307/04 APOLOGIES FOR ABSENCE There were no apologies for absence.
308/04 TO RECEIVE DECLARATIONS OF INTEREST REGARDING ITEMS ON THE AGENDA The Chairman declared a personal interest in planning application 4/2428/04 - Works to trees at 38 Kitsbury Road.
309/04 MINUTES The minutes of the previous meeting held on the 1st November 2004 were agreed and signed by the Chairman subject to the word “contrary” being added to the third line of the recommendation for 4/2411/04. The minutes were amended.
310/04 MATTERS ARISING Vide 300/04 – Enforcement matters The Chairman reported that in respect of 37 Kings Road the shed on the boundary had not been removed but had been reduced to 4 feet. He asked for the Enforcement Officer to be notified. Vide Item 303/04 – Planning Application 4/2411/04 88 Kings Road Following representations from the Planning Officer the recommendation was slightly adjusted to read as follows: Object as the information provided on the application form said that the existing building was 138 square metres with the new floor space being 280, yet the lost floor space would be 1485. It is therefore insufficient to judge the full impact of the development proposal and is therefore contrary to Policy 11 of the Dacorum Borough Local Plan.
311/04 CHAIRMAN’S COMMUNICATIONS Notification had been received from RICS East of England that 26 entries had been received as Landmarked buildings in the East of England. It had been decided not to choose a winner but to celebrate the diversity of those buildings by putting together a booklet containing photographs and details. Notification had been received from Planning Officer, Yvonne Edwards, that application 4/1204/04 at 10 Shrublands Road had been granted by the Development Control Committee. Notification had been received from NALC that the Office of the Deputy Prime Minister had published a revised circular relating to the negotiation of Planning Obligations under Section 106 of the Town & Country Planning Act 1990. Copies of the consultation were available at www.odpm.gov.uk/planning. Comments were required by 18th January 2005. A response had been received from Planning Enforcement Officer Egan to the list of outstanding enforcement issues notified to him following the last planning meeting. The response had been copied to the Chairman.
312/04 PUBLIC PARTICIPATION There were 15 members of the public present. Mr. E. Dyer said that he was intrigued as to who was proposing to obtain independent advice concerning the safety issues as a result of the development at 77 High Street. He hoped that this was not a Town Council initiative as Hertfordshire Highways had abrogated their responsibilities. Mr. Dyer said that there was mention of Section 106 Agreements under Chairman’s Communications and it was time that developers with whom agreements had been reached were obliged to make good damage caused to the highway during development. He cited Manor Street and Three Close Lane as examples.
313/04 ROAD NAMING – SEVEN NEW HOUSES OFF OAKWOOD Following discussion it was agreed to recommend: Hockeridge View As the Town Council’s preferred name for the new road off Oakwood. Action Town Clerk
314/04 TO CONSIDER EMPLOYING AN INDEPENDENT CONSULTANT TO ADVISE ON PEDESTRIAN AND VEHICLE SAFETY AT THE PROPOSED DEVELOPMENT AT 77 HIGH STREET (4/2371/04) Members were informed that this application was due to be heard by the Development Control Committee on Thursday 2nd December 2004 and it was agree to defer consideration of the employment of an independent consultant until the decision was known. It was further agreed that the Town Planning Committee would be represented at the Committee meeting and that the representative would wish to address the Committee. Action Town Clerk
315/04 PLANNING APPLICATIONS The Committee considered forms and drawings for applications relating to the Town of Berkhamsted which had been received from Dacorum Borough Council up to the date of the meeting and it was RESOLVED That Dacorum Borough Council is informed of the Council’s comments and observations, if any, as follows. The Council also trust that due regard will be taken of any objections which may be received from neighbours in the vicinity.
4/1938/04/FUL AMENDED PLANS & ADDITIONAL PLAN (no. 1354/18) - Alterations and extensions to allow conversion into seven apartments and construction of eight apartments over car parking with glazed link to Mill at Castle Mill, Lower Kings Road. (PN) Object due to the adverse impact of the visual appearance, design and bulk on both the Town and Canal-scape. The extension is obtrusive and should not dominate the appearance of the original Mill. The Committee consider that any conversion, including the plant room, should be sympathetic to the existing architectural features and be no higher than the existing building.
4/1993/04/RET AMENDED PLANS – Patios and privacy screens at various plots at The Mansion, Berkhamsted Hill. (JC) Mr. Cyril Collins was present along with a number of residents of Castle Village to object to that part of the application which required the patios to be reduced in size. He said that this was a retrospective application which contained a number of errors and omissions and apparent misunderstandings by the Planning Department Case Officer. The screens which had been erected were not fences and did not enclose any part of the land. They were therefore not contrary to any requirements made by the developer or the local authority at the construction stage. The screens provided privacy to the residents and they should be retained. Object to the reduced patio area which would be insufficient for adequate wheelchair access.
4/2246/04/FHA AMENDED PLANS – Loft conversion with front rooflight and rear dormer at 23 Queens Road. (YE) No Objection
4/2271/04/FUL AMENDED PLANS - Rear extension 200 High Street. (YE). No Objection
4/2371/04/FUL ADDITIONAL PLAN – Demolition and replacement of one two-bedroom house and the construction of nine two-bedroom houses at 77 High Street. (YE). Object to the design of No. 77, which is inappropriate, as the ridgeline and fenestration should match that of the adjoining properties and not that of the demolished property. It is therefore contrary to policy 11d of the Dacorum Borough Local Plan 1991 -2011. Object due to the unsafe nature of the access to and from the site,

