On 6th April 2K, the FiA World Council took a decision to transfer the sporting power hitherto vested with the FMSCI to MAI with immediate effect.
However, the FMSCI is still to receive any official communication in this regard. Just like us, the FMSCI has also only received the Press Release, the bottom of which read "For Media Information only, no REGULATORY VALUE".
The FMSCI waited till 12 April 2000, expecting a written official confirmation on the same, but in vain. The FMSCI then decided to write to the FiA on the same. Accordingly, Mr.K.D. Madan, President FMSCI sent two letter (click here) to the FiA on the 12th instant, for which, we understand, the FiA is yet to reply.
While this is the case with the FMSCI, the MAI is writing letters to all the FMSCI Member Clubs to get support for the MAI.
SURPRISINGLY, THE MAI SENDS A LETTER RECEIVED FROM MR.PIERRE DE CONINCK, SECRETARY GENERAL FIA (SPORT) WHICH CLEARLY STATES THAT THE WORLD COUNCIL WHICH MET ON 6TH APRIL DECIDED TO TRANSFER THE SPORTING POWER FROM FMSCI TO MAI. THIS LETTER IS ADDRESSED TO MR.NAZIR HOOSEIN, PRESIDENT MAI.
It is a puzzle, when the FiA can send a letter to MAI on the above lines, what prevented them to send a similar letter to the FMSCI, while just the address had to be changed in the letter. Most probably, Mr.Nazir Hoosein would have threatned Mr.Coninck to send a letter like this to MAI so that he can use the same to get the support of the FMSCI Member Clubs and the Government of India. But FiA still maintains its silence when it clearly knows that they have not sent an official communication to the FMSCI. It simply goes to show that FiA have clearly bent backwards to help Mr.Nazir Hoosein, while are adamant even to follow the natural justice when it comes to the FMSCI. PROVING FiA is nothing but (MA)FIA.
The decision of the World Motor Sports Council is ultra vires the powers of the Council as per FMSCI. If the FiA is clear in their minds that what they have done is legal, even if the FIA Secretariat had slipped up on this issue, Mr.Max, in his enthusiasm, would have definitely himself typed a letter and would have sent to the FMSCI. But have not done that WHY ? Particularly when they have sent a letter to MAI.
We were all expecting (and I was actually ready to go to Mumbai) that Mr.Nazir Hoosein would call for a press meeting, but he did not WHY ? Most probably he also knows that what FIA has done is wrong.
But then why the FiA has acted this way. A deep thought on this clearly reveals, that Max knows pretty well that what they are doing is wrong. In spite of this, to help his best friend Mr.Nazir Hoosein, he pressurised 13 people on the Council to vote for this. This would give Mr.Nazir Hoosein some time to try and fool as many member clubs as possible and also fool the Govt. of India to get the sporting power. Once he could achieve this, then the matter would be put up before the General Assembly, at which time, Mr.Nazir Hoosein would conveniently tell that he has the support of so many clubs and he has also got the Govt. of India's recognition. Then the General Assembly would have no choice and Max can also boldy face the General Assembly.
Max was expecting that by his pressure tactics would get the unanimous decision but fortunately, people above board decided not to be a part of this erroneous decision, hence abstained. This is the first blow to Max.
The second is the letters from the FMSCI (click here) a copy of which has been sent to all the FIA member clubs, it is learnt, the FMSCI is yet to receive a reply. Max did not expect this. Max was thinking that FMSCI would become silent till such time that his good friend Mr.Nazir Hoosein fools every body and get the required documents. When FMSCI sent a letter to FiA quoting all the relevant Article in FiA Statutues which FiA had gone against, Max was caught in between. He doesn't know what to do. If he had known, the FiA would have sent a reply by now.
