06/5.       MATTERS ARISING

06/5.1.         Vide 05/44: Request for e-mail notification of receipt of allotment tenancy termination forms  and new allotment tenancy agreements

06/5.1.1.        Members were informed that all allotment representatives were receiving e-mail notification of the receipt of allotment tenancy termination forms and new allotment tenancy agreements that related to their particular site.

06/5.2.         Vide 05/45.3: Request for removal of rubbish at Dellfield

06/5.2.1.        Diana Reay confirmed that although the rubbish had been removed, allotment tenants were continuing to deposit rubbish.  She said that this included an asbestos water tank that she promised to move to a safe storage area on site.  Action: Diana Reay.

06/5.3.         Vide 05/45.3: Letter to tenants requesting them to refrain from using allotment boundary fencing as trellis

06/5.3.1.        Members were informed that a suitable letter had been written to all tenants. 

06/5.4.         Vide 05/47.3: Request for the small gate at Butts Meadow allotments to be welded shut

06/5.4.1.        It was decided to deal with this matter under agenda item 06/12.4.

06/5.5.         Vide 05/47.3: Request for Dacorum Borough Council’s Shredder to be made available for use at Butts Meadow Allotments

06/5.5.1.        Dennis Hallam confirmed that Dacorum Borough Council had supplied their shredder and that it had proved to have very useful.

06/5.6.         Vide 05/48: Letter to Frank Cooper & Son expressing concern regarding the quality of their contracted maintenance work at Sunnyside Allotments

06/5.6.1.        Members were advised that such a letter had been written to Frank Cooper & Son and that another Committee of the Town Council had dealt with the matter.

06/5.7.         Vide 05/49: Letter to all allotment tenants regarding the problem of bonfires

06/5.7.1.        Members were informed that a suitable letter had been written to all tenants.  At the meeting a paper prepared by Angela Wheeldon was handed to the Chairman and it was agreed that this paper would form the basis of an agenda item for the next meeting.  Action: Assistant Town Clerk.

06/5.8.         Vide 05/50: Recommendation to Full Council regarding the future tenanting of allotments to persons outside of the parish of Berkhamsted

06/5.8.1.        Members were informed that the Town Council had resolved that allotment plots on all four of its sites would, in future, only be let to residents of the parish of Berkhamsted.  Angela Wheeldon stated that this meant that this new rule would not be applied retrospectively.

06/5.9.         Vide 05/56: Survey of asbestos on all allotment sites

06/5.9.1.        Members were informed that such a survey had now been undertaken.

06/5.10.     Vide 05/56: Letter to all allotment tenants requesting that no asbestos, in any form, be brought onto allotment sites

06/5.10.1.   Members were informed that a suitable letter had been written to all tenants.

06/5.11.     Vide: 05/58: Letter to James Richards declining his request for a replacement shed

06/5.11.1.   It was decided to deal with this matter under agenda item 06/10.4.

06/5.12.     Vide 05/58: Letter to Mr Ian Johnson notifying him of the Town Council’s decision regarding works to the oak tree located on his allotment

06/5.12.1.   See agenda item 06/10.4.

06/6.       ALLOTMENT MANAGEMENT TEAM CONSTITUTION

06/6.1.         Members noted the paper circulated with the agenda detailing the Allotment Management Team Constitution adopted and approved by the Town Council on 30th January 2006 (Full Council minute 08/06).  It was agreed that the only amendment that the Allotment Management Team would recommend that the Town Council make to this constitution was that the comma after the word “Berkhamsted” in paragraph eight of the text be removed.  Action: Town Clerk.

06/6.2.         The Assistant Town Clerk was asked to include an item on the next agenda to discuss the allotment strategy.  Action: Assistant Town Clerk.

06/7.       FORMAL CLARIFICATION OF THE MEMBERSHIP OF THE ALLOTMENT MANAGEMENT TEAM

06/8.       ALLOTMENT INCOME & EXPENDITURE VARIANCE ANALYSIS: 01/04/05 TO 31/01/06

06/8.1.         Details were noted by members.