4/2438/04/FUL Conversion of upper floor offices to form twenty flats (AMENDED SCHEME incorporating two additional flats) at 221-233 High Street. (RF) Councillor Geraldine Corry asked for her objection to the two additional studio flats to be recorded. No Objection
4/2448/04/FUL Change of use of part of residential unit to Chiropody Practice at 260 High Street. (PN) No Objection
4/2450/04/FHA Part two-storey and part single storey side extension, two storey rear extension, single storey rear extension, porch and new front boundary wall and rails at The Dyke, Graemesdyke Road. (FB) No Objection. The Tree Officer should be made aware that trees to be felled are not covered by a TPO.
4/2451/04/FUL Installation of new shop front at 227-229 High Street. (TP) No Objection. The Committee noticed that the position of the existing projecting sign is between 227 and 229 High Street and not 225 and 227 as shown on the plan.

4/2473/04/FHA Loft conversion with rear dormer at 53 Kitsbury Road. (YE) Object because the dormer would have an overbearing impact on the roof by reason of its design, scale and siting in that it is less than a metre from the flank wall of No 54. It would fail to complement or be in proportion with the existing building and so would appear out of keeping with, and have an adverse effect on, the character and appearance of this part of the Berkhamsted Conservation Area.

4/2489/04/FHA First floor side extension at Vaughan House, 1 Shootersway Park. (EP) No Objection
4/2493/04/FUL Dwelling adj. Hardrick, Shootersway. (FB) Mr. P. Sharper, a local resident, was present to object to the application and produced plans for members of the Committee to show the effect of a three-storey building between two adjacent two-storey existing dwellings. He said that the amended plans showed that the building was wider than the previous one, which had been turned down, and the side access was insufficient at 2’ 6”. Object as the height of the building at three storeys is in excess of the two recommended in the Supplementary Guidelines for Shootersway, and therefore has an adverse impact by reason of its design, on the area; the space on either side of the single storey rear ‘extension’ is only a metre which is overbearing by its design by having a larger foot print than the front of the house. It is therefore contrary to the guidelines set down in Appendix 3 paragraph (iii) ‘Layout and Design of residential areas’ relating to Spacing of dwellings with regard to the cramped layout and loss of privacy.

(JA) Object to the single storey front extension only in terms of design and bulk which therefore harms the surrounding and adjoining neighbourhood, through visual intrusion and loss of privacy. 4/2530/04/FUL Change of use of ground floor from commercial to residential and creation of three bed dwelling at The News, 279 High Street. (YE). No Objection
4/2535/04/TPO Works to trees at 15 Oakwood (BC). Object to the work to T2 as the clearance over the pavement is good and that there is no overhang of the road. The Committee is concerned at the proposed works to T1 following the maintenance carried out last year in that the balance and appearance of the tree would be damaged.
4/2570/04/RET 15m monopole with three antennae, one dish, radio equipment housing and ancillary development at Berkhamsted Town Football Club, Broadwater. The proposal introduced a terrace into a row of semi-detached properties. b. No alterations had been made to resolve the on-street parking problem for residents which was severe at school opening and closing times and when events were held. c. The shared access compromised security. d. The proposed new dwelling was smaller than no.21 which had already been reduced in size in comparison to its neighbours. e. The new dwelling would be the only house in Swing Gate Lane where wheelie bins would have to remain outside the front. Object due to the adverse visual appearance this additional house would have being added on to one of several attractive semi-detached houses. The doors and windows do not align with numbers 21 and 23. If built the additional crossover would result in a reduction of the availability of on-street parking. The provision of a right of way through the rear garden of the proposed development would lead to loss of privacy to the neighbouring property.

