Wages under this Agreement will be increased, and fully retroactive, as follows:
Effective July 1, 2007 3.0 percent
Effective July 1, 2008 3.0 percent
Effective July 1, 2009 4.0 percent

Article 17, “Insurance Contribution”

Effective July 1, 2009, all employees who enroll in the Employer’s approved Health Maintenance Organization (HMO) medical insurance plan shall pay 12.0 percent of the cost of the Medical Expense Benefits portion, with the Employer paying 88 percent. Effective July 1, 2009, part-time employees will be required to contribute 50 percent of the cost of the HMO medical insurance plan they choose.

A new Article 38, SUCCESSORS AND ASSIGNS, shall be added to the Agreement to read:

(a) The Employer will continue to recognize the Union as the exclusive bargaining agent of all employees covered by this Agreement and will continue to be bound by the terms of this Agreement as long as the employees covered by this Agreement remain under its jurisdiction. If at any time and for any reason, jurisdiction over employees covered by this Agreement is transferred to any other entity, including but not limited to any other agency or subdivision of the Commonwealth of Massachusetts, such entity shall be bound to recognize the Union as the exclusive bargaining agent of all employees covered by this Agreement and be bound by the Agreement. The Employer serves as guarantor of the terms of this provision, and shall be responsible for any failure in the observance of its terms, whether or not such failure is beyond its control.
(b) In the event of a change in the ownership, management, operation, or any other transaction, that results in the transfer of jurisdiction over the employees covered by this Agreement to any other entity, the Employer guarantees that no such employees shall be terminated for non-disciplinary reasons, laid off, or otherwise involuntarily separated from employment, for at least one calendar year following such change.