06/9.       LIST OF VACANT ALLOTMENT PLOTS (ALL SITES)

06/9.1.         Details were noted by members.

06/9.2.         Angela Wheeldon and Freda Earl agreed to meet Councillor Betty Patterson, chairman of the Town Council’s Environment Committee, to discuss the possible recategorization of certain allotment plots on Sunnyside New allotments.  Action: Angela Wheeldon, Freda Earl and Betty Patterson.

06/10.  DELLFIELD ALLOTMENT

06/10.1.     List of current tenancies

06/10.1.1.   E-mailed to chairman & allotment representative only

06/10.2.     List of tenants to be given one month’s notice of automatic eviction due to failure to keep their plot cut or cultivated

06/10.2.1.   No letters of this nature were requested to be sent to any tenant.

06/10.3.     Site Representative’s Report

06/10.3.1.   Diana Reay asked if the Town Council could arrange for that part of the Ash Tree growing above ground on plot DF-G to be cut down and removed from site.  Diana Reay stated that she would deal with the tree stump herself.  Action: Town Clerk & Diana Reay.

06/10.3.2.   Diana Reay stated that a notice board displaying a ‘no public right of way’ sign is required on the eastern entrance to the site.  She said that such a sign should not be fixed to the gate as it is routinely removed.  Action: Town Clerk.

06/10.3.3.   Members requested that a quotation be obtained for the cost of replacing the existing three foot high south east boundary fence (which runs from the south-east entrance gate up to Normandy drive) with a combination of a six foot fence and a Holly hedge.  Action: Town Clerk.

06/10.3.4.   Members requested that a quotation be obtained for the cost of installing a holly hedge along the Dacorum Borough Council owned fence on the south east boundary of the site (which runs from the south east entrance gate down to the railway line).  Action: Town Clerk.

06/10.4.     Oak tree on plot DF-12

06/10.4.1.   Details contained in Mr Johnston’s letter were noted by members.

06/10.5.     Petition from the tenants of Dellfield Allotments requesting improvements to site security

06/10.5.1.   Freda Earl agreed to firstly liaise with Diana Reay and then prepare a letter to be sent to Mr Surridge in response to his petition.  Action: Freda Earl/Town Clerk.

06/10.5.2.   Members requested the Assistant Town Clerk ascertain the cost of obtaining two motorcycle style combination locks and chains (which could be made to have identical combination numbers) so that they could be used to lock both entrance gates.  Action: Assistant Town Clerk.

06/10.6.     Rubble & litter being deposited on the Allotment

06/10.6.1.   Diana Reay agreed that in future she would arrange for any rubble that is deposited on the allotment to be used to fill ruts in the central roadway.  Action: Diana Reay.

06/11.  SUNNYSIDE OLD AND SUNNYSIDE NEW ALLOTMENTS

06/11.1.     List of current tenancies

06/11.3.     Site Representative’s Report

06/11.3.1.   Details of Bruce Jones report was noted by members.

06/11.3.2.   Bruce Jones was handed a list of grass cutting dates at the meeting.  He asked if Frank Cooper & Sons could be contacted to see if it was possible to change the grass cutting scheduled on 7th August so that it takes place on or around the 14th August.  This would enable the grass to be cut that much closer to Sunnyside Allotment Societies open day taking place on 20th August.  Action: Assistant Town Clerk.

06/11.3.3.   It was agreed by members to open all allotment sites for visitors during National Allotment Week.  National Allotment Week runs from 14th August to 20th August 2006.  Dennis Hallam & Diana Reay agreed to consult their tenants to see if they wished to actively participate in this event.  Action: Diana Reay, Dennis Hallam, Jean Hallam and Bruce Jones.

06/12.  BUTTS MEADOW ALLOTMENT

06/12.1.     List of current tenancies

06/12.2.1.   No letters of this nature were requested to be sent to any tenant.