4/2371/04/FUL Demolition and replacement of one two-bedroom house and the construction of nine two-bedroom houses at 77 High Street. (YE) There were a number of local residents present to object to the application represented by Mr. Colin Garrett. Mr. Garrett provided a report for the Chairman and quoted Councillor Ian Reay, Dacorum Borough Council Planning Portfolio Holder, from the most recent edition of the Berkhamsted Review. The main objections put forward on behalf of local residents were that the development would not enhance the Conservation Area nor would they benefit the community at large. The access was still dangerous and unsuitable and would cause further deterioration of traffic congestion. He urged members of the Committee not to be led astray by the spurious opinions of experts who had commented on the proposals but to use their own common sense and local knowledge to recommend that the application should be refused. Object to the design of No 77 as its design is inappropriate as the ridge line and fenestration should match that of the adjoining properties and not that of the demolished property and is therefore contrary to policy 11d of the Dacorum Borough Local Plan 1991 to 2011. Object due to the unsafe nature of the access to and from the site, It is still strongly recommended that a site visit takes place to include Ward Councillors of the Town Council, representatives of Hertfordshire Highways, the Planning Officer and a representative of the developer, at a peak traffic time during the school term in order to fully appreciate the dangerous nature of the access/egress.

291/04 CHAIRMAN’S COMMUNICATIONS Notification had been received that appeals in relation to planning applications 4/0847/04 and 4/0848/04 had been withdrawn but the appeals for 4/1176/04 and 4/1177/04 would go ahead at the inquiry at a date to be confirmed. An agenda had been received and circulated for the Annual Planning Seminar with Town and Parish councils to be held at 6.30 p.m. on 26th October 2004 in the Bulbourne Room. The appeal by Berkhamsted Town Council against the failure of Dacorum Borough Council to determine the planning application for the skateboard park on Velvet Lawn had been acknowledged by the Planning Inspectorate.
292/04 PUBLIC PARTICIPATION There were four members of the public present. Angela Wheeldon asked if the bodged brickwork on Bridge 99 opposite the Crystal Palace public house had to be accepted. The parapet was yellow. It was blue on one side and it was a dog’s breakfast. It was agreed that Councillor Corry and the Town Clerk would visit the scene and assess the problem. (YE) Object as there are insufficient drawings to show how the first floor roof profiles relate to either the front or rear extensions with No 12, as it appears to be higher and out of keeping with all the canopies on this row of eight houses. It would therefore have an adverse impact on the appearance of the Conservation Area opposite. 4/2024/04/FUL AMENDED PLANS – Demolish existing dwelling and construction replacement dwelling at South Gables, 22 Meadway (FB). A spokesperson said that this proposed development was in the middle of a row of neat semi-detached houses. The proposal would close space between them and introduce a terrace. The proposed house was much larger than others in Swing Gate Lane and was of a bulky construction. The privacy of no. 19 would be compromised and some street parking would be reduced adding to the severe parking problems particularly associated with the nearby school. Another local resident pointed out that there did not appear to be a rear access to the existing house at no. 21. This would cause problems especially with wheelie bins. Object due to the adverse visual appearance this additional house would have being added on to one of several attractive semi-detached houses. The doors and windows do not align with numbers 21 and 23. If built the additional crossover would result in a reduction of the availability of on-street parking. No provision seems to have been made for rear access to no. 21.

A spokesperson on behalf of CARAB and the Castle Street residents urged the Town Council to reject the application, which was inappropriate in the Conservation Area. The roof was dominating and oppressive and the windows and frontage had an industrial look. There would be increased traffic flow from Castle Street to Mill Street and noise pollution from increased functions at the school. There would be an adverse impact on the homes of local people including loss of light. Mrs. Susan Johnson on behalf of Berkhamsted Citizens Association said they were not opposed in principal to the development and recognised the need of the school to expand. They also did not object to the demolition of some of the existing buildings, however, the plans produced were an inappropriate design in the Conservation Area and they particularly objected to the repetitive gables, fenestration and the vents, which looked like a forest of aerials. A representative of the Chiltern Society read a letter of objection and said that the proposals would dominate the street-scene, were out of sympathy with existing housing and the visible chimneys were out of keeping with the Conservation Area. New street elevations and window designs were needed to fit in with the area. Object because of the impact the proposals have on Castle Street, Mill Street and The Moor by their visual appearance, the adverse impact on the Conservation Area and the listed Grade II building opposite. The cowls at over 3m dominate the roof profile that will clearly be seen from a distance. The scattered obscure fenestration damages the historic Castle Street street-scene and the visual appearance from The Moor. The building is hard up against the garage beside 44 Castle Street preventing maintenance to either building. Concerns were also expressed with the design of the river alterations and that the proposals would dominate the river and reduce it to a ditch. Members expressed a desire to see the report from the Environment Agency.

