departed this life in said county and state testate on the 6th Day of August 1880 having executed and
published his Last Will and Testament
in the presence of witnesses who reside in said county which
said will your Petitioner
now brings into court and prays that the same be admitted to Probate in Common
Form in terms of the Law Your Petitioner will ever pray this August 10th 1880.

Aforementioned
State of Georgia : In the Name of God, Amen. I, J. W. Carter of the county of Rabun and Rabun County State of
Georgia, being of sound mind and memory and desirous to settle my worldly
affairs while I have strength so to do, do make and publish this my Last Will
and Testament hereby revoking all wills
by me at any time heretofore made and 1-First, I (give and bequeath this
stricken out) commit my Soul to God who gave and my body I desire to be buried in a decent Christian manner suitable
to my
condition in life.
Item 2-I desire and direct
that all my just debts be paid without delay
by my Executors hereinafter (named, stricken out) appointed as I am (not, stricken out) unwilling my creditors
should be delayed in their rights
especially as there is no necessity of delay.
Item 3d-I give and bequeath
to my beloved wife Jane Caroline during
her natural life the following described tracts or parcel of land the
same being parts of lots of land Number (147) One hundred and Forty seven and One hundred and Sixty two (162) in
the Second district of Rabun County
bounded as follows that part off of (147) One hundred and Forty seven bounded
three deeds from Jesse Carter will more fully
show and set forth or in
other words all the lands I own, claim or possess of said Lot (147) in said 2nd
district and all that part of lot of land Number (162) One hundred and Sixty
two purchased from J. B. Dillard which deed from said Dillard will more fully
(show represent, stricken out) set forth and show containing in all one hundred
and
twenty (or 30) five acres be
the same more or less with all the rights, members and appertenances to said
lot of land in any wise belonging and after the death of my said wife the said
lands and premises to be sold and the proceeds to be equally divided between
the chve in the second district of Rabun County containing two hundred and
fifty acres more or less and lot 79-Seventy nine in the first district of Rabun
County containing Four hundred and
Ninety acres (490) and I do hereby authorize and empower (a second
"empower" stricken out) my said wife with advise
and consent of my other
Executor to dispose of said last named lots of land for other lands adjoining
or contiguous to my home plantation on which I now live.
Item 4- I give and bequeath to my beloved wife for
and during her natural life or until my
youngest child comes of age then or during
her widowhood the five Negros, one William twenty years old, girl Mary sixteen years old, boy Thomas thirteen
years old, boy Jesse five years old, Roxey Ann three years old and the said
Caroline Carter and
my son G (orJ) W. Carter are
hereby fully authorized and empowered to sell any two of said negros and
dispose of the proceeds of said sale in
the purchase of lands and then at the death of my said wife or her intermarriage
again, all the above named are to be sold, or should it be deemed best, divided
equally between all the children of the said J. W. and Caroline Carter share
and alike.
Item 5th-I give and bequeath
to my beloved wife all my household and kitchen furniture to dispose of as she
shall think best at any time and at her death should any be left she has the
right to dispose as she pleases.
Item 6-I also give and
bequeath to my beloved wife all my stock of horses, mules, cattle, hogs, sheep
and plantation and farming tools, wagon and buggy and gearing for the same of
every kind for and during her natural life or widowhood and should any of the
children of the said J. W. Carter and Caroline Carter marry during the lifetime
or widowhood of the said Caroline Carter, she shall have the power and
authority to give them such
portion of stock and household and other furniture as she may (desire, stricken
out) deem right and keep an account of the value of the property thus given and
the amount thus given shall be deducted from their proportional share in the
final distribution of said Estate.
Item 7th-It is my will and
desire that if my wife Carter and my other Executor shall dispose of lots of
land and purchase other lands and also sell the above mentioned Negros and
purchase other lands then in that case the said lands sold after the death of
my said wife or should she die before the youngest child should come of age
then when said children come of age and the proceeds equally divided between
the children of the said J. W. Carter and Jane Caroline Carter or if it is
deemed best
said property shall be
equally divided between said Legatees without sale.
Item-I give and bequeath to
my said wife all the money, notes and
accounts I am owed (?) possessed or own subject to be disposed of at the
will of said wife.
Item-I do hereby constitute
and appoint my beloved wife Jane Caroline Carter Executor and my worthy
(Brother, looks stricken out) friend Thomas Carter Executor of this my last
will and testament this 2ond June 1864.

remembers going to his grandfather's house. He said the kitchen and living room
were wallpapered with stock certificates! He thought they were from Kansas
Power and Light Co., and he said that at the time, they weren't worth anything,
so his grandfather used them for wallpaper. Several years later, after William
A.'s death, they supposedly were worth quite a bit, but we don't know how

Notes for LEVI W. WILSON:
Levi and Leona Wilson
established a farm on Indian Creek about a mile south of Paint Gap. Paint Gap
was the name of the post office located in a general store at the intersection
of Indian Creek Road and Prices Creek Road. Both the store and post office are
now closed, although the old building remained until 1989.
The original home was a
two-room cabin close to the creek. It was broad-axed by John W. Shepherd,
Leona's Brother, who lived across the road from them. A new, and present house,
was constructed about 1912.
Levi and Leona had eleven
children. Many of the children left the Yancey County area for economic
opportunities when they came of age. Levi and Leona lived on the farm all their
lives. Levi occasionally worked at a lumber mill to augment the farm's income.
The mill belonged to the Auburn Lumber Company, and they cut birch for
furniture.
Both Levi and Leona are
buried at the family cemetery, which is on a hill behind their home.