The fact is that by now all the 113 ASNs in the World would have come to know of the way the FiA works. When the entire world is fighting for their rights, what is wrong in the FMSCI fighting for their rights. But the FiA still now has been thinking that when Max says some thing, whether it is right or wrong, all the ASNs would go by him, shedding out their self-respect. But Max by now should have realised that the ASNs will go along only with the truth and not with the high handness of the FiA. What has happened to the FMSCI today, is likely to happen to any other ASN in the world tomorrow and the ASNs would have realised this by now. It is high time that all the ASNs in the world put an end to this irresponsible, dictatorial and high handness of the FiA. After all FiA needs the ASNs more than the ASNs need FiA.
Now coming to the Indian Motor sports scenario, the MAI has been writing letters to all the FMSCI Member Clubs, quoting some articles in the FIA Sporting Code (in short threatening them) to join the MAI, otherwise the events held by them would be illegal. Is it so ?
Definitely it is not the case. The Member Clubs are very much aware that what they are running is a National event which does not require, by any stretch of imagination, a permit from the FIA or MAI for that matter. All the organising clubs knows that FMSCI is the only body recognised by the Govt. of India to control and promote motor sports in India, which gives FMSCI the power to issue permission to any organising club to conduct motor sports events with in the territory of India. Then why MAI is writing like this. Mr.Nazir Hoosein pretty well knows that the member clubs of the FMSCI is aware of everything that has happened. If he writes a simple letter, the Clubs will not join him. Following his guru "Max Mosley", now he is also trying to threaten the member clubs to join MAI quoting articles from the FIA Sporting Code. It must be remembered that the Motor Sports in India was alive, when FMSCI was not there. Developed when FMSCI came in to existence. What FiA, or Mr.Nazir Hoosein has done to the Indian Motor Sports except that they are trying to disrupt the sport. When Mr.Nazir Hoosein was running the so called Himalayan Rally, how many of us aware that when some other clubs like KMSC, Bangalore wanted to run an International event, the same Mr.Nazir Hoosein tried to block this as he does not want any other International event to take place except the Himalayan Rally. Now FiA dictates to us that he is going to promote motor sports, Oh! that's really great!!!! Who is FiA to come and dictate to us. The Press release says that FMSCI failed to comply with the full restructuring. Yes Mr.Leon wanted Mr.Nazir Hoosein to be the President, his chamchas to be on the Council. who is Mr.Leon to come and tell us that who has to be the President. Fortunately, they did not say that who should be the SWEEPER in the FMSCI Office? This is a real threat to the democractic setup of the FMSCI and the Country. Even after 50 years of independence, it is rather unfortunate that some body else is dictating on what we have to do ? If we allow this to continue, tomorrow thay will say who should be the winner of the rallies too ? is this what we want ? is this the objective of the FiA. If so we donot require FiA at all.
In this juncture, I really pity the competitors in particular the privateers, who spend their hard earned money in motor sports. They are confused. They do not know whether the motor sports will be there or not. Do not know where to contact. Who is responsible for this confusion. The MA FIA.
Last 15 days could have been the most quiet period in the history of Indian Motor Sports as for as the events are concerned. Competitors do not know what to do ?
The World Motor Sports Council decide that MAI will be the sporting power holder, promptly sends a fax to MAI to that effect, keeps FMSCI in the dark. The FMSCI is in dilema, as to what is their status now, whether they are members of the FIA or not, as no official communication from the FiA. The FIA web site had FMSCI as members till yesterday, only since yesterday, MAI had become the ASNs. When the FiA is so confused about the whole issue, how do you expect a competitors to be.
The MAI is not a member of the FiA but an ASN for India. Ridiculous. MAI does not hold the Government of India's permission. Inspite of this they are ASN for India, while in the last AGM, the FiA had categorically extended the probation period of an ASN for not able to get their Government recognition. But magnanimously granted the same to MAI, who is not even a member of the FIA. Double Standards.
In short, the FiA had taken not
only the Indian Motor sports and the entire Indian motor sporting franternity
for granted, but also has grossly violated their own statutues to please
one individual and by which had taken all the ASN's in the world for granted.
It is high time that FiA realises this, or the world ASN's reiterate that
FiA needs the ASN's more than the ASN's need FiA and teach FiA a good lesson
that FiA does not try to unnecessary trouble the ASN's if they cannot guide
them.
