Lewis Tucker’s Will

In the Name of God a men I Louis Tucker of the County of Pope and State of Arkansas being weak in body but of sound and perfect mind and memory blessed be Almighty God for the same do make and publish this my last will and testament in manner and form as follows that is to say first I give and bequeath unto my beloved wife Mary Tucker the house where I now live and all the household furniture thereunto belonging Likewise one bay mare Likewise the East half of the north west fractional fourth and the north west quarter of the north west fractional quarter of Section No. thirty one in Township No. eight North or _______ No twenty west containing one hundred and thirty nine acres and four hundredths and one Negro boy named Edmond and all the rest of my personal property I give and bequeath unto my said wife to have and to hold so long as she shall live in witness whereof I have hereunto set my hand and seal the 13 day of September 1845

In vacation of the Probate Court of Pope County Octr 16th 1845

Be it mentioned that on the 16th day of October A. D. 1845. Before me John R. Horner, Clerk of the circuit court and Ex officii Clerk of the Court of Probate within and for the county of Pope aforesaid, Personally came and appeared George W. Petray and John B. Curtis to me personally made known and produced here before me for probate the above and foregoing instrument of writing purporting to be the last will and testament of Lewis Tucker Deceased of said county aforesaid and to which instrument of last will and testament aforesaid their names are appended as attesting witnesses and to which will no executor isleft. Who on oath deposeth and sayeth that the said Lewis Tucker on the 13th day of September (viz 1845) the year of our Lord one thousand eight hundred and forty five did sign, seal, publish, and declare in their presence the said instrument so dated to be his last will and testament and requested them to sign their names thereto as such attesting witnesses and that they in his presence and in the presence of each other did sign and subscribe their names thereto as by him requested on the 13th day of September A. D. 1845 and further that the said Lewis Tucker at the time of _______ signing & sealing said instrument or will to the best of their knowledge and belief was in sound and disposing so help them God.