06/12.3.     Site Representative’s Report

06/12.3.1.   Dennis Hallam informed members that since the north-west (recreation ground) boundary gate has been locked site security has improved and vandalism is no longer a problem, probably because there is now no through way through the allotments.

06/12.3.2.   Dennis Hallam stated that the straining wire on the fence recently installed by DTTS Ltd needs attention.  Action: Assistant Town Clerk.

06/12.4.     Improved site access to Butts Meadow Allotments

06/12.4.1.   Members discussed this issue and Dennis Hallam stated that the current site access would not be a problem provided the surface of the existing allotment access road could be improved.  It was agreed adding hardcore/rubble to the access road would solve the problem.  Dennis agreed to include a request in the next Butts Meadow Allotments Newsletter asking tenants to supply stones/hardcore to help build up the road.  Action: Dennis Hallam.

06/13.  FUTURE USE OF DACORUM BOROUGH COUNCIL’S CHIPPER

06/13.1.1.   Dennis Hallam reported that being able to use Dacorum Borough Council’s chipping machine had proved very successful.  It was agreed that a request should be made to Dacorum Borough Council to ask if they would provide the chipper again sometime in the future, but only when the ground was dry due to problems accessing the site in wet weather.  Members agreed that Allotment Site Representatives should advise the best time of year at which to use the chipper in future.  Action: Diana Reay, Jean Hallam and Bruce Jones. 

06/14.  ISSUES RELATING TO THE SUPPLY OF ALLOTMENT WATER TO TENANTS

06/14.1.     Contingency plans for a drought this year

06/14.1.1.   The Assistant Town Clerk was asked to write to Three Valleys Water firstly to ascertain their position regarding siphoning of water and the use of hose pipes given the imminent hose pipe ban,  and secondly whether the allotments come under the classification of horticultural land use.  Action: Assistant Town Clerk.

06/14.2.     Long term water supply policy

06/14.2.1.   Advice for allotment tenants in a time of water shortage

Bruce Jones agreed to provide the Town Clerk with information that could be incorporated into a letter to be sent to all allotment tenants regarding advice on water conservation.  Action: Bruce Jones.

Members agreed that no refunds on water charges would ever be made under any circumstances e.g. if a hose pipe ban were to be imposed.  Action: Jean Hallam, Bruce Jones, Diana Reay and all Berkhamsted Town Council Staff.

Members agreed that once information was available as a result of actions to both item 06/14.1.1. & 06/14.2.2. above, a letter would be written to all tenants stating firstly the position regarding the imminent hose pipe ban based on Three Valleys Water’s advice to the Town Council and secondly what measures tenants can take to conserve water on the allotments and thirdly that no refunds of water charges would be given under any circumstances.  Action: Assistant Town Clerk.

Members discussed the idea of incorporating advice to tenants on measures they could employ to conserve water in an allotment welcome pack.  It was agreed to discuss the welcome pack at the next meeting.  Action: Assistant Town Clerk.

The Town Clerk was asked to arrange for the Town Warden to undertake a site survey of each allotment site in order to locate the position of underground & above ground water services, as well as to ascertain the nature and condition of site boundaries.  It was suggested that the Town Warden approach Dacorum Borough Council to see if he could borrow their CATS scanner which would help him locate underground metal pipework.  Action: Town Clerk & Town Warden.

The Assistant Town Clerk was asked to speak to the Town Warden to ascertain which allotment water meters are proving difficult to read due to water vapour being trapped behind the glass meter lens.  He was then asked to contact Three Valleys Water to see what they could do to rectify the problem.  Action: Assistant Town Clerk.

Members agreed that, in the light of the imminent hose pipe ban, no further allotment water supply licences should be granted until the ban is lifted.  Action: Diana Reay, Jean Hallam, Bruce Jones and all Berkhamsted Town Council staff.

06/14.2.2.   Review of allotment water pricing policy

Members agreed to defer discussion of this matter until the Town Council was aware of what the new water charges would be.  Action: Assistant Town Clerk.