She would have a wall only one foot from her boundary which would cause loss of natural light and loss of sunlight in the afternoon. She was concerned that damage could be caused to her property by drainage and ventilation and that she may suffer damp from the shower on her party wall. Object as the proposed extension by virtue of its relative height and positioning, would have an overbearing impact on the neighbouring property, and would result in loss of sunlight, contrary to Policy 11 of the Dacorum Borough Local Plan 1991-2011. Also that the egress onto Gravel Path was dangerous and there was an issue of ownership of the land in respect of which the management company had not been consulted and would not give their consent to any request for permission of use. Object on the following grounds: a. Over-development of the site. b. The original estate was conceived as an integral set of buildings and any addition would not be in keeping with the original concept. c. Any proposed building would increase the poor visibility on egressing the site by vehicles and pedestrians, as there is no pavement on that side of Gravel Path. d. (RF) A representative of Berkley Court was present to object to the application, which constituted a change of use from a garden to a repair workshop. There would be noise from electrical saws all day long and he had noted that the staff using the equipment were required to wear ear protectors. The noise would adversely affect the quality of life of the residents. Support as the temporary hut will be well screened and further away from windows on Berkley Court, but subject to conditions stipulating hours of use being imposed to minimise disturbance to nearby residents. Appropriate soundproofing measures should be installed and screening should be erected around the vacated site.

4/1498/04/FUL Skateboard Park at Velvet Lawn recreation ground, Swing Gate Lane. (NG) Mr. N. Cutting said that the proposed site of the Skateboard Park was within 10 metres of a hedge and two trees. It was also less than 100 metres from the nearest dwelling. If the plan was correct it would intrude on the football pitch. There was mention of a footpath in the application which was not shown on the drawing. Contrary to statements made in the application the Park would not be seen easily from Swing Gate Lane as the view was obstructed by trees. There were no toilet facilities on the site. There was no information on the proposed catchment area. The site was too far from the Town centre and would not attract skateboarders from a very wide area. If it was constructed on Velvet Lawn it should be moved closer to the existing playground and should be subject to a four-year temporary permission. The management group should be set up before it begins operating and CCTV should be installed before use. There were two members of the Berkhamsted Youth Town Council present who objected to the proposed location of the skateboard park. They said it was too far from the centre of the Town and other locations such as Canal Fields should be considered. They were concerned that Velvet Lawn would not be a safe area for users and were confident that a more suitable location could be found. 229/04 CHAIRMAN’S COMMUNICATIONS A copy of a letter sent to David Noble, Dacorum Borough Council, by Councillor Fantham, Chairman of Northchurch Parish Council had been received asking why a planning application for a bus shelter at the junction of Darrs Lane and the A4251 had been referred to Berkhamsted Town Council, for information. Notice had been received from Dacorum Borough Council of the adoption of the Borough Local Plan 1991-2011 on 21st April 2004. Copies were available from 12th May 2004 at the Civic Centre, Berkhamsted. A letter had been received from English Heritage providing information about their blue plaque scheme. The letter had been copied to Councillor Talbot-Ponsonby.

(JC) There were a number of members of the public present to object to this application. Mr. Cyril Collins a resident of Castle Village, though not representing anyone else, said that his remarks were shared by a number of people including the Residents Association. Mr. Collins read a long statement listing numerous points including: a. Detrimentally altering the peace, (noise and light pollution), tranquillity and views in an Area of Outstanding Natural Beauty. b. Restricting a Right of Way. c. Danger from wayward golf balls. Mr. Collins showed members pictures of similar golf range fencing. Object as the proposals are contrary to Policy 42 of both the Hertfordshire Structure Plan Review 1991-2011, the Hertfordhsire Structure Plan Alterations 2001-2016 Deposit Draft version, Policies 8, 73 & 90 of the Dacorum Borough Local Plan and Policies 9, 79 & 96 of the Dacorum Borough Local Plan Deposit Draft in that the site is within the Chiltern’s Area of Outstanding Natural Beauty, wherein the prime consideration is the preservation of the natural beauty of the area. The proposed application would result in the change from rough grazing to a more manicured grassed area. The erection of a fence would be detrimental to the character and appearance of the site which would fail to preserve the natural beauty of the area. There is a potential danger from golf balls to pedestrians using the public footpaths and to nearby properties. There is also a possibility of increased traffic resulting from the new facilities which cannot be adequately catered for. It is understood that a condition of the original Section 106 Agreement following the development of Castle Village required that the land subject of the application should be retained in its original state. This condition should not be overturned.
