Introduction: The United States of America is a sovereign nation and what is termed a "legal entity". Legal entities are empowered to own, buy and dispose of property, conduct business and make contracts in the marketplace and sue or be sued in court. In comparison, the Government of the United States is a non-entity. Examples of non-entities are pets, automobiles, buildings, bank accounts, statues and properties. A non-entity does not own, buy or dispose of property, does not make contracts and cannot sue or be sued in court. While a legal entity can be sued, a sovereign nation cannot be sued unless the opposing party is given permission. For various reasons, Congress has passed certain laws permitting the United States to be sued in court in certain instances.
Sometimes acts of the Government are imputed to the Sovereign. These acts must be authorized by law because the Government is not permitted to do anything unless authorized by the Constitution and Laws. An example of government acts imputed to the Sovereign are treaties with foreign countries. Of course, these imputed acts must be for the benefit of the United States and not acting against the United States to stay within the Constitution and Laws.