06/15.  TENANT EVICTION APPEALS PROCEDURE

06/15.1.     Members agreed that the tenant eviction appeals procedure stated in paragraph 19 of the Allotment Management Team’s Constitution should apply (the non AMT Councillor being elected on an adhoc basis), namely: 

“An appeals procedure against termination of an allotment tenancy will consist of the AMT Chairman, the Town Clerk and one non AMT Councillor who will consider the details of the appeal by interview with the tenant or through written communication. The tenant may be accompanied at an interview.“  (Minutes of Full Council dated 19/01/06 Vide 08/06)

06/18.  MINUTES OF THE MEETING HELD ON 22ND MARCH 2006

06/23.4.1.         It was agreed not to proceed with this work but to try locking the existing gates instead.

06/24.3.3.         A reply was awaited from the Town Clerk regarding action to be taken to reduce the number of rabbits on Sunnyside allotments.  Action: Town Clerk.

 

06/25.  BUTTS MEADOW ALLOTMENT

06/25.3.1.         There is now a waiting list for allotment plots.

06/25.3.2.         Dennis Hallam advised that a new notice board had been installed.

 

06/26.  BONFIRES

06/26.1.            After discussion the following action was agreed:

                                            i.       A letter is to be written to Brian Scott or David Austin to ask what happens to material on Dacorum Borough Council allotment sites that would otherwise be burnt, and whether they would be willing to remove similar material from Berkhamsted Town Council’s allotment sites.  Action: Town Clerk. 

                                          ii.       Freda Earl & Angela Wheeldon will prepare a letter to be sent to all tenants regarding the subject of bonfires and stating that the Town Council will be working towards minimising bonfires on all sites.  Members agreed that the contents of this letter would need to be approved at the next meeting before it can be issued.                                                  Action: Freda Earl/Angela Wheeldon.

 

06/27.  ALLOTMENT STRATEGY

06/27.1.            Bruce Jones agreed to prepare a detailed strategy for consideration by members at the next meeting.  Action: Bruce Jones.

 

06/28.  REVIEW OF ALLOTMENT WATER PRICING POLICY

06/28.1.            Diana Reay agreed to revisit the ‘allotment water consumption for years 2000 to 2003 inclusive’ spreadsheet, issued with the AMT agenda for the meeting of 25th February 2004 (Vide 04/10), to try to establish a suitable allotment water charge (per 25.292 square metres – where 25.292 square metres = one pole).                   Action Diana Reay.

06/28.2.            It was agreed that the ban on issuing allotment water supply licences would be lifted.  Action: All allotment representatives/Town Council staff.

 

06/29.  WELCOME PACK FOR NEW ALLOTMENT TENANTS

06/29.1.            Dennis Hallam & Diana Reay agreed to provide site-specific items for the welcome pack that will be considered at the next meeting.                                               Action: Dennis Hallam & Diana Reay.

Sunnyside:

Should have 6 rolls of polythene set aside, not 5 as minuted.

Mr. Dyer disputed the wording of the minute at 02/34.3.2 and said that as far as he was aware a special meeting of the town Council had not taken place to discuss the wording of the new tenancy agreement.  The town clerk explained that the proposed changes were so minor that a special meeting had not been necessary.

Angela Wheeldon drew attention to the Berkhamsted freecycle scheme.

05/46.  SUNNYSIDE OLD AND SUNNYSIDE NEW ALLOTMENTS

05/46.3.          Site Representative’s Report 

·        Two damaged ball valves, subject of vandalism, had been repaired and a means of protection installed. Work had been carried out by a new tenant.

·        Vacant plot signs had been uprooted by vandals.

·        There had been an attempted break in to the Sunnyside Rural Trust Training Centre

·        Concern was expressed that Plots 14 – 19 had been removed from the SRT lease but immediately returned to SRT as tenanted plots. It had been thought that these plots would be added to the bank of plots available for letting to the public. The Chairman explained that the adjustments to the boundary of the SRT lease had been to tidy the map where several plots vacated too late to be included in the original lease had been tenanted by SRT as allotment plots. The Town Council did not want to increase the size of the leased land by adding in these plots to the new lease, which would have reduced the area of land available for allotments. It therefore proposed to SRT that in consideration of these plots being taken from allotment tenancy and added to the leased land, plots 14 – 19 would be taken from the lease and returned to allotment use, but tenanted by SRT as part of Sunnyside Wildspace partnership as they were before. There had been confusion between ‘allotment use (and vacant)’ and allotment use (and tenanted).

 

05/47.  BUTTS MEADOW ALLOTMENT

05/47.3.          Site Representative’s Report 

·        Small amount of rubbish awaiting collection – Action Town Warden

·        Request to have the small gate welded to keep it closed. Two or three tenants have a key to the padlock which breaches security of the site. Action Town Warden

·        Council shredder to be requested preferably for a Saturday, and the shreddings left on site as mulch.

·        Rotavator being renovated

·        Now have a tree stump remover. Will see if it is effective.

·        New plot signs needed for some plots. Jean Hallam will see if they can be made by the tenants concerned. (Note – previous plot signs were made by Sunnyside Rural Trust.

·        Plot 21 is overgrown and unsuitable for tenanting.

 

05/48.  ANNUAL MAINTENANCE CONTRACT 

Ted Dyer reported that the maintenance by Frank Cooper & Son had not been so good as in previous years. They appeared to be sub-contracting the grass cutting and the quality had reduced. The full width had not been cut and they had to be asked to return to complete. Also the hedge cutting had not been completed for the full length to the railway line.

It was agreed to write to Frank Cooper & son to ask for their views on the matters raised and not to accept the quote until a reply had been received.

05/49.  BONFIRES:  CLARIFICATION OF TENANCY AGREEMENT 

Following discussion it was agreed to write to all tenants regarding the problem of bonfires on allotment sites, with particular reference to the leaflet, and ask for their suggestions on how the problem can be resolved, by use of a returnable slip.

05/50.  TENANTING ALLOTMENTS TO PERSONS OUTSIDE THE PARISH 

It was agreed that a recommendation should be made to Full Council that in future, allotment plots should only be let to residents of Berkhamsted Parish. The reason for this was the current high demand for plots on all sites.

05/51.  BERKHAMSTED TOWN COUNCIL’S ALLOTMENT PLOT LETTING POLICY 

Deferred to the next meeting of the Management Team.

 

05/52.  CLARIFICATION OF THE POWERS AND DUTIES OF ALLOTMENT REPRESENTATIVES, ALLOTMENT SOCIETIES, AND BERKHAMSTED TOWN COUNCIL 

It was agreed to hold a special meeting to prepare a Constitution for the Allotment Management Team for consideration by Full Council. It was important for the Management Team to identify precisely what their role was.

It was agreed that the meeting should be held on the 23rd November 2005 at 2.30pm.

It was agreed that a survey of all sites should be carried out by the Town Warden with Site representatives to identify the extent of the problem.

A letter to be sent to all tenants informing them not to bring asbestos in any form onto allotment sites.

05/57.  WELCOME INFORMATION PACK FOR NEW TENANTS

05/58.  AGREEMENT WITH MR IAN JOHNSTON ABOUT CARE OF OAK TREE ON DELLFIELD 

The Chairman referred to a letter received from the tenant of plot DF 13 asking for a reduction in rent by converting the plot to 5 poles because of the detrimental effect of the Oak tree on the neighbouring plot.  Following discussion it was agreed to reduce the plot to 5 poles and the rent accordingly.

However, the request for a replacement shed to be provided was not agreed.

 James Richards to be advised by letter.

Action Town Clerk/ Bob Price. 

It was further agreed that any works to the Oak Tree would be undertaken by the Town Council and not by the tenant of the plot on which it stands. Mr. Johnston to be notified by letter of this decision, and that access to the plot would be needed when works were to be carried out.
